Former Sixteenth (16th) Division

PEOPLE OF THE CA-G.R. CR No. 41169
PHILIPPINES,
Plaintiff-Appellee, Members:

BARRIOS, M. M., Chairperson,

- versus - LEGASPI, G. F. D., and
ONG, W. S., JJ.

CARLITO TADEO y SAGUN, Promulgated:

Accused-Appellant.
AUGUST 27 2020

RESOLUTION
LEGASPI, G. F. D., J.:

Before Us is accused-appellant Carlito Tadeo's motion for

reconsideration1 of Our 27 January 2020 Decision2 which denied his appeal.
In praying for his acquittal, accused-appellant insisted that there are gross
inconsistencies in the prosecution witnesses' testimonies and that there was
unlawful aggression on the part of Willy Lapuebla.

In its comment3, plaintiff-appellee People of the Philippines, through

the Office of the Solicitor General, prayed for the denial of the motion for
reconsideration for lack of merit.

An examination of the arguments raised in accused-appellant's motion

for reconsideration reveals that the same are a mere rehash of the basic
matters raised in his appeal and which were already exhaustively passed
upon, duly considered and resolved in Our 27 January 2020 Decision.

IN VIEW OF THE FOREGOING, the instant motion for

reconsideration is DENIED.

SO ORDERED.
