The humble regular bail

application on behalf of the

petitioner named above;

MOST RESPECTFULLY SHEWETH:

1. That the present regular bail application is

being preferred on behalf of the above named petitioner in

connection with Ramgarh P.S Case no 61/2020, u/s 379/411/34

of Indian Penal Code, 1860 (I.P.C)

2. The case is now pending for trial in the

Court of Learned Addl. Session Judge-IV, Ramgarh. Further it is

submitted that on completion of investigation, chargesheet has

been submitted, cognizance has been taken by the lower court.

3. Now the petitioner has moved regular bail

application in this case before this Hon'ble High Court.

4. That the brief fact of the case is as follows:

The FIR has been lodged on the written report of Shankar

Yadav. It is alleged in the FIR that the informant is employed as

mechanic in Bihar Foundary and spong Factory. On 13.02.2020

at about 9:00 AM, he came to the factory with his Hero

Splender Plus motorcycle bearing registration no. JH-02AA-7656,

Engine No. HA10EJD9K0414 and Chesis No. MBLHA10AMD9K-

04116 and put his motorcycle in the motorcycle stand. When he

returned after finishing his work at 6:00 PM, he found that his

motorcycle was missing from there. He searched the motorcycle

but could not traced. Thereafter, he submitted the theft report

of his motorcycle before the police. Hence the FIR was lodged.

5. That the cause of action has arisen within

the territorial jurisdiction of the High Court of Jharkhand.

6. That the petitioner has been arrested by

the Police on 17/02/2020 and since then the petitioner has been

languishing in judicial custody.

7. That the petitioner has been falsely

implicated in this case.

8. That the petitioner thoroughly is innocent

and has committed no offence as alleged.

9. That the entire allegations leveled against

the petitioner is fictitious, imaginary and concocted one. There

is no shred of truth therein.

10. That, entire case of the prosecution is

based on the conjecture and surmises.

11. That this bail application has been filed on

behalf of Suresh Bediya. He has been wrongly implicated in this

case on the basis of the confessional statement of co-accused.

The alleged stolen motorcycle was not recovered from his

possession. Therefore , he may be enlarged on bail

12. That the chargesheet has been filed in this

case and the case is pending for trial in the Court of Learned

Addl. Session Judge-IV, Ramgarh.

13. That the petitioner has moved regular bail

application before the the Court of Learned Addl. Session Judge-

IV, Ramgarh. But the prayer of bail has been rejected by the

Court of Learned Addl. Session Judge-IV, Ramgarh vide order

dt. 18.05.2020.

14. That there is no apprehension of either

tempering with the evidence or to abscond in this case, if the

petitioner is granted regular bail as the chargesheet has already

been filed.

15. That the petitioner is ready to furnish bail

bond of sufficient amount to the satisfaction of the learned

Court below.

16. That other and further point shall be urged

at the time of hearing.

bail in connection with Ramgarh P.S
