following Affidavit is being offered to prove the following :

1. That there was a legitimate buy bust operation;

2. That the accused was arrested in flagrante delicto peddling

illicit drugs; and

3. The identity of the seized buy bust money and illicit drugs.

JUDICIAL AFFIDAVIT

Ako si PO3 Johnny Walker 25 taong gulang, kaanib ng

pambansang Pulisyang Pilipinas at kasulukuyang nakatalaga sa
Drug Enforcement Unit (DEU) ng Himpilan ng Pulisyang Lungsod ng
Santiago na matapos makapanumpa alinsunod sa ating umiiral na
bagong Saligang Batas ay malaya at kusang loob na nagsasalaysay
at pinagtitibay ang mga sumusunod;

 PAUNANG PAHAYAG
Ako ay siniyasat ni Atty. Lurimar A. Raguini, ng City
Prosecutor’s Office ng Lungsod ng Santiago na may opisina sa
Gandara Building, Lungsod ng Santiago. Ang pagsisiyasat na ito ay
ginawa sa nasabing opisina sa wikang Filipino. Sinagot ko ng
makatotohanan ang kanyang mga katanungan at ipinaliwanag niya
sa akin na ako ay sumusumpa at kung ako ay magsisinungaling ay
maari akong makasuhan ng “perjury” o “false testimony.”

TESTIMONYA
T: Magandang Hapon po. Ikaw po ba ay si PO3 Johnny Walker,
ang isa sa mga witness sa kasong ito?
S: Opo.
T: Bakit ka narito?
S: Upang magbigay testimonya at patunay bilang isang poseur-buyer
sa pamamagitan ng sinumpaang salaysay na ito.
T: Ano ang iyong pangunahing tungkulin?
A: Ang aking pangunahing tungkulin ay maniktik, magmanman,
mangalap ng impormasyon at manghuli ng mga tao na lumalabag sa
batas at resolbahin ang mga kaso na inilalapit sa aming tanggapan;
T: Maari mo bang ilahad kung ano ang nangyari noong gabu ng May
23, 2020?
A: Opo. Na, ang oras ay 8:00 ng gabi ng May 23, 2020 habang kami
ay nasa aming himpilan at malayang tumutupad ng aming tungkulin
ay nagsadya sa amin ang aming CA (Confidential Agent), at
ipinarating sa amin ang inpormasyon na talamak na pagbebenta ng
droga o pinaghihinalaang ipinagbabawal na gamot /SHABU nitong si
@ Balong sa kanilang lugar sa Baptista Village, Villasis, Santiago
City. Na ayon sa aming CA, itong si @ Balong ay bagong
nagbebenta ng shabu at gumagamit din, malimit lang na nasa labas
ng kanilang bahay naka istambay at nag aantay ng kanyang mga
parokyano;
T: Matapos mong malaman ang ulat ng inyong confidential agent,
ano ang iyong ginawa?
A: Ang nasabing ulat ay agad ko ipinabatid sa aming Chief Intel na si
PLT. Alfonso Napoleon. Na agad din naman niyang inu utos sa
aming team leader na si PMSG. Heinekken Emperador, na
magsagawa ng mabilis na aksyon at pagmamanman dito kay @

Balong na talamak na nagbebenta ng ipinagbabawal na gamot sa
kanilang lugar sa Baptista Village, Villasis, Santiago City. Na agad
din namin tinawagan ang aming CA, upang kami ay samahan sa
magmanman dito kay @ Balong. Na aming din ipinatala sa
nakatalagang Desk Officer ang aming gagawin pag mamanman, at
pumunta kami nasabing Barangay sakay ng aming pribadong
sasakyan;
T: Ano ang sumunod na nangyari?
S: Nang marating namin ang Baptista Village ay tumambay kami di
kalayuan sa lugar kung saan abot tanaw lang ang bahay ni @
Balong na nakilala ng aming CA itinuro niya sa akin itong si @
Balong. Na ayon sa aming CA na itong si @ Balong ay malimit na
nasa labas at nag aabang ng kanyang mga parokyano o customer.
Na habang ako at ang aking CA ay naka istambay sa nasabing lugar
ay may nakita kaming dumating na isang lalaki, lumapit dito at
nagkipag usap kay @ Balong, nakita ko na dumukot sa bulsa ang
lalaki ng pera at iinabot kay @ Balong, pagkatapos matangap ni @
Balong ang pera ay nakita ko din na dumukot naman siya sa
kanyang kaliwang bulsa ng isang coin purse at kumuha ng isang
pirasong heat-sealed transparent plastic sachet na naglalaman ng
hinihinalang shabu sabay inabot sa lalaki at pagkatapos ng kanilang
transaksyon ay agad din umalis ang kanyang parokyano. Na
pagkatapos ng aming nasaksihan ay agad naman kaming bumalik sa
aming opisina upang iulat sasa aming hepe at sa ang aming team
leader na si (PMSG Heinekken Emperador) ang transaksyon na
pagbebenta ng ipinagbabawal na gamot nitong si @ Balong;
T: Matapos niyong makumpirma na mayroon ngang nagaganap na
bentahan ng Droga, ano ang inyong ginawa?
A: Alas- 9:00 nung gabi ng May 23, 2020, kami ay bumalik sa aming
himpilan, at inulat ko sa aming hepe ang lantarang pag-bebenta ng
pinaghihinalaang ipinagbabawal na gamot o shabu nitong si @
Balong kayat aming din itong ipinatala sa aming Desk officer;
T: Ano ang ginawa ng iyong hepe?
S: Agad inutos ng aming hepe PLT COL LEMONO MATADOR na
mag sagawa ng Buy bust operation laban dito kay @ Balong sa
kanyang lantarang pagbebenta ng ipinagbabawal na gamot at kami
ay nag sagawa ng pagpupulong sa aming gagawing operasyon;
T: Maari mo bang ilahad kung ano pa ang mga sumunod na nangyari
ng gabing iyon?
A: Opo. Nang ang oras ay alas 10:30 ng gabi noong May 23, 2020 ay
nagpatala kami sa aming Desk Officer ng Isang pirasong isang

Limang daang piso papel na may serial number NJ863633 na galing
sa aming Finance Section, nilagyan ko ito ng markang “X” sa loob ng
selyo ng pera upang gamiting marked money sa Buy-bust Operation
at naki pag Coordinate din kami sa PDEA PRO2, at kami ay binigyan
ng PDEA Cert.10005-012020-1386 para dito kay @ Balong na may
petsang May 23, 2020 mula kay Agent Kiki Ng Inamo. Na ang Team
leader ng Drug Enforcement Unit, sa pamumuno ni PMSG
Heinekken Emperador, at ako PAT Johnny Walker ay naatasan na
maging Poseur Buyer (PB) at si PAT Miguel G. Nebra ay ang
magsisilbing Back-up security, Photographer habang ang iba pa
naming kasamahan ay magsisilbing Security Perimeter. Na ang
aming napagkasunduan na ang PRE-ARRANGED SIGNAL ay ang
pagtangal ko ng aking suot na sumbrero, bilang palatandaan o
hudyat na ako ay positibong nakabili ng ipinagbabawal na gamot o
SHABU;
T: Matapos ang pagpupulong ano ang inyong ginawa?
A: Agad naman namin tinawagan ang aming CA, upang kami ay
samahan na mag tungo dito kala @ Balong sa Baptista Village,
Villasis, Santiago City upang bumili ng ipinagbabawal na gamot. Na
pinapuntahan din namin ang DOJ representative sa aming
kasamahan upang sunduin ngunit walang tao sa kanilang opisina. Na
ang oras ay 11:45 ng gabi ako ay ipinakilala ng aming CA, dito kay @
Balong at sinabi ko na bibili kami ng item o Shabu. Na agad naman
niyang itinanong sa akin kung magkano ang aking kukunin, sumagot
naman ako na halagang Limang daang piso lang pang gamit;
T: Ano ang iyong ginawa pagkatapos ng pag-uusap niyo ni
@Balong?
A: Agad ko naman iinabot ang aking pera dito kay @ Balong at
pasimple siyang dumukot sa kanyang bulsa na isang coin purse at
kumuha siya ng isang pirasong HTPS na hinihinalang shabu at pa
simple niya itong iinabot sa akin;
T: Pagkatapos ng palitan ano ang iyong ginawa?
A: Pagkatapos ko na matangap ang isang pirasong heat sealed
transparent plastic sachet na naglalaman ng hinihinalang shabu
mula dito kay @ Balong ay agad ko naman tinangal ang aking suot
na sumbrero hudyat na ako ay positibong naka bili na ng shabu.
Nang nakita nila ang PRE ARRANGED SIGNAL na pagtangal ko ng
sombrero agad dumating ang aking back up na sina P03 Miguel G.
Nebra kasama ang aming team leader ay doon ay agad akung
sumigaw na “MGA PULIS KAMI! Wagkang kikilos!” sabay hawak
sa kamay ni @ Balong upang ‘di na siya makatakbo agad ko din

siyang sinabihan na siya ay aking inaresto sa salang pag labag sa
R.A. 9165 na iligal na nagbebenta ng shabu o bawal na gamot;
T: Maari mo bang isalaysay ang mga sumunod na eksena?
A: Sinabihan ko itong si @ Balong ng kanyang mga karapatan
pantao alinsunod sa batas sa salitang kanyang naiintindihan. Tulad
na may karapatan siyang manahimik, Na lahat ng kanyang sasabihin
ay pupuwedeng gamitin laban sa kanya, may karapatan din siyang
kumuha ng sariling niyang abogado, at may karapatang magpatingin
sa isang mapagkakatiwalaang doctor na sarili niyang pili, at kung
walang siyang kakayahan na magbayad ay bibigyan ng estado;
T: Pagkatapos ano ang nangyari?
A: Pagkatapos ko naman siyang sabihan ng kanyang mga karapatan
pantao ay agad ko naman siyang inatasan na ilabas ang laman ng
kanyang mga bulsa at doon ay nakumpiska ko mula sa kanyang
kaliwang bulsa ang isang coin purse na may laman na Tatlong (3)
pirasong heat-sealed transparent plastic sachet na naglalaman
ng hinihinalang shabu mula sa kanyang pag-iingat at sa kanang
bulsa ay ang perang nagkakahalaga ng Eight Hundred Pesos
(Php800.00) kasama ang aming Buy bust money na halagang
Limang daang piso na aking ginamit. Na pagkatapos namin
maaresto ay agad din kaming nagpatawag ng Barangay Official at
Media representative na kasama na naming, upang maging saksi sa
aming gagawin pag imbentaryo at pag mamarka ng mga ebidensiya
sa lugar kung saan siya na aresto sa Baptista Village.
T: Maari mo bang ilahad ang iba pang nangyari?
A: Habang andoon sa pinangyarihan ay akin nilagyan ng marka na
GBC-BB 01-23-20 itong isang (1) heat sealed transparent plastic
sachet na akin nabili ko kay @ Balong na naglalaman ng
pinaghihinalaang shabu at ang Tatlong (3) pirasong heat sealed
transparent plastic sachet na naglalaman ng hinihinalang shabu ay
nilagyan ko din ng markang GBC-1 01-23-20, GBC-2 01-23-20 at
GBC-3 01-23-20 mula sa kanyang pag iingat, ang perang aking na
rekober na halagang (Php800.00) kasama ang buy-bust money na
halagang limang daang piso na may serial no. NJ863633 na ginamit
ko bilang Buy bust money ay inilagay ko din sa transparent plastic
zip lock upang pag ingatan. Na matapos maisagawa ang paglalagay
ng mga marka sa mga nakuhang mga ebidensya sa nasabing lugar
kaharap ang mga saksi, ay ginawa din namin ang imbentaryo kung
saan nakilala namin siya sa tunay niyang pangalan na si BAILANDO
PAMORE y LAKLAK, 30 na taong gulang, walang asawa, walang
trabaho at kasalukuyang nakatira sa Baptista Village, Villasis,
Santiago City. Na kung saan dito sa imbentaryo ay pumirma o

lumagda itong sina WILKINS ABSOLUT ng ABC-IBC-GMA 64 na
kinatawan ng MEDIA at ang Brgy. Official na si Brgy. Councilor
MARCELLA NATURE-SPRING ng Brgy. Villasis, Lungsod ng
Santiago bilang mga saksi at mahigpit din namin sinusunod ang
reglamento na sinasaad ng (SEC. 21 ng R.A. 9165) at pagkatapos
ay aming silang binigyan ng kopya ng imbentaryo kasama na din
itong si @Balong na kaharap din habang ginagawa ang imbentaryo.
Na amin din hinarap sa Duty Desk Officer na si PSSG Bayani
Mabuhay, upang ipakita at ipatala ang mga pangyayari at ebidensya
na aking nakuha sa kanya na may mga kaukulang marka;
T: Matapos niyong mahuli ang suspek at mamarkahan lahat ng
ebidensya, ano ang inyong ginawa?
A: Matapos magawa ang mga kaukulang dokumento ng aming
Imbestigador ay dinala na namin siya sa Callang Hospital upang siya
ay masuri ng Doctor at pagkatapos ay pumunta na kami sa
Regional Crime Laboratory upang doon siya ay ipa Drug test at ipa
Laboratory examination ang mga ebidensyang na tinanggap naman
ni PMSg Rivera, ng ika 2:15 ng umaga ng ika-24 ng Mayo 2020.
Na, dahil sa nasabing pangyayari ay aming hinihiling sa Punong
Taga-usig nitong Lunsod ng Santiago na masampahan namin ng
kaukulang demanda itong si BAILANDO PAMORE y LAKLAK, @
Balong sa kasong paglabag sa “Sec. 5 & Sec. 11, Art II of R.A.
9165”;
T: Meron ka pa po bang nais idagdag?
S: Wala na po.
T: Handa ka na po bang manumpa at lagdaan ang Judicial Affidavit
na ito?
S: Opo. Akin pong pinanunumpaan na ang ang lahat ng salaysay
dito sa Judicial Affidavit ay pawing katotohanan lamang at batay sa
aking personal na kaalaman patungkol sa kaganapang nakasaad sa

I, DR. ROSANNA TULIPS, single, of legal age, residing at No.

123 Rose Boulevard, Camella Homes, Batal, Santiago City, answer
the following questions propounded by Atty. Lurimar A. Raguini with
office address at No. 69 Susmaryosep St., Dimabirbirukan Village,
Brgy. Patul, Santiago City. The same address where the examination
was held.

QUESTIONS were propounded by plaintiff’s counsel in

SPANISH which the affiant fully understands, while the answers
given by the witness is in SPANISH also.

BACKGROUND OF THE CASE

Jerjer Mo is a 22-year-old, and a resident of Kemerut Village,

Brgy. Mabini, Santiago City, who was shot on May 27, 2020 at the
decedent’s residence in the same address.

PRELIMINARY QUESTIONS

A: Me gradué de la Universidad de Barcelona.

A: Actualmente soy el oficial médico-legal de la Oficina de
Laboratorio Regional de Crimen de PNP de la ciudad de
Tuguegarao.
(I am currently the medico-legal officer of the PNPs Regional Crime
Laboratory Office of Tuguegarao City.)

Q: ¿Cuánto tiempo ha estado ejerciendo su profesión como médico?

(How long have you been practicing your profession as Medical
Doctor?)
A: Estoy practicando mi profesión durante los últimos 20 años a
partir de 1999 después de aprobar mi examen de la Junta Médica.
(I am practicing my profession for the past 20 years starting 1999
after I passed my Medical Board Examination.)

Q: ¿Alguna vez tuvo algún otro tipo de estudios, como por ejemplo
estudios de posgrado?

A: Sí, hice una maestría en ciencias forenses en la Universidad de

A: Soy responsable de examinar los cuerpos y cadáveres y también
cualquier lesión física de las víctimas vivas, incluidas las víctimas de
violación.
(I am responsible for examining bodies and cadavers and also any
physical injuries of any living victims which includes rape victims.)

calificado para testificar sobre la causa de la muerte de la víctima,

A: Como oficial médico legal, me pidieron que examinara el cadáver
de Jerjer Mo.
(As the medico-legal officer I was asked to examine the cadaver of
Jerjer Mo.)

A: Si.

Q: ¿Quién te llamó para examinar el cuerpo?

(Who called you in to examine the body?)
A: Me llamó el Superintendente Jefe Fernandino Gogo de la
comisaría de la ciudad de Santiago y me pidió que examinara el
cuerpo de la víctima, que luego fue identificada como Jerjer Mo.
(I was called in by Chief Superintendent Fernandino Gogo of
Santiago City, Police Station and he requested that I examined the
body of the victim who was later identified as Jerjer Mo.)

Q: ¿Puedes describir a la víctima al verla?

(Can you describe the victim upon seeing it?)
A: La preservación del cuerpo es buena; Está previamente
embalsamado. Se observan sitios de incisión de embalsamamiento
en el brazo derecho y el cuadrante superior derecho del abdomen.
Hay una cicatriz en el tercio distal del antebrazo izquierdo, y los sitios
de venopunción se observan en el antebrazo izquierdo y ambas
piernas. No se observan viejas cicatrices quirúrgicas, tatuajes,
deformidades o amputaciones.
(Preservation of the body is good; it is previously embalmed.
Embalming incision sites are noted in the right arm and the right
upper quadrant of the abdomens. There is a scar in the distal 3rd of
the left forearm, and the venipuncture sites are noted in the left
forearm and both legs. No old surgical scars, tattoos, deformities or
amputations are noted.)

A: Mi hallazgos son los siguientes:

 El cuerpo es el de un hombre filipino bastante desarrollado y
bastante nutrido que parece ser consistente con la edad
reportada de 22 años. La longitud es de 62.5 pulgadas desde
la corona hasta la suela, y el peso estimado es de 130-150 lbs.
(The body is that of a fairly developed, fairly nourished Filipino
male appearing to be consistent with the reported age of 22
years. The length is 62.5 inches from the crown to sole, and the
estimated weight is 130-150 lbs.)
 La cabeza es normocefálica, y hay evidencia de una herida de
bala en el ojo derecho.
(The head is normocephalic, and there is evidence of a gunshot
injury in the right eye.)
>La bala entra en la región orbitaria derecha, perfora el
ojo derecho y fractura los huesos occipitales derecho y
occipital derecho del cráneo.
(The bullet enters the right orbital region, piercing the right eye,
and fracturing the right orbital and right occipital bones of the

at 22 Karimarimarim St., Patul, Santiago City, plaintiff in the case,
state under oath as follows:

PRELIMINARY STATEMENT

The person examining me is ATTY. CHUVACHOO CHIU with

address at 119, Marikit St., Patul, Santiago City. The examination is
being held at the same address. I am answering her questions fully
conscious that I do so under oath and may face criminal liability for
false testimony and perjury.

PURPOSE: This affidavit/testimony of plaintiff, Maria R. Mabunganga

is being offered to prove that the she has the right to recover the
ownership of Lot 6849. The plaintiff’s testimony is also offered to
prove the legal basis for the declaration that she was the owner of the
disputed lot.

1. Q: Do you know about the lot in this case, Lot No. 6849?
A: Yes madam.

2. Q: Could you please tell us why you know about the said lot
and why are you familiar with it?

A: It is because that the lot was located at Balintocatoc, Santiago
City with an area of 27,907 square meters owned by my
grandparents Claro Mabunganga and Gregoria Chinorva. The said
lot was acquired by my father, Francisco Mabunganga and later I also
acquired it through Deed of Extrajudicial Settlement of Estate and
Cession with my three (3) sisters, namely: Melba M. Napilitan, Cielo
M. Lardizabal, and Maria Visia M. Maluwang, who waived their
successional rights in my favor. Later, I caused the subdivision of the
said lot into five (5) lots, under my name except Lot No. 6849-B which
is under the name of Mariano M. Limlim and was issued Transfer
Certificate of Titles (TCTs): (1) Lot No. 6849-A (13,072 square
meters) under TCT No. T-83946; (2) Lot No. 6849-B (3,100 square
meters) under TCT No. T-84049; (3) Lot No. 6849-C (10,000 square
meters) under TCT No. T-83948; (4) Lot No. 6849-D (1,127 square
meters) under TCT No. T-83949; and (5) Lot No. 6849-E (608 square
meters) under TCT No. T-83950.

3. Q: Do you have document that could be exhibited to prove

that your grandparents and you are the owner of the said lot?
A: Yes madam, I have reconstituted OCT No. RO-18971 under the
name of my grandparents Claro Mabunganga and Gregoria Chinorva,
the copy is attached in the complaint marked as “Annex A”. I have
also the Titles (Transfer Certificate of Titles (TCTs): (1) Lot No. 6849-
A (13,072 square meters) under TCT No. T-83946; (2) Lot No. 6849-
B (3,100 square meters) under TCT No. T-84049; (3) Lot No. 6849-C
(10,000 square meters) under TCT No. T-83948; (4) Lot No. 6849-D
(1,127 square meters) under TCT No. T-83949; and (5) Lot No. 6849-
E (608 square meters) under TCT No. T-83950.);

4. Q: Who is now in the possession of the said lot?

A: Bea N. Malapad. But in December 15, 1996, through my
counsel, I sent a letter to defendant apprising it about the facts and
circumstances affecting the property and its occupancy of Lot No.
6849-A with an area of 13,072 square meters. I proposed to
Defendant that it purchase Lot No. 6849-A at the Fair Market Value
(FMV) of PhP 400 per square meter and also requested for
reasonable rentals from 1960 and I also wrote to Engr. Orlando Lusis,
City Engineer, Santiago City about the on-going construction projects
in the property.

5. Q: What happened to your proposal to the defendant and to

your letter with Engr. Orlando Lusis?
A: The proposal was turned down, Engr. Lusis then informed my
counsel that defendant Bea Malapad is the owner of the property site
having acquired the disputed lot by virtue of a Deed of Donation
executed by the City of Santiago in favor of defendant.

6. Q: Do you have the copies of the letters sent to Bea Malapad
and Engr. Lusis?
A: Yes madam.

7. Q: Do you have any other proof to justify your ownership to

the said lot?
A: Yes madam, I have the Tax Declaration No. 04-006-00681
issued for said lot, and the April 20, 1992 Certification from the Office
of the Treasurer of the City of Santiago, attesting to respondent’s
payment of realty taxes for Lot 6849 from 1980 to 1990

I, BEA N. MALAPAD, of legal age, married, and living at 33

Mabuhay St., Villa Gonzaga, Santiago City, plaintiff in the case, state
under oath as follows:

PRELIMINARY STATEMENT

The person examining me is ATTY. MILO OVALTINE with address at

69 Kininam St., Centro East, Santiago City. The examination is being
held at the same address. I am answering his questions fully
conscious that I do so under oath and may face criminal liability for
false testimony and perjury.

PURPOSE: This affidavit/testimony of defendant, Bea N. Malapad is

being offered to prove that the she was the rightful owner of Lot 6849.
The defendant’s testimony is also offered to prove the legal basis for
the declaration that she was the owner of the disputed lot.

QUESTIONS were propounded by defendant’s counsel in Ilocano

which the affiant fully understands, while the answers given by the
