LETTER OF PROTEST

Re: Responsibility for Cargo Quantity

Dear Sirs,

After completion of loading at the port of Salaverry, Shipper's surveyors conducted draft surveys,
calculated
cargo quantities on board based on draft surveys and sealed all the cargo hold enterances. It means
that vessel has 2696,643 m/t POTASH, 2693,467 m/t TSP and 15498,360 m/t DAP onboard. I have
already been informed that shore measurement will be valid for discharge figure at the all discharging ports.

I have to inform you that, I will not accept any responsibility if any dispute and/or claim will arise
about cargo quantities. I hold the receivers fully responsible about the discharge quantities and will not accept
any claim about this subject.

Acting for and on behalf of my Owner and my Charterer, I do hereby note protest, reserve the rights of my
Owner's and my Charterer's to refer to this matter at a later date and to take such action as may be deemed
necessary.

This letter is valid for all discharging ports.

Name and signature.
