Q1. Based on the discussion in class, analyse ‘Marti Koskenniemi’s ‘What is International Law For?

Q2. Do you think that International Law is not representative of the vast majority of the World
Community? Comment on the same by examining the question ‘Is International Law,
International’? [3 Marks]

Cite specific examples as discussed in the class. [3 Marks]

Q3. The State of Guasse was facing a civil revolt where it was alleged that the rebel factions were
being harbored, supported and funded by the nation state of Adimia. The State of Guasse takes
the matter to the ICJ claiming that there was widespread violation of the provisions of the UN
Charter, the use of force under Article 2(4) and other related provisions. Nation state of Adimia
claims that it has a multilateral treaty reservation, which makes the provisions of the UN Charter
inapplicable to it. It is the argument of Guasse that reliance could be placed on Customary
International Law.

Based on the afore-mentioned factual/legal situation and a landmark case on the ICJ in this
regard, comprehensively analyse the relationship between International Customary Law and
treaty law under International Law. [7 Marks]
