EXECUTIVE ORDER
Number 16-A-2020

AN EXECUTIVE ORDER PROVIDING AMENDMENTS TO EXECUTIVE ORDER 16-2020

WHEREAS, Section 15 of Article II of the 1987 Constitution states that the State
shall protect and promote the right to health of the people and instill health
consciousness among them;

WHEREAS, Article 3 (d), Rule 1 of the Implementing Rules of Republic Act 7160
provides that every LGU shall exercise the powers expressly granted, those necessarily
implied therefrom, as well as powers necessary, appropriate, or incidental for its
efficient and effective governance, and those which are essential to the promotion of the
general welfare. Within their respective territorial jurisdictions, LGUs shall ensure and
support, among other things, the preservation and enrichment of culture, promote health
and safety, enhance the right of the people to a balanced ecology, encourage and
support the development of appropriate and self-reliant scientific and technological
capabilities, improve public morals, enhance economic prosperity and social justice,
promote full employment among their residents, maintain peace and order, and
preserve the comfort and convenience of their inhabitants;

WHEREAS, recognizing the need for an inter-sectoral collaboration to establish


preparedness and ensure efficient government response to assess, monitor, contain,
control, and prevent the spread of any potential epidemic in our Country, the Inter-
Agency Task Force (IATF) for the management of Emerging Infectious Diseases was
created by virtue of Executive Order No. 168, Series of 2014;

WHEREAS, on March 8, 2020, President Rodrigo R. Duterte, recognizing that


the COVID-19 as a threat to public health and even to national security, prompted a
whole-of-government approach thereby addressing the COVID-19 outbreak and thus
declared a State of Public Health Emergency throughout the entire Philippines through
Proclamation No. 922;

WHEREAS, as the situation deteriorated worldwide, on March 12, 2020, the


World Health Organization has characterized COVID-19 as pandemic;

WHEREAS, pursuant to DILG Memorandum Circular No. 2020-018 and


amended by DILG Memorandum Circular No. 2020-023 the undersigned issued an
Executive Order No. 02-2020, entitled: “An Order Creating The COVID-19 Task Force
the City of Kabankalan;

WHEREAS, on March 14, 2020, Mayor Pedro P. Zayco, Jr., issued Executive
Order No. 06-2020, entitled: “An Order adopting a Whole-of-City approach in the
Containment, Control, and Prevention of COVID-19 and deputizing all government
agencies in the City of Kabankalan for the purpose and subsequently issued Executive
Order 09-2020 declaring a General Community Quarantine in the City of Kabankalan;

WHEREAS, the Department of Health issued Department Memorandum No.


2020-0067 dated February 3, 2020, entitled: “Guidelines on the Disposal and Shipment
of the Remains of Confirmed Cases of 2019 Novel Coronavirus Acute Respiratory
Disease;

WHEREAS, on March 27, 2020, the Department of Interior and Local Government
issued Memorandum Circular No. 2020-063 entitle: “Interim Guidelines on the Management
of Human Remains for Patient Under Investigation (PUI) and confirmed Coronavirus
Disease 2019 (COVID-19) cases;

NOW, THEREFORE, I, PEDRO P. ZAYCO, JR., by virtue of the authority vested


in me by law as Mayor of the City of Kabankalan do hereby issue this Executive Order
to amend certain provision of Executive Order 16-2020;

Section 1. Section 4 is hereby amended to be read as follows:

“XXX

4.4. In case of burial in a cemetery is opted by the family, the City


General Services Office or its duly authorize representative for the
specific purpose, shall be responsible for properly disposing of the
remains in the public cementery of Barangay Camansi or Barangay
Oringao, whichever is accessible to the family of the deceased.

XXX”

Section 2. REPEALING CLAUSE. All other Executive Orders, issuances, rules, and
regulations or parts thereof which are inconsistent with this Order or other related
Provincial Executive Orders are hereby revoked, amended, or modified accordingly.

Section 3. EFFECTIVITY. This Executive Order shall take effect immediately.

Done this 16th day of September 2020 in the City of Kabankalan, Province of Negros
Occidental, Philippines.
