Compliance to Solid Waste Management Act of 2000

The Municipality has partially adopted measures to comply and enforce RA No. 9003 or the Solid Waste
Management Act of 2000 dated January 6, 2001, which partially contributed to a favorable condition of
the environment, health and sanitation of the residents.

The Government, in its efforts to introduce improvements in the present system of Solid Waste
Management (SWM), enacted Republic Act No. 9003 (Ecological Solid Waste Management Act of 2000),
providing for an ecological SWM program, creating the necessary institutional mechanism and
incentives, declaring certain acts prohibited and providing penalties therefor,

Section 10 of RA 9003 or the Ecological Solid Waste Management Act of 2000 – particularly states the
role of LGUs in Solid Waste Management:

Pursuant to the relevant provisions of R.A. No. 7160, otherwise known as the Local Government Code,
the LGUs shall be primarily responsible for the implementation and enforcement of the provisions of
this Act within their respective jurisdictions.

Review on the status of the Municipality’s ten-year SWMP, ocular visit and interview with the concerned
official disclosed the following:

a. Material Recovery Facility (MRF) and Composting Facility were constructed and operational as
planned.
b. The Information Education Campaign (IEC) and Enforcement and Assessment of Barangays
regarding the RA No. 9003, the Municipal Solid Waste Management Ordinance and Piggery and
Poultry Ordinance were conducted.
c. The Municipality failed to start the construction of Sanitary Land Fill during the year but
informed the audit team that the project was already bidded. In the absence of SLF, a Residual
Containment Area was constructed to cater the collected waste of the entire Municipality.
d. The recruitment and training of enforcers, start of enforcement activities, and assessment of
enforcement activities were not implemented during the year because of the delayed operation
of SLF.

The foregoing status of accomplishments under its 10-year SWMP and onsite inspection of the SLF
proposed location shows the intention of management to fulfill its obligation as mandated by law.

We recommended that management (1) revisit and continue implementing the measures contained in
the Municipality’s 10-Year SWM Plan, (2) fast tract the implementation of SLF and (3) continue adopting
such measurer to comply with the mandate of the law.
