AFFIDAVIT OF WITNESS

I, Whitney N. Ness, of legal age, female, bona fide resident of P-69

Blueridge, Baguio City been duly sworn in accordance with law do hereby state
the following to wit, that:

1. At around 7:00 P.M. of 28 March 2020, I was on my way home walking along JP
Soriano Street, Blueridge, Baguio City, walking in front of me was a couple
holding hands. I recognized, from her voice, hair and clothes, that the woman
was my friend Ms. Heart Evangel. Just as I was going to call her attention, she
suddenly pulled a gun tucked on her waist and pointed the gun towards two
policemen across the street. One of the policemen immediately called out to Ms.
Evangel to drop the gun.

2. When I saw the gun pointed by Ms. Evangel, I got scared and hid behind a
parked car behind the street.

3. After a few minutes and not having heard any gun shot, I looked over the parked
car and saw that Ms. Evangel was already on the floor and handcuffed by the
policemen and that one of the policemen was telling her something.

4. When the policemen stood Ms. Evangel, one of them saw me and told me that
everything is alright. After talking to me and the other by-standers who saw the
incident, the policemen sat Ms. Evangel in the police car, her companion
followed and the police car left.

5. That I am executing the affidavit to attest to the truthfulness of the foregoing facts
and to support the filing of a complaint against the suspect.

IN WITNESS WHEREOF, I have hereunto affixed my signature this 28 th day of
