Dear Governor and Members of the Legislature:
Bias incidents target individuals because of what they look like,
how they worship, or who they love. They jeopardize our pursuit
of freedom and opportunity. They erode, undermine, and attack
the identity and heritage of our citizens. They dehumanize people.
And they shake the foundations of our cultural and religious
institutions. They have no place here in New Jersey.
With this letter, I submit a report on bias incidents in our State,
produced pursuant to Attorney General Executive Directive 1987-3.
The report covers the years 2017 and 2018, and is based on bias
incident reports submitted to the New Jersey Uniform Crime
Reporting System by law enforcement agencies across New Jersey.
The data demonstrate an increase in reported bias incidents over
the last two years. In other words, New Jersey law enforcement
agencies are now receiving more reports of suspected or confirmed
crimes committed because of the victim’s perceived or actual
race, color, religion, gender, disability, sexual orientation, gender
identity or expression, national origin, or ethnicity.
This year—for the first time—our report goes beyond the numbers
compiled by the New Jersey State Police and includes analysis from
our Division on Civil Rights that puts the data in context. In addition
to presenting the data, the report compares New Jersey’s numbers to
national trends, discusses possible causes of the increase in reported
bias incidents, and offers recommendations for moving forward.
This report would not have been possible without the cooperation
of the New Jersey State Police, other New Jersey law enforcement
agencies, and the Division on Civil Rights. But the cooperation
cannot stop with the publication of this report. We cannot overcome
hate until we recognize that we all are partners in the fight.

1987-3, the thirtieth (2017) and thirty-first (2018) Bias
Incidents in New Jersey reports are submitted. These
reports contain statistics related to bias incidents. All
information is based on bias incident reports submitted
to the New Jersey Uniform Crime Reporting System by
every New Jersey law enforcement agency for the years
2017 through 2018. The report contains comparisons and
analyses between 2016, 2017 and 2018 data.
These reports could not have been realized without the
cooperation of all New Jersey law enforcement agencies.

Dear Attorney General Grewal:
The New Jersey Division on Civil Rights (DCR) hereby presents
this Report, analyzing a rising tide of hate in New Jersey and
across the country. This report examines bias incident reports
submitted to the New Jersey Uniform Crime Reporting System by
every New Jersey law enforcement agency during 2017 and 2018.
It also discusses possible causes of the increase in reported bias
incidents and offers recommendations for moving forward.
The Report could not come at a more critical time. There was a
thirty-two percent increase in the number of reported bias incidents
in New Jersey between 2016 and 2017: from 417 in 2016 to 549 in
2017. This was the largest jump since at least 2006. There was an
additional four percent increase from 2017 to 2018. The 569 reported
bias incidents in 2018 were the highest total number since 2011.
Addressing the rise in hate, bias and prejudice requires a clear
understanding of where we have been and where we are today.
That is the purpose of this report: to carefully analyze data for
2017 and 2018, to place the data in context, to discuss some of the
possible reasons for the increase in reported bias incidents, and to
help inform the path forward.
DCR is charged with enforcing the New Jersey Law Against
Discrimination and preventing and eliminating bias, prejudice,
and discrimination in our State. We look forward to working
with you, the New Jersey State Police, other New Jersey law
enforcement agencies, and communities across the State to
confront hate, create connections, break stereotypes, and protect
the civil rights of all New Jersey residents.

This report documents a rising tide of hate in New Jersey and
around the country. There was a 32% increase in the number of
reported bias incidents in New Jersey in 2017: from 417 in 2016 to
549 in 2017. This was the largest jump since at least 2006. There
was an additional 4% increase from 2017 to 2018. The 569 reported
bias incidents in 2018 were the highest total number since 2011.2
Bias incidents are suspected or confirmed offenses that are
committed because of the victim’s perceived or actual race, color,
religion, gender, disability, sexual orientation, gender identity or
expression, national origin, or ethnicity.
Attorney General Grewal, the New Jersey State Police, and the
Division on Civil Rights are committed to working together and
using all resources and tools available to reduce and eliminate the
scourge of bias incidents from New Jersey. We have started this
work already. In late 2018 and early 2019, the Division of Criminal
Justice, County Prosecutors, local police, New Jersey State Police,
the Office of Homeland Security and Preparedness, and the
Division on Civil Rights hosted events to raise awareness around

2. As discussed infra Section IV, it is difficult to pinpoint how much of the increase in reported bias incidents
is caused by an increase in the total number of bias incidents, and how much is caused by improvements in
the frequency with which those bias incidents are reported to law enforcement. Nonetheless, this report—with
its close examination of reported bias incidents in 2017 and 2018, as well as its analysis of trends from 2006
to 2018—will help the public understand the scope of the problem while simultaneously helping to guide our
efforts to address it.

bias incidents in nearly every county across the State. In April,


the Attorney General announced new Bias Incident Investigation
Standards, which mandate a victim- and community-centered
approach by law enforcement, electronic reporting of bias
incidents, greater inter-agency communication, and continuing
training for members of law enforcement.3
But charting the best way forward requires a more complete
understanding of where we have been, and where we are today.
That is the purpose of this report: to carefully analyze bias crime
data for 2017 and 2018 and to place the data in context, to help
inform the path forward.
This report is divided into five sections. The first introduces the
data. The second analyzes the data, including by type of bias;
offender and offense; and county. The third compares this data to
national trends. The fourth suggests possible causes of the increase
in reported bias incidents. And the fifth offers recommendations
for moving forward. We hope this report helps New Jerseyans
to understand the challenges we face and to commit to moving
forward, together.

I. Introduction to the Data


The data released today and analyzed in this report is based on
bias incident reports submitted to the New Jersey Uniform Crime
Reporting System by every New Jersey law enforcement agency
during 2017 and 2018. For comparison purposes, portions of this
report also analyze data submitted to the New Jersey Uniform
Crime Reporting System by every New Jersey law enforcement
agency from 2006 through 2016; the New Jersey State Police
previously released that data in annual reports covering
each of those years.
Pursuant to N.J.S.A. § 2C:16-1(a)(1) or (2), the crime of bias
intimidation is an enumerated offense committed with the purpose
to intimidate or with knowledge that the crime would intimidate
an individual or group of individuals “because of race, color,
religion, gender, disability, sexual orientation, gender identity
or expression, national origin, or ethnicity.”4 The enumerated
offenses are found in chapters 11 through 18 of Title 2C of the
New Jersey Statutes, N.J.S. 2C:33-4; N.J.S. 2C:39-3; N.J.S. 2C:39-4
or N.J.S. 2C:39-5. They include, but are not limited to, harassment,
assault, terroristic threats, arson, criminal mischief and homicide.
A bias incident is a suspected or confirmed bias crime.

Therefore, this report does not capture every bias crime or bias
incident in the State. Instead, it captures only those incidents that
were reported to law enforcement where police officers suspected
or confirmed a bias crime. Because the data captures only reported
bias incidents, it is under-inclusive in that it does not capture
incidents that were never reported to local law enforcement.5
According to a report from the United States Department of Justice
Bureau of Justice Statistics, more than half of hate crime victims
nationwide from 2011 to 2015 did not report the crimes to the
police.6 41% of victims handled them privately or through a non-law
enforcement official; 23% believed that police “would not want to
be bothered or to get involved, would be inefficient or ineffective,
or would cause trouble for the victim”; and 19% felt the crime was
not important enough to report to the police.7 Therefore, while this
report analyzes reported bias incidents, the actual number of bias
incidents that occurred in New Jersey is likely much higher.8

incidents that local police departments did not report to New Jersey State Police. Recent changes to the
Bias Incident Investigation Standards further streamline reporting. Under the new Bias Incident Investigation
Standards, local law enforcement agencies must report all confirmed or suspected bias incidents within
twenty-four hours of the initial law enforcement response. These reports are submitted through an e-portal that
automatically forwards all reports to the Bias Crimes Unit at the Division of Criminal Justice, the New Jersey
State Police, the New Jersey Office of Homeland Security and Preparedness, and the appropriate County

II. Detailed Analysis of Reported


Bias Incidents in New Jersey
From 2010 to 2015, reported bias incidents in New Jersey fell by
more than half (53%). But in 2016, that decline began to reverse,
and reported bias incidents increased by 14%. This was followed
by a 32% jump in 2017, from 417 in 2016 to 549 in 2017. There was
an additional 4% increase from 2017 to 2018. The 569 reported
bias incidents in 2018 was the highest number since 2011. In total,
reported bias incidents have increased 55% in the last three years.

A. Bias Incidents by Type of Bias


In 2017, the motivations for reported bias incidents
in New Jersey were broken down as follows:
n 52% were motivated by the victim’s race, ethnicity or ancestry;
n 38% were motivated by the victim’s religion;
n 10% were motivated by the victim’s sexual orientation,
gender, or gender identity or expression;
n Slightly less than 1% were motivated
by the victim’s physical or mental disability.
In 2018, the breakdown was similar:
n 54% were motivated by the victim’s race, ethnicity or ancestry;
n 35% were motivated by the victim’s religion;
n 10% were motivated by the victim’s sexual orientation,
gender, or gender identity or expression;
n Slightly less than 1% were motivated by
the victim’s physical or mental disability.

In every year from 2006-2018, African-Americans were the most


frequent targets of racially-motivated bias incidents. During that
thirteen-year period, there were 7,861 reported bias incidents;
nearly three-thousand (2,946), or 37.5%, were anti-Black. In 2017,
there were 206 reported anti-Black bias incidents. This accounted
for 37.5% of all bias incidents in New Jersey during that year and
72.8% of all incidents motivated by the victim’s race, ethnicity or
ancestry. This was also a 62.2% increase from the previous year.
In 2018, there were 221 reported anti-Black bias incidents, which
accounted for 38.8% of all reported bias incidents in New Jersey
and 72% of all such incidents motivated by the victim’s race,
ethnicity or ancestry.
Between 2006 and 2018, Jews were the religious group most
frequently targeted in reported bias incidents. During that
thirteen-year period, there were 2,341 anti-Jewish bias incidents,
or 29.8% of total reported bias incidents. There were 172 reported
anti-Jewish bias incidents in 2017. This accounted for 31.3% of
all bias incidents in New Jersey during that year and 82.7% of all
incidents motivated by the victim’s religion. From 2016 to 2017,
there was a 38.7% increase in bias incidents targeting Jews. In
2018, there were 172 reported anti-Jewish bias incidents, which
accounted for 30.2% of all reported bias incidents in New Jersey
and 86.4% of all such incidents motivated by the victim’s religion.
Moreover, there were 95 reported swastika incidents in 2017 and
57 reported swastika incidents in 2018.
Between 2006 and 2018, Hispanic individuals were the ethnic
group most frequently targeted in reported bias incidents.
During that thirteen-year period, Latinos were the victims
in 331 incidents, or 4.2% of total reported bias incidents.

B. Bias Incidents by Offender & Offense


Of the 227 known offenders in 2018:
n 105 (46.3%) were minors;
n 179 (78.9%) were male and 48 (21.1%) were female;
n 180 (79.3%) were white, 36 (15.9%) were Black,
and 4 (1.8%) were Asian.
Of the 213 known offenders in 2017:
n 63 (29.6%) were minors;
n 165 (77.5%) were male and 48 (22.5%) were female;
n 177 (83.1%) were white, 20 (9.4%) were Black,
7 (3.3%) were Asian.
Of the 3,730 known offenders from 2006-2018:
n 1390 (37.3%) were minors;
n 2737 (73.4%) were male and 993 (26.6%) were female;
n 3074 (82.4%) were white, 512 (13.7%) were Black,
and 55 (1.5%) were Asian.
In 2017, there were 276 harassment offenses and 179 intimidation
and destruction/damage/vandalism offenses. In 2018, there were
244 harassment offenses and 212 intimidation and destruction/
damage/vandalism offenses.

C. Bias Incidents by and Against Students and Minors


In both 2017 and 2018, colleges and universities were the locations
with the greatest number of reported bias incidents. In fact, over
25% of reported bias incidents in each year occurred at colleges
and universities (145 reported incidents in 2018 and 139 in 2017).9
In 2018, the New Jersey State Police also added a new category of
data; the data now measures the number of reported bias incidents
that occurred at elementary and secondary schools. There were 32
incidents in such schools in 2018 alone.
Bias incidents among young people are not limited to schools.
In fact, 105 of the 227 known offenders in 2018 (46%) were minors.
That was a 67% increase from the 63 minors who were known
offenders in 2017. And between 2006 and 2018, minors comprised
nearly 29% of the victims of bias incidents.

D. Bias Incidents by County


The majority of counties in New Jersey experienced an increase in
reported bias incidents from 2016 to 2017. Burlington, Bergen, and
Cape May Counties reported the largest percentage increases: each
county reported an increase of over 100% in reported bias incidents
from 2016 to 2017 (Cape May County experienced a 400% increase,
from one reported bias incident in 2016 to five in 2017).
From 2017 to 2018, nine counties experienced a decrease in
reported bias incidents, nine counties experienced an increase,
and three counties stayed the same. Union and Passaic Counties
experienced the largest increase in reported bias incidents from
2017 to 2018; both counties experienced a greater than 100%
increase. Morris County also experienced a significant increase,
from 31 reported bias incidents in 2017 to 52 reported bias
incidents in 2018 (a 68% increase).
As for the highest rate of incidents, in 2017, the counties with
more than one reported bias incident per 10,000 residents were
Gloucester, Monmouth, Middlesex, Burlington, and Mercer.10 In
2018, the counties with more than one reported bias incident per
10,000 residents were Monmouth, Burlington, and Morris Counties.

E. Arrests
From 2006 to 2018, New Jersey law enforcement made 1,278 arrests
resulting from bias incidents. Of those arrests, 857 (67.1%) of the
perpetrators were adults, and the remainder were juveniles. The

III. Comparison to National Trends


The rise in bias incidents in New Jersey since 2016 is consistent with
nationwide trends. According to FBI data, 7,175 hate crimes were
reported in the United States in 2017.11 This was an increase of 17%
nationwide from the prior year.12 It was also the third consecutive
year with an increase, and the single biggest spike since the surge
of incidents targeting Muslims after September 11th.13
The following chart shows FBI statistics on the number
of reported hate crimes nationwide from 2000 to 2017.14

The national data also shows that the most common motivations for
bias incidents were similar to those in New Jersey: race, ethnicity,
ancestry (59.6%) followed by religion (20.6%), and then sexual
orientation (15.8%).15
The FBI’s data for New Jersey also shows a jump in bias crimes.
According to the most recent FBI data, New Jersey experienced a
76% jump in bias crimes from 2016 to 2017, from 282 to 495. This
was the largest reported increase in the FBI’s data for New Jersey
in more than a decade.16

IV. Potential Causes of the Rise


in Reported Bias Incidents
As noted above, it is critical to recognize that an increase in
reported bias incidents can be caused by multiple factors.
As an initial matter, it is difficult to pinpoint precisely how much
of the increase in reported bias incidents reflects an increase in
the total number of bias incidents, and how much is caused by
an increase in the frequency with which those bias incidents
are reported to law enforcement. Attorney General Grewal and
other law enforcement leaders have highlighted the importance
of reporting bias incidents,18 and New Jersey has continued to
make improvements to its bias reporting systems.19 It is therefore
possible that at least a portion of the increase in reported bias
incidents in recent years can be attributed to a greater number
of bias incidents being reported to law enforcement.
Nonetheless, it is unlikely that the entire increase can be
attributed to improvements in reporting, as the recent rise
in reported bias incidents in New Jersey is consistent with a
nationwide trend which cannot be explained solely by such
improvements.
Scholars and experts have suggested several factors they believe
are connected to the rise in bias incidents: social media, political
rhetoric, and the rise in the number of hate groups. As for
social media, psychologists have found that people, including
perpetrators of hate crimes, tend to conform to perceived

social norms and act in ways that they believe will be socially
acceptable.20 However, instead of looking to their real-world
communities for social cues, people are increasingly seeking
affirmation of their personal beliefs through technology, especially
on social media. But social media posts do not accurately reflect
the full spectrum of societal views. As just one example, Facebook
uses an algorithm to determine what kind of content most engages
users and then proliferates that content.21 Studies suggest that
“[p]osts that tap into negative, primal emotions like anger or fear”
perform best in user engagement, and thus are proliferated by
the Facebook algorithm. Facebook’s algorithm can thus elevate
“superposters” with exaggerated worldviews, including when it
comes to hate and bias.22
Outside forces have also begun to use social media’s targeted ads
to stir up hate and divisiveness online. A report published by the
Center for the Study of Hate and Extremism at California State
University, San Bernardino, found a strong correlation between
racially divisive ads posted by the Russia-based Internet Research
Agency on social media platforms during and after the 2016 election

campaign and reported hate crimes in America’s ten largest cities


during that time period.23 More than half of the Russia-based Internet
Research Agency’s 3,500 ads explicitly referenced race, accounting for
twenty-five million ad impressions.24 And the Center for the Study of
Hate and Extremism at California State University, San Bernardino,
noted that during certain periods of increased Russian Facebook ads,
hate crimes generally rose and “rose most dramatically in specific
subcategories referenced in the Russian ads.”25
As to political forces, hate crimes may be more likely during times
of political and social change.26 And research suggests that extreme
political rhetoric, which tends to be amplified during times of
political and social change and polarization, may contribute to
an increase in hate crimes. For example, another study by the
Center for the Study of Hate and Extremism compared President
George W. Bush’s speech six days after the September 11th attacks
declaring that “Islam is peace,” with then-candidate Donald
Trump’s call for a Muslim ban five days after the San Bernardino
attack in 2015.27 The study found that “anti-Muslim hate crimes
dropped dramatically across the country” after President Bush’s
statements of tolerance, as compared to the spike in hate crimes
immediately following September 11th, while such crimes

increased from eight incidents nationwide in the five-day period


immediately following the San Bernardino attack to fifteen
incidents, including multiple assaults and two fire-bombings,
in the five-day period following then-candidate Trump’s Muslim
ban proposal.28 The study also noted a moderate weekly rise in
Google hate searches following that proposed ban.29
Social media platforms can help to amplify divisive political
rhetoric. A recent report by the ADL and the Network Contagion
Research Institute about Gab and certain message boards on
4chan found that “anti-Semitic slurs and content doubled on
these platforms after the election of President Donald Trump.”30
There was also a “dramatic surge in the expression of racism”
on those platforms during that same time period. In addition, it
appears that the perpetrators of several mass shootings posted
hate-filled messages on Gab or 8chan immediately before
committing the attacks.31 And the Network Contagion Research
Institute study found that derogatory terms for Jewish and Black
people significantly increased on 4chan and Gab between the
summer of 2016 and the fall of 2017, peaking dramatically around
the time of President Trump’s inauguration in January 2017 and the
Charlottesville rally in August 2017.32

Another factor that may help to explain the rise in hate crimes
is a recent rise in hate groups. The Southern Poverty Law
Center identified 1,020 hate groups in the United States in 2018,
the highest number ever recorded in the two decades that the
organization has been tracking this data.33 In fact, 2018 was the
fourth straight year in which the number of hate groups grew;
there has been a roughly 30% increase in the number of hate
groups since 2014.34 There were eighteen active hate groups in
New Jersey in 2018, and in January of this year, the New Jersey
Office of Homeland Security and Preparedness noted an increase
in reported instances of recruitment by white supremacist groups
across the state, including increased propaganda distribution at
colleges and universities.35 This rise in propaganda distribution
is not limited to New Jersey; the ADL reported a 182% increase
nationwide in incidents of white supremacist propaganda
from 2017 to 2018.36

V. Recommendations
for Moving Forward
While it is difficult to pinpoint the precise causes of the rise
in reported bias incidents, it is clear that we must all work
together to stop it.
Part of this can be addressed by government. Local police must
vigorously investigate, and the Office of the Attorney General
and County Prosecutors must vigorously prosecute bias crimes,
recognizing that an act of hate against any one of our communities
is a threat to all of our communities. To ensure this occurs, in April
the Attorney General announced new Bias Incident Investigation
Standards, which mandate a victim- and community-centered
approach by law enforcement, electronic reporting of bias
incidents, greater inter-agency communication, and continuing
training for members of law enforcement.37
The Division on Civil Rights, which was created by the New Jersey
Legislature in 1945 to “prevent and eliminate” bias, prejudice, and
discrimination, also has a role to play. The New Jersey Law Against
Discrimination prohibits acts of bias, discrimination and harassment
in employment, housing and places of public accommodation
(including schools, businesses, government buildings, public
transportation, restaurants, theaters, and other places open to the
public), and some incidents reported to police as bias incidents or
bias crimes may violate the Law Against Discrimination even if they
do not rise to the level of a criminal offense.

Government must also be proactive in working to bring


communities together to prevent acts of bias and prejudice. As
earlier noted, in late 2018 and early 2019, the Division of Criminal
Justice, County Prosecutors, local police, New Jersey State Police,
the Office of Homeland Security and Preparedness, and the
Division on Civil Rights hosted events to raise awareness around
bias incidents and bring communities together in nearly every
county across the State. Many included community leaders, non-
profit organizations, advocates and other stakeholders to share
their experiences and make recommendations for the future.
And we are currently working together with communities to
begin having the difficult conversations necessary to break down
barriers, create connections, and foster mutual respect.
These community conversations are critically important because
government and law enforcement cannot do this alone. We need
to commit to working together to address hate and prejudice. We
must call out hateful comments from our leaders whenever we
hear them. We must push back against anyone who accepts hate,
anger, and division as a normal part of our political discourse.
Faith leaders must teach that all humans are entitled to dignity
and respect and that we must love our neighbors as ourselves.
Community groups must organize events to bring people together
to share their stories. Parents and teachers must teach children to
recognize the humanity in others, and to recognize that the ties
that bind us together are stronger than those that would tear us
apart. And students must refuse to bully others and must instead
stand up for their peers.

In his 1994 autobiography, Long Walk to Freedom, Nelson Mandela


wrote: “No one is born hating another person because of the color
of his skin, or his background, or his religion. People must learn to
hate, and if they can learn to hate, they can be taught to love, for
love comes more naturally to the human heart than its opposite.”
On the Friday after the massacre at two mosques in Christchurch,
New Zealand in March, 2019, women and girls across the country
wore headscarves in a remarkable display of solidarity with their
Muslim sisters. One of the organizers of the campaign, Headscarf
for Harmony, explained that the purpose of the campaign was
to “change the rhetoric in our countries, to move towards each
other, with gentle gestures and heartfelt kindness, to create the
space to hear each other’s stories, to discover our similarities,
build relationship[s], make our streets safe for each other and
deliberately and determinedly choose to live in harmony.”
We must all work to do just that, and we hope that this
report helps to start us down that path.38
