AGREED ORDER FOR INJUNCTION AND A ER DIRECTING DEFENDANTS TO PAY On the _/@ _ of September 2020, the parties entered into an agreement to resolve the issues pending before the Court in this matter, The parties requested that their agreement be presented to the Court for review, approval, and merger into the judgments, decrees, and orders of the Court at this time. ‘The Court, after being fully advised in the premises, finds as follows: (1) That Title 68 O.S. §232 permits the entering of an Injunction in cases in which taxes are due and owing or in which returns are not filed, (2) That the Defendants are delinquent in the payment of sales tax ($69,487.92), interest ($36,944.73), and penalty ($7,220.79) in the total amount of $113,653.44 (ONE HUNDRED THIRTEEN THOUSAND SIX HUNDRED FIFTY-THREE DOLLARS AND FORTY-FOUR CENTS), with interest calculated through September 9, 2020 (“Outstanding Liability”), and accruing on the unpaid tax at the rate of 15% (FIFTEEN PERCENT) per LAURAALEE, Cour clerk " wT annum. The Outstanding Liability encompasses the audited sales tax periods of February 2016 through December 2017. (3) That the Plaintif’s Petition, requesting an Order enjoining and restraining the Defendants, Greater Wynnewood Exotic Animal Park, LLC and Jeff Lowe, as President of Greater Wynnewood Exotic Animal Park, LLC and as an Individual, from operating the business in Garvin County, Oklahoma, is granted instanter, provided however, that this Order for Injunction will be stayed so long as: (a) The Defendants make a down payment in the amount of $20,000.00 (TWENTY THOUSAND DOLLARS) to the Oklahoma Tax Commission, upon the filed date of this Order, (©) The Defendants make monthly installment payments in the amount of ‘$2,500.00 (TWO THOUSAND FIVE HUNDRED DOLLARS), the first payment to be made on of before October 15, 2020, and equal payments to be made on or before the 15 (FIFTEENTH) day of each month thereafter, until such time as all delinquent taxes, interest, and penalties are paid to the Oklahoma Tax Commission; (©) The Defendants make all the required payments in certified funds payable to the Oklahoma Tax Commission and delivered to the Office of General Counsel of the Oklehoma Tax Commission on or before the date due, a payment mailed on the due date is not sufficient; and (@) The Defendants must maintain compliance with the tax laws of the State of Oklahoma. (4) That Defendants, upon payment of all base taxes, will request a waiver hearing, as outlined in 68 O.S. §220(A) and 0.A.C. 710:1-5-12, for the potential waiver of all ‘outstanding penalty and interest owed. If the waiver is denied, then payments will continue ‘until the Outstanding Liability has been paid in full. IT IS THEREFORE ORDERED, ADJUDGED, AND DECREED that the Plaintiff's prayer for an Order for Injunction restraining the Defendants, Greater Wynnewood Exotic Animal Park, LLC and Jeff Lowe, as President of Greater Wynnewood Exotic Animal Park, LLC and as an Individual, and Defendants” agents, employees, successors, assigns, servants, attomeys, and all others who are under the control of the Defendants, is granted instanter, Provided however, that this Order for Injunction will be stayed as provided by this Order. TT IS FURTHER ORDERED, ADJUDGED, AND DECREED by the Court that, should the Defendants fail to make the required monthly payments and/or fail to maintain compliance, then the stay of injunction will be lifted upon the application of the Plaintiff, IT IS FURTHER ORDERED, ADJUDGED, AND DECREED by the Court that the Defendants shall pay all court costs in connection with this action to the Court Clerk of Garvin County within 30 (THIRTY) days of the date of this Order.
