Right to Health in India: Promises and Practices of the

Welfare State
Abstract
Human rights are arguably the most globalized political value of our times. At the same
time, human rights has been criticized on the grounds that it is legal, individualistic and
universal assumptions are particularistic ‘We the people of India’ when these words
were being written in the Constituent Assembly by those very ‘We the people’
who represented all the Indians for times to come, could never have imagined that
the people of India will have to fight for even their basic needs like primary
health in the so called Socialist, Sovereign, Republic and Democratic State even
after the years of the enactment of the Constitution. Health is the most important
factor in nationwide development. It is a condition of a person’s physical and mental state
and signifies freedom from any virus or disease. Right to health is a dynamic right without
which no one can exercise one’s basic constitutional rights as well as human rights Health is
one of the basic requirements of human being. Nowadays India is facing problem of
degradation of health. The Constitution of India is supreme law to administer the entire
Nation. Health services in India at the time of Freedom were a function of the
socio-economic and political interests of the royal rulers. The post-independence
observed a real struggle in providing inclusive health care, and in extending the
set-up of health services. However, the developments in our health transfer
system did not match the needs of a vast majority of our individuals. The
Government is under responsibility to protect the health of the people because
there is close relationship between Health and the quality of life of a person.
There are many provisions under the Constitution of India which deal with the
Health of the Public at large. The founding fathers of the Indian Constitution
correctly introduced Directive principles of State Policy with a view to protect
the health of the public Health is the most valuable requirement for happiness and
joy
