Questionnaire

1. Give explanation behind the failure of discussion


between the RTC employees Union and the
management of TSRTC?

The Govt. of Telangana constituted a committee on


01.10.2019 with the following IAS Officers vide Memo
No.1272/Spl.A/A1/2019-1, dated 01.10.2019 to
negotiate and resolve the issues raised by the RTC JAC
and to make recommendations to the Government for
improving the operational and financial performance of
TSRTC.

The above Committee held discussions with the leaders of


the Unions continuously on 2 nd, 3rd and 4th October and
informed the members of JAC as follows:

 Officers of TSRTC have been advised to examine


all the demands and submit issue wise details.

 Consultations have to be made with all the stake


holders on the demands raised by the JAC, before
making any recommendations.
 The Committee requires time to submit
recommendations on the demands raised by the
JAC and to suggest the measures for
strengthening of TSRTC.

 If the employees resort to Strike, all the Officers


concerned would be busy in making alternative
arrangements for transportation of commuters
which would lead to delay in submission of the
report.
The Committee assured that all the demands will be
examined sympathetically and recommendations will
be submitted to the Government as expeditiously as
possible. The Committee finally requested the
leaders of JAC to suspend the strike, to avoid the
delay in submissions of the recommendations to the
Government as the Officers would be preoccupied
with contingency plans if the employees resort to
strike.

The representatives of the Unions attended for conciliation


proceedings before the Conciliation Officer and Joint
commissioner of Labour, Hyderabad (twin cities) on
04.10.2019 and the Official representatives of TSRTC
requested to adjourn the conciliation proceedings in view
of the constitution of the Committee by the Government
to examine the demands raised by the JAC. The
Conciliation Officer also requested the leaders of JAC not
to resort to strike in view of the pendency of the
Conciliation proceedings.

Ignoring the measures taken by the Government to


examine the demands raised by the Unions and causing
inconvenience to crores of passengers, the unions called
the employees of TSRTC to go on strike from 05.10.2019.

Ques 2. Apart from 21 demands of the employees union,


are there any other grievances of demands of the RTC
employees Union?

(a) What are the grievances/demands of the employee


union?
(b) Had the State govt. of Telangana and management
of TSRTC discussed those issues?
(c) Provide information of the above the discussion
(a) The following are the demands raised by the Joint
ActionCommittee.
1) Merging of TSRTC into Government.

2) Steps to protect TSRTC. Payment of concession amounts


to TSRTC. Regular releasing of funds to TSRTC by
Government.

3) To allocate 1% Budget. Viability Fund for TSRTC towards


the losses caused for Town and Rural services, as is being
done for Metro Rail. To release funds allocated to RTC. To
release the due amounts from GHMC as per Act
amendment.

4) Government should bear burden on diesel.To abolish MV


Tax.To exempt TSRTC from all types of taxes since RTC is
running for social obligation.

5) Job security for conductors and drivers.

6) Revision of pay scales 2017w.e.f. 01.04.2017.

7) To fill up vacancies in all categories.

8) To pay dues with interest to PF, CCS, SBT & SRBS.

9) To provide employment to the children of deceased


employees - To provide supervisory posts also to them as
per their eligibility.

10) To release settlement to the retired employees


including wages for SakalaJanulasamme period.

11) To consider inter-zonal / inter-regional transfers as


onetime measure.

12) To grant child care leave to women employees on par


with government.
13) To provide alternative employment to the medically
unfit employees and color blind employees - To rescind
the circular issued on government exemption from
providing alternative employment.

14) To provide White Ration Card, Arogyasri Card and


Asara Pension to the retired employees.

15) To withdraw over mileage buses – to withdraw hire


buses and to purchase new buses.

16) To alter Electricity FAME-2 scheme so as to purchase


the buses by RTC and receive the concessions applicable
to the scheme.

17) To upgrade TNK Hospital as super specialty hospital


– to provide medical facilities and supply medicines – to
provide referral facility at super specialty hospital for
employee’s parents.

18) To arrange duties as per MTW Act – to pay double


wages for double duty.

19) To regularize the services of the remaining contract/


casual employees and CED and Paramedical Staff working
on contract basis.

20) Payment of Leave Encashment due, DA Arrears and


supply of Uniform.

21) Operation of buses as per inter-state agreement and


to arrest illicit operations.

22) To permit TSRTC for Courier, Parcel and Goods


transport.

23) To increase the posts of supervisors as per staff ratio


and fill up the vacancies.
24) To reduce the work burden of garage workers and
abolish the outsourcing system in all wings.

25) To regulate the duties of lady conductors working in


GHZ such that they complete their duty hours by 21.00
hrs.

26) To regularize the services of Regulation 30


employees from the date of their assuming higher
responsibilities.

The IAS Officer’s Committee held discussions with the


leaders of the Unions continuously on 2 nd, 3rd and 4th
October and informed the members of JAC that the
Committee requires time to submit recommendations on
the demands raised by the JAC and requested the union
leaders not to resort to strike. But without heeding to the
request of the Committee the unions proceeded on strike.
Hence, further discussions could not be held.

Ques 3.

It came to the notice of the Commission that mobile


phones were not allowed to the venue of discussion
between the union & the state government, TSRTC.
Explain.

In order to avoid disturbance during the discussions,


mobile phones were not allowed to the venue of the
discussion.

Ques 4.

What relief measures /action provided by the state


government of Telangana for the regard and need of the
public interests.
TSRTC engaged drivers and conductors on payment of
daily remuneration to operate all buses to avoid public
inconvenience. TSRTC is able to operate 70% of the buses.
Thus, no public inconvenience is caused.

The State Government of Telangana issued stage

carriage permits to private operators to avoid public


inconvenience.

Ques 5.

Is there any direction from the Hon’ble High Court to hold


talks & settle all their disputes between 28.10.2019 &
report back to court? Any report submitted by the state
govt. of Telangana or management of TSRTC? Provide a
copy of detailed report.

In WP (PIL).131 of 2019 the Hon’ble High Court through


orders dated 18-10-2019 directed the corporation to
discuss on 21 non-financial demands raised by the Unions
under the supervision of state government.

As per orders of the Hon’ble High Court, the Managing


Director has constituted a committee consisting of the
following Executive Directors to examine the 21 demands
raised by the Unions and listed in the order of Hon’ble
High Court dated 18-10-2019 in WP(PIL). No. 131 of 2019
and advised to submit factual report on the financial
implications/other implications on each demand.

Accordingly, the committee submitted its factual report to


the Managing Director on 25.10.2019.
As per the orders of the Hon’ble High Court, a letter dated

26.10.2019 was issued to the leaders of the JAC calling

upon there to attend meeting on 26.10.2019 at 2.00 P.M.

in the conference hall of Engineer in Chief, Roads and

Buildings Office, Erramanjil, E&C Office, Hyderabad for

discussions/negotiations vide letter No.MD Peshi-

167(2)/2019, dated 26.10.2019.

The Chief Secretary to the Government has authorized Sri

Sandeep Kumar Sultania, IAS Secretary to Government

and Commissioner to Transport Department (FAC) vide

letter No.273/CSP/2019, dated 26.10.2019 to participate

in the talks along with In-charge Managing Director,

TSRTC. Despite the order passed by the Hon’ble High


Court directing the leaders of the JAC to participate in the

meeting and discuss on 21 demands, they have never

shown any interest to discuss on these 21 demands.

Instead they have insisted to discuss all the demands

which were not in accordance with the orders of this

Hon’ble High Court. Therefore, a factual report has been

submitted to the Hon’ble High Court. A Copy of the report

is enclosed herewith.

Ques 6.

How many buses hired by the State Government of

Telangana/TSRTC till date since strike commence?

No buses have been hired by the state Government of

Telangana for operation of buses during strike period.

Private buses have been issued stage carriage permits by

the govt. on payment of rs.100/- towards tax on prorata

basis per vehicle per day.

Ques 7

How much expenditure incurred due to hiring of private


buses by the state Government of Telangana/TSRTC?
Since, there is no hiring of private buses no expenditure

was incurred by the Govt.

Ques 8

How many suicides committed/attempted by the


employees of RTC during ongoing strike till date?

4 employees committed suicide till date.

Ques 9

Whether State Govt. of Telangana / TSRTC received any


severe accident / injury of harassment matter from the
general public (commuters) because of ongoing strike?
Provide details.

No such complaint was received.

Ques 10

Whether State Govt. of Telangana / TSRTC received any


type of complaint against any employees of RTC from any
corner of State of Telangana?

No such complaint was received.

Ques 11

A case of attempted suicide by a driver Bathini Ravi in a


Narsapet depot in Telangana. Is it true?

(a) What is the present medical condition of the driver?


(b) What medial relief/facility directed by the TSRTC /
State government of Telangana to the driver?
(c) Any financial support / relief provided to the family of
the driver?

The said driver attempted to commit suicide but he was

prevented by the co workers and he didn’t suffer any

injuries.

How many RTC employees resumed their duties?

222 employees resumed their duties.

Ques 13

What’s the present schedule of government bus route in


the State of Telangana? Provide a copy of the scheduled
list.

TSRTC has been operating ----- no. of routes.

Ques 14

How many private buses are running on road in the state


of Telangana since the day of strike?

Ques 15

Whether any report on the ongoing strike subject from


the State Labour department, Telangana submitted to the
government? Provide a copy of the report.
Ques 17

Provide information of last salary remunerated to the


employees of the RTC?

the employees of the RTC were paid salary for the

month of Aug19 in the first week of September.
