III. Problem Presented

Marisol, presently was referred by PNP - La Paz for temporary shelter and protective
custody because she was allegedly raped by her Step Father and Half-brother.

IV. Brief History

As far as Marisol can remember, her step father Nerio Pantil, had been abusing her
sexually ever since she was ten years old. When she was eleven years old, her half-
brother started sexually abusing her.

Accordingly, Marisol would touch and caress a lot, signs that minor didn’t really give
attention to for all she thought, those were all just the behaviors of her stepfather’s
flattery. Minor accordingly started living in Pudoc, Poblacion, La Paz, Abra with her
step father’s roof when Marisol is in Grade 2 and they were close to each other as
minor would relate, she grew up closer to her step-father. As per minor’s half-brother,
Elbymar or Amben (nickname) and Marisol were really close. Marisol expresses that
her brother was a funny joker and sweet during her younger years, she even sleeps
besides her half-brother.

The first incident of rape accordingly happened in Pudoc, Poblacion, La Paz, Abra,
August 2016, Marisol is in Grade 5. It is during Intrams day at their school. When her
 stepfather Nerio Pantil invites her to the farm to feed some of his animals. Upon
arrival at the farm, her stepfather toppled a sack of roots as if fixing a bed. Then hold
Marisol’s two hands, forcing her to lay down on the sack. her father started caressing
her which she still thought at that time was just his gestures of his endearment until
she noticed he started touching her private parts and removing her underwear. Minor
tried to fight back and refused him but accordingly, he is stronger than she is. Nerio
succeeded in raping her and afterwards, threatened the minor not to tell anyone or he
will force her, her mother and siblings to leave their house because he knows that
they have nowhere to go when that happens. Then the succeeding raping incidents
happened every time her mother and siblings are not at home accordingly at their
home in Pudoc, Poblacion, La Paz, Abra until they transferred at Ababeng, Poblacion,
La Paz, Abra.

There is one instance that her mother, Sandra Bobila got able to witness the raping
incident when Marisol in Grade 6, her mother was humiliated and fights back Nerio
Pantil but she never made an action, she only promised Marisol that in case Nerio will
do the act again, she will accompany her to go to the police station. Minor was too
scared and frightened on what her step-father can do so she kept quiet the whole time.
From then on, Marisol would just sleep and have sexual intercourse with Nerio
whenever he wanted to.

February 2017, the first rape incident that her half-brother, Amben Babila was the
perpetrator. The incident happens at Pudoc, Poblacion, La Paz, Abra while they were
sleeping in the Kubo. Her companion that time is her sister Maricel Turqueza.
Marisol was sleeping when he felt like someone was on her top. Upon opening her
eyes, he saw her half-brother, Amben Babila. She smells liquor coming from her half-
brothers’ mouth, then the raping happens.

Marisol didn’t find any guts to tell anyone what her stepfather and half-brother did to
her until on January 27, 2020, minor went to PNP La Paz Station and disclosed her
story.

Marisol on the other hand, noticed to be very pale, absent-minded. She was brought
to Abra Provincial Hospital for medico-legal examination. Medico-legal examination
results of Marisol was that foul-smelling vaginal discharge, deep healed lacerations
were seen, and found out that she was alleged raped. OB who attended to Marisol
quickly referred her to PNP and MSWDO-La Paz for further interventions.
Subsequently, she was turned-over to the MSWDO of La Paz for temporary shelter
and protective custody.

On February 4, 2020, Marisol was brought to Dr. Corazon Adriatico, psychologist

and had her undergone behavioral assessment. And recommending Marisol to
undergo Rehabilitation Program.

At present, minor’s maternal relatives and her mother are accordingly pleasing
Marisol to not to pursue a case against her stepfather and half-brother and even trying
to promise Marisol to distance her from his step-father and half-brother. They are
planning to send Marisol in Pangasinan with her younger sibling to stay with their
maternal aunt and she will be the one to give care with them and send them to school.

V. Background Information

a. Client’s Information

Marisol is the youngest among 6 children of Sandra Papagayo and the late
Damaso Turqueza. She grew up attached to her biological father more than her
mother as Marisol’s mother shared. When Marisol was born, her father had
 always been there to take care of her even the times her mother and father got
separated. Marisol and her siblings stayed with their father’s custody. Marisol
shared that her father would usually take her out for a treat and treats her very
nicely. Their set up with her father and mother are even okay before.

When Marisol is in Grade 5, her father died suddenly due to too much liquor
consumption, leaving Marisol and her siblings nothing but sadness and shock.
Marisol and her siblings transferred to their mother’s custody.

At school, Marisol is an achiever, she excelled in her class and was described to
be a bright student. Marisol loves to hang out with her girlfriends and go along
with all the activities at school.

But after the rape incident happens to her, Marisol suddenly, often seen hanging
out with the boys at school. Marisol started to become quieter and keeps to herself
oftentimes. She started disliking going school she became shy and would always
be absentminded. Accordingly, Marisol find it difficult lately to say what she
wants or what she needs.

b. Family’s Information

Marisol grew up in a broken family. Her father and mother weren’t married. Her
mother has been into a relationships five times. Marisol’s perpetrator was the last
partner of her mother.

When Marisol’s mother learned what had happened to Marisol, she was very sad
and angry at the same time yet she never does any act of it, she only promised
Marisol to accompany her at the police station if ever her live in partner will
touch her again as her solution to stop the cycle of abuse in their home. About
Marisol’s mother reaction to her half brother as perpetrator, she never believes it
and questioning Marisol how could he do it if her brother was staying in San Juan,
Abra and only coming to visit them often times.

Marisol’s maternal relative on the other hand had been trying very hard to
convince her to not to pursue a case against her stepfather and half-brother and
even trying to promise Marisol to distance her from his step-father and half-
brother.

VI. Updates/Assessment

This is a case of a child who was sexually abused by her step-father and half-brother.

At first Marisol never gave up and pursued the case she filed against her step-father
and half-brother. She was also made aware of consequences that would happen once
her step-father and half-brother’s verdict is guilty, and she was still firm on her
decision to pursue the case.

But at present, due to her mother’s request and begging, Marisol started to tell to the
social worker and to the WCPD staff that she only said all her allegations due to her
anger towards her mother who yelled and scolded her publicly when she is always
outside with her friends. She even tells to the above personnel that she just wanted to
stay away from her mother’s and step-father’s house that is why she made the
statement against her mother and step-father.
