Assignment of Error- Assignment of error is the specification of the trial court's alleged errors
on which the appellant relies in seeking an appellate court's reversal, vacation, or modification of
an adverse judgment. Trial court’s alleged error is pointed out in an appellate brief as grounds for
reversal.
Defendant- The person defending or denying; the party against whom relief or recovery is
sought in an action or suit, or the accused in a criminal case.
Ejectment- An action for ejectment is a lawsuit brought to remove a party who is occupying real
property. This is not the same as an unlawful detainer (eviction) suit against a non-paying or
unsatisfactory tenant. It is a suit against someone who has tried to claim title to the property.
Ex parte judicial proceeding- An ex parte judicial proceeding is conducted for the benefit of
only one party. Ex parte may also describe contact with a person represented by an attorney,
outside the presence of the attorney. The term ex parte is used in a case name to signify that the
suit was brought by the person whose name follows the term.
Plaintiff- the party who initiates a lawsuit by filing a complaint with the clerk of the court
against the defendant(s) demanding damages, performance and/or court determination of rights.
