IMPLEMENTING RULES AND REGULATIONS

ON MEMORIAL PLANS AND COLLEGE EDUCATION PLANS FOR THE MEMBERS
AND EMPLOYEES OF THE BJMP MUTUAL BENEFIT ASSOCIATION
INCORPORATED (BJMPMBAI)

To effectively carry out the contents of the contract in the signed Memorandum of
Agreement (MOA) on November 29, 2018 between the PHILPLANS First Incorporated and the
BJMP MUTUAL BENEFIT ASSOCIATION INCORPORATED (BJMPMBAI), the
BJMPMBAI Board of Directors, pursuant to the powers vested in it under its Constitution and
By-Laws, hereby issues the following rules and regulations.

The Commission may revise, the supplement these rules and regulations and issue
related guidelines, circulars and other subsidiary issuances as it deems necessary for the effective
implementation of the various provisions of this MOA.
RULE 1. TITLE AND SCOPE
SECTION 1. TITLE
These Rules and Regulations shall be referred to as the “Implementing Rules and
Regulations “of the BJMPMBAI IN GRANTING BENEFITS TO ITS MEMBERS,
OFFICIALS, AND EMPLOYEES ON MEMORIAL PLANS AND COLLEGE EDUCATION
PLANS, or the “Rules”.
SECTION 2. SCOPE
These Rules shall apply to all paying BJMPMBAI Members, Officials and Employees.
RULE 2. DEFINITION OF TERMS
Whenever used in the Rules, the following terms shall have the respective meanings
hereafter set forth.
Association – refers to the Bureau of Jail Management and Penology Mutual Benefit
Association Incorporated or BJMPMBAI.
Beneficiary – refers to a designated person or persons by the paying BJMPMBAI
Members, Officials and Employees in the subscribed Memorial Plans and College Education
Plans. In case that No name of designated beneficiary is listed in the records of BJMPMBAI
members, the latest named beneficiary of such BJMPMBAI Member, Official and Employee
kept in the BJMP records of Personnel files shall be the basis to determine in granting of the
benefits due to the Qualified Relative of the deceased member.
Beneficial Owner – refers to any person who is designated as the ultimate beneficiary of
the Life Insurance Benefits of the BJMPMBAI Members, Officials and Employees duly recorded
as such by the BJMPMBAI in its official records.
BJMP – refers to the Bureau of Jail Management and Penology
BJMPMBAI member – refer to the following who regularly pay the required
membership fee and monthly contributions:
a. BJMP Uniformed personnel, active, honorably separated or retired;
b. BJMP Non-Uniformed personnel active, honorably separated or retired;
c. BJMPMBAI officials and employees, active, honorably separated or retired; and
 d. Associate members (BJMPMBAI Amended By-Laws Article III Sec.4)
College Education Plan – refers to the education plans purchased by the BJMPMBAI
from PHILPLANS First Inc., for the benefits of the qualified relatives of BJMPMBAI Members,
Officials, and Employees.
Commission – refers to the Philippine Insurance Commission, the government’s
regulatory body which is mandated by law to regulate and supervise the insurance, pre-need, and
HMO industries in accordance with the provisions of the Insurance Code, as amended, Pre-Need
Code of the Philippines, and Executive Order No. 192 (s. 2015).
Contract Price – refers to the Pre-Need Price of the Plan exclusive of taxes and fees.
In Good Standing – refers to individual BJMPMBAI Member, Official, and Employee
regarded to have fulfilled his/her obligations without being a subject to any sanction, suspension,
or disciplinary censure.
Life Insurance Benefit – refers to the Insurance Benefits of a Plan duly approved by the
Life Insurance Company Affiliated with PHILPLANS First Inc.
Memorial Plan – refers to the Memorial plans purchased by the BJMPMBAI from
PHILPLANS First INC., for the benefit of BJMPMBAI Members, Officials and Employees
when need for its use arises.
Participants – refer to Named or Unnamed BJMPMBAI Members, Officials, and
Employees who are eligible, or whose qualified relatives are eligible to utilize the Purchased
Plans as determined by The Rules of the BJMPMBAI and to all those indicated in the List of
Participants submitted by the BJMPMBAI and the subsequently approved by PHILPLANS First
Inc.
Paying members – refer to members who are paying the monthly contributions including
their Associates.
PHILPLANS First Inc., or PHILPLANS – shall refer to a corporation and existing
under and by virtue of the laws of the Republic of the Philippines engaged in the sale and
maintenance of various pre-need plans including Memorial Plans and College Education Plans.
Nominee – refers to a person or persons designated by the BJMPMBAI M embers,
Official and Employees to use the coverage of benefits in the PHILPLANS College Education
Plan.
Qualified relatives – refers to a person or persons designated by the paying BJMPMBAI
Members, Officials and Employees as beneficiary of the subscribed Memorial Plans and College
Education Plan with established proof of relationship by consanguinity up to the 4th civil degree.
Unnamed participants – refer to the purchased Memorial Plans for use of BJMPMBAI
Members, Officials and Employees when need arises at any given time.
Utilization of a Plan – refers to instances which include, but shall not be limited to, the
assignment or transfer in favor of a Named Participant in the case of a Memorial Plans, and the
transfer to a non-Participant for availment of the College Education benefits by the qualified
relatives of a Named Participant in case of College Education Plan.
RULE 3. DETAILS AND UTILIZATIONS OF
MEMORIAL PLANS AND COLLEGE EDUCATION PLANS
SECTION 3. The BJMPMBAI Purchased Memorial Plans and College Education Plans from
PHILPLANS FIRST Inc.,
SECTION 4. The Memorial Plans are the Unnamed Memorial Plans and Named Memorial
Plans
SECTION 5. The College Education Plans are the SUMMA College Education Plans and the
STI College Education Plans.
SECTION 6. Details and Utilization of the Unnamed and Named Memorial Plans.
 A. Unnamed Memorial Plan
A1. Under this Plan, the BJMPMBAI shall purchase from PHILPLANS
Forty Four (44) Memorial Plans every month of January and February each year.
A2. The Contract Price per Plan is Fifty Thousand Pesos (PhP50,000.00)
per Plan;
A3. The AGE of the BJMPMBAI Members, Officials and Employees is at
least Eighteen (18) years to
