Sub:- Providing Loans to the needy advocates, out of the amount
released by the Government of Andhra Pradesh, being part of
100 Crores sanctioned by the Government for Welfare of the
Advocate Community - Reg.

The Government of Andhra Pradesh has announced “Grant” of
Rs.100 Crores for Welfare of the Advocate Community in the State of Andhra
Pradesh. In pursuant to the request made by the Chairman, Bar Council of
Andhra Pradesh, Government has released an amount of Rs.25 Crores, out of
the afore said 100 Crores, announced by it for the Welfare of the Advocate
community. A Special Committee was constituted under the Chairmanship of
the Advocate General to disburse the said amount. The Committee has decided
to provide Health Insurance to the needy Advocates and also to provide loan
facility to all those needy advocates, who have already filed COP Applications
OR Declarations. The details of the Loan Scheme and the modalities fixed are as
follows :

The Bar Council of Andhra Pradesh has approved the said Loan Scheme
by Resolution dated 06-08-2020.

The following “Eligibility Criteria” is prescribed for the purpose of granting
the loans :

1. Advocate should have filed Application under Certificate and Place of


Practice (Verification) Rules, 2015 OR should have passed All India
Bar Examination and should have filed Declaration.

2. Advocate should have AADHAR card.

3. Advocate should not have availed stipend under YSR LAW NESTHAM

4. Spouse should not be a gainfully employed in any Government /


Government Undertaking / Corporation / Government Organization.

5. Advocates, who have retired from Government / Government


undertaking Service and availing pension are not eligible.

6. Advocates, possessing Four-wheeler as well as House is not eligible.

Note : Any person, who was allotted a house under a Government


Scheme meant for socially and economically weaker section categories
and a person, who owns a house in a village, other than the City or
Town, where he is practising, will not be disqualified.

7. Bar Council Members and Presidents of the Bar Associations are not
eligible.

8. The Advocates, availed Financial Assistance under Covid-19, provided by


the Bar Council and all other Advocates, having less than 5 years
standing i.e. enrolled on or after 01-08-2015 are entitled to avail loan of
Rs.10,000/- only.

9. The Advocates, who are more than 5 years of standing and not availed
financial assistance under Covid-19, provided by the Bar Council are
entitled to choose loan either to an extent of Rs.10,000/- or Rs.20,000/-
.

10. All Government Pleaders / Asst. Govt. Pleaders / Special Govt. Pleaders
/ Public Prosecutors / Asst. Public Prosecutors / Special Public
Prosecutors / Standing Council / Legal Advisors and the Advocates, who
are having the source of income are not eligible to avail the loan.

The Advocates intend to obtain the loan, can submit the applications
through online digital application from 10-08-2020 4:00 PM to 16-08-2020
4:00 PM with Bar Association Certificate / ID Card &
Self-Declaration. The Link will be enabled on 10-08-2020 at 4.00 P.M.

The office will verify the details submitted in the application and will
display the list of applicants, Bar Association wise, in the website of the
Bar Council on 20-08-2020, to enable the Bar Associations to raise
objections, if any, within 48 hours.

After verification, the applications will be placed before the Committee for
consideration. The amount granted by the Committee will be transferred
directly, through online, to the Accounts of the respective Advocates. If the
applications are received, more than expected, the proposed loan amount will
be rescheduled. The Repayment of Loan will be scheduled from January, 2021.
The advocates can pay the installment by “SBI Collect” online payment gateway.

If, any Advocate fails to repay the loan amount within the scheduled
period, Disciplinary action will be initiated by the Bar Council, treating the
same as misconduct.
