RESOLVED THAT:
I. This Council approves the form of drafC by-law and
franchise agreement attached hereto and authorizes the
submission thereof to the Ontario Energy Board for
approval pursuant to the provisions of Section 9 of The
Municipal Franchises Act.

Councillor Yake expressed his dissatisfaction with the public meeting held
recently regarding the future use of the old Mount Forest arena. He felt
the meeting was not productive as no progress has been made towards a
decision and recommended hu-ing a consultant to create a few plans to
present to the public along with costs to aid in the decision.

Mayor Broomhead informed Council that the sewage treatment plant and
the new sports complex are both ahead of schedule. Tenders for the new
County library should be out in mid January.

DECEMBER 10, 2007
Present a t t h e 8:00 a.m. meeting were: Bev Plume, Lloyd Aitken, Mayor
Mike Broomhead, Councillor Bob Mason, Chairman Councillor Dan Yake, Mark
MacKenzie, John Jeffery and Linda Spahr.
The Mount Forest Fire Department responded to 16 calls for assistance during the month
of November 2007.
Two meetinglpractice sessions were held during November. On November 12"' sixteen
members were present, and on November 26"' seventeen members were present.
On November 2ndand 3'd two members attended a fire fighter course in Neustadt. Two
members attended the Wellington County Mutual Aid meeting held in Arthur on
November 6t" On November 1lththirteen members took part ip the Remembrance Day
Parade and laid a wreath at the Cenotaph Two members hosted the St. May's Separate
School Kindergarten classes on November 12t11and 13" Seven members took part in the
Runway Show for Big Brothers & Sisters held in Haniston on November 16th
The Chief attended a Clandestine Drug Lab Awareness session on November 2of11and
took part in an Emergency Management Exercise on November 3oth.
The Department is receiving a high number of ambulance assist calls; mainly due to
delays with ambulance.

MOUNT FOREST FIRE DEPARTMENT
Township of Wellington North
The Mount Forest Fire Department responded to 13 calls for assistance during the month
of December 2007.
Two meetinglpractice sessions were held diuing December. On December lot'' fifteen
members were present, and on December 17thseventeen members were present.
On December 4"' two members attended the Wellington County Mutual Aid meeting in
Moorefield.
The Department took part in the Mount Forest Santa Claus Parade on December 711'. On
December 15~"five members attended the Holstein Santa Claus Parade and assisted with
Traffic Control.
Six members attended the wake for Chief of Inspections of the Minto Fire Department,
Michael Hinsperger on December 18t1'. Four members attended the funeral of Michael
Hinsperger and three members were on stand by for the Hauiston Fire Department on
December 19th.

We are writing this letter to let you know that we are still proceeding
with the development on the property described as Mount Forest, Egremont,
Concession 3, Part Lot 7 1, RP 60R2 149, Part 2 Part, in the Township of
Wellington North, in the County of Wellington.
The sewer work will now have to wait until the Spring of 2008, due to
the slow response from the Saugeen Valley Conservation Authority. They '
now want some more Grade Shots from our Engineering Firm, B.M. Ross
and Associates for more assessment, which has resulted in a further delay.

RESOLU1'ION OF THE COUNCIL OF THE CORPORATION OF THE CITY OF WATERLOO
December 17,2007
"WHEREAS the City of Waterloo is one of many Ontario municipalities with existing infrastructure
renewal funding needs, currently estimated at over $156 million for the City of Waterloo;
AND WHEREAS the Government of Canada has seen fit to exempt all municipalities in Canada
from paying the Goods and Services Tax ("GST") resulting in a $1 -2 million per year benefit to the
City of Waterloo;
AND WHEREAS the City of Waterloo pays approximately $700,000.00 per year in Provincial Sales
Tax ("PST").
1) the Council of The Corporation of the City of Waterloo request the Provilice of Ontario to
fully exempt all Ontario municipalities from paying PST, with the understanding that the
savings realized be mandated to fund existing infrastructure renewal in local municipalities;
the Prime Minister of Canada, Minister of Finance, Minister of National Revenue, Minister
of Transport, lnfrastructure &Communities, Minister of Public Works & Government
Services and Minister of Public Safety
all municipalities in Ontario with a request that those municipalities endorse the City of
Waterloo's resolution and forward their endorsement to the Prime Minister of Canada,
Minister of National Revenue, Minister of Transport, lnfrastructure and Communities,
Minister of Public Works and Government Services and Minister of Public Safety and the
Premier of Ontario, Minister of Public lnfrastructure Renewal, Minister of Finance, Minister
of Revenue, Minister of Transportation and Minister of I\/lunicipal Affairs and Housing."

RESOLU'I'ION OF THE COUNCIL OF THE CORPORA'I'ION OF THE CITY OF WATERLOO
December 17,2007
AND WHEREAS provincial and national economic prosperity is inextricably linked to the well being and prosperity of towns and
cities;
AND WHEREAS public ownership of infrastructure has shifted over the past 50 years away from the federal and provincial
governments to become an increasing responsibility for municipal governments such as the City of Waterloo;
AND WHEREAS the City of Waterloo requires revenues that grow with the economy in order to contribute to the sustainability of
its infrastructure;
AND WHEREAS the Council of the City of Waterloo has introduced a number of initiatives such as ten-year capital planning,
continuous improvement, public private partnerships and a proposed capital investment contribution as the City's efforts to
address the infrastructure deficit;
AND WHEREAS the City of Waterloo has determined that its municipal infrastructure deficit is approximately $160 million over
the next ten years;
AND WHEREAS the City of Waterloo's infrastructure deficit would require a one time municipal tax increase of 40% to be fully
funded;
AND WHEREAS property taxes, for the most part, is a very regressive tax not based on economic growth, income or ability to

AND WHEREAS there is just a single taxpayer paying taxes to the different levels of government;
AND WHEREAS, on average, municipalities collect eight cents of every dollar of total government collected taxes for the
services they provide;
AND WHEREAS there are federal and provincial surpluses projected over the next number of years;
1) the Council of The Corporation of the City of Waterloo calls upon the Provincial and Federal governments to re-
examine how municipalities are funded in regards to infrastructure and work together with a view to providing long term
and sustainable infrastructure funding programs to assist the City of Waterloo and all upper, lower and single tier
municipalities in addressing their infrastructure roles and responsibilities;
2) copies of this resolution be forwarded to the Prime Minister of Canada, the Premier of Ontario, Federal and Provincial
Ilinisters of Finance, Provincial Minister of Public lnfrastructure Renewal, Federal Minister of Transportation, all
Members of Parliament, all Members of Provincial Parliament, the Association of Municipalities of Ontario (AMO), the
Federation of Canadian Municipalities (FCM) and the Big Cities Mayors' Caucus of FCM;
3) all municipalities be encouraged to pass motions supporting this resolution and forward to their relevant federal and
provincial representatives."

THE CORPORATION OF 'THE
TOWNSHIP OF WELLINGTON NORTH
WHEREAS Section 317 of the Municipal Act, 2001, S.O. 2001, c.25, as
amended, provides that the Council of a local municipality may, before the
adoption of the estimates for the year pass a by-law levying amounts on the
assessment of property in the local municipality rateable for local municipality
purposes, includiqg pipeline, conservation lands, managed forest,
residentiallfarm, farmland, commercial, industrial and multi-residential
assessments in the local municipality;
AND WHEREAS Section 317 of the Municipal Act, 2001, S.O. 2001, c.25,
provides that the amount levied on a property shall not exceed 50 per cent of the
total amount of taxes for municipal and school purposes levied on the property
for ,the previous year.
AND WHEREAS Section 346 of the Municipal Act, 2001, S.O. 2001, c.25, as
amended, provides that the Council may require the payment of taxes to be
made into the office of the Treasurer by any day or days to be named herein, in
bulk or by installments;
AND WHEREAS Section 345 of the Municipal Act, 2001 S.O. 2001, c.25, as
amended, provides that the Council of a local municipality may impose late
payment charges for ,the non-payment of taxes or any installment by the due
date, a percentage charge, not to exceed 1 114 per cent of the amount of taxes
due and unpaid, may be imposed as a penalty for the non-payment of taxes on
the first day of default the non-payment of taxes in the manner specified in the
by-law but interest may not start to accrue before the first day of default. and on
the first day of each calendar month thereafter in which default continues, but not
after the end of the year in which the taxes are levied;

AND WHEREAS Section 347 of the Municipal Act, 2001, S.O. 2001, c.25, as
amended, provides that the Council of any municipality may authorize the
Treasurer to accept part payment on account of taxes due and to give a receipt
for such part payment, provided that acceptance of any such part payment does
not affect the collection of any percentage charge imposed and collectable 1~1nder
Subsection (3) in respect of non-payment of any taxes or any class of taxes or of
any installment thereof;
AND WHEREAS Section 345 of tlie MUI-~icipalAct, 2001, S.O. 2001, c.25, as
amended, provides that the Council of a local municipality may require that the
Treasurer, add to the amount of all taxes due and unpaid, interest at such rate
not exceeding 15 per cent per annum as the Council determines, from the 31"
day of December in the year in which the taxes were levied until the taxes are
paid;
1. THAT for the year 2008, 50 per cent of the total amount of taxes for the
previous year shall be levied, raised and collected on all real property
taxable within the pipeline, conservation lands, managed forest,
residentiallfarm, farmland, commercial, industrial and multi-residential
classes, and liable to pay the same according to the last revised
assessment roll:
2. THAT the said interim tax levy shall be due and payable in two
installments at the Township of Wellington North Municipal Office and
most chartered banks and financial institutions as designated by the
Municipality, on or before the following dates:
3. THAT the Treasurer mail or cause same to be sent by first class mail to
the residence or place of business of such person indicated on the last
revised assessment roll, a written or printed notice specifying the amount
of taxes payable, due dates and penalty and interest rates to be applied
upon default.
4. THAT failure to receive the aforesaid notice in advance of the date for
payment of the interim levy or any installment does not affect the timing of
default or ,the date from which penalty shall be imposed.

5. THAT penalty of 1.25 per cent will be added to current taxes with
installment due dates which are in default, in accordance with Section 2 of
this By-law, as of the 1" day of March 2008 and the lst day of May 2008
respectively to each installment due date, and thereafter a further penalty
of 1.25 per cent will be added on the lst day of each month and every
month the default continues until December 3lSt,2008.
6. THAT interest of 1.25 per cent on the amount of any taxes due and
unpaid after Decerl-lber 31, 2008, shall be charged on the lst
day of each
calendar month thereafter in which the default continues.
10. 'THAT this by-law shall be deemed to come into force and effect on
January 1, 2008 and shall apply to all tax classes.
11. THAT in the event that any provision or section of this by-law is found by
a court of con-lpetentjurisdiction to be ultra vires the posers of the Council
of the Corporation, 01-llysuch provision or section, as the case may be,
shall be inoperative and all other provisions and sections of this by-law
shall remain in full force and effect.

THE CORPORATION OF 'THE

AUTHORITY: Municipal Act, 2001, S.O. 2001, Chapter 25, as amended, Section 407.
WHEREAS the Municipal Act, 2001, S.O. 2001 Chapter 25, Section 407,
provides authority for a council by by-law to authorize the head of council and the
treasurer to borrow from time to time, by way of promissory note or banker's
acceptance, such sums as the council considers necessary to meet, until taxes
are collected and other revenues received, the current expenditures of the
corporation for the year; and
WHEREAS the total amount which may be borrowed from all sources at any one
time to meet the current expenditures of the Corporation, except with the
approval of the Municipal board, is limited by Section 407 of the Municipal Act,
2001.
1. The liead of council and the treasurer are hereby authorized to borrow
from time to time by way of proniissory note or banker's acceptance
during the year 2008 (hereinafter referred to as the current year) such
sums as may be necessary to meet, until the taxes are collected and other
revenues received, the current expenditures of the Corporation and the
other amounts that are set out in subsection 407(1) of the Municipal Act,
2001.
3. The total amount which may be borrowed at any one time under this by-
law, together with the total of any similar borrowings that have not been
repaid, shall not exceed from January 1 to September 30 of the current
year, 50 percent of the total and from October 1 to December 31 of the
current year, 25 percent of the total of the estimated revenues of the
Corporation as set forth in the estimates adopted for the current year or
$1,000,000.00 whichever is less.
4. The treasurer shall, at the time when any amount is borrowed under this
by-law, ensure that the lender is or has been furnished with a certified
copy of this by-law (a certified copy of the resolution mentioned in section
2 determining the lender,) if applicable, and a statement showing the
nature and amount of the estimated revenues for the current year and also
showing the total of any other amounts borrowed from any and all sources
under authority of section 407 of the Municipal Act, 2001 that have not
been repaid.
a) If the estiniates for the current year have not been adopted at the
time an amount is borrowed under this by-law, the limitation on total
borrowing, as set out in section 3 of this by-law shall be calculated
for the time being upon the estimated revenues of the Corporation
as set forth in the estimates adopted for the next preceding year.
If the estimates for the current year have not been adopted at the
time an amount is borrowed under this by-law, the statement
furnished under section 4 shall show the nature and amount of the
estimates revenues of the corporation as set forth in the estimates
adopted for the current preceding year and the nature and amount
of the revenues received for and on account of the current year.
5. All or any sums borrowed under this by-law shall, with interest thereon, be
a charge upon the whole of the revenues of the Corporation for the current
year and for any preceding years as and when such revenues are
received; provided that such charge does not defeat or affect and is
subject to any prior charge then subsisting in favour of any other lender.

BEING A BY-LAW TO CONFIRM THE PROCEEDINGS OF THE
COUNCIL OF 'THE CORPORATION OF THE TOWNSHIP OF
WELLINGTON NORTH AT ITS REGULAR MEETING HELD ON
JANUARY 7,2008.
AUTHORITY: lblunicipal Act, 2001, S.O. 2001, c.25, as amended, Sections 5(3) and 130.
WHEREAS the lklunicipal Act, 2001, S.O. 2001, c.25, as amended, Section 5(3), provides that the
jurisdiction of every council is confined to the municipality that it represents and its powers shall be
exercised by by-law.
AND WHEREAS the Municipal Act, 2001, S.O. 2001, c.25, as amended, Section 130 provides that
every council may pass such by-laws and make such regulations for the health, safety and well-
being of the inhabitants of the municipality in matters not specifically provided for by this Act and for
governing the conduct of its members as may be deemed expedient and are not contrary to law.
NOW THEREFORE the Council of The Corporation of the Township of Wellington North hereby
ENACTS AS FOLLOWS:
1. That the action of the Council at its Regular Meeting held on January 7, 2008 in respect to
each report, motion, resolution or other action passed and taken by the Council at its
meeting, is hereby adopted, ratified and confirmed, as if each resolution or other action was
adopted, ratified and confirmed by separate by-law.
2. That the Mayor and the proper officers of the Township are hereby authorized and directed
to do all things necessary to give effect to the said action, or to obtain approvals where
required, and, except where otherwise provided, the Mayor and the Clerk are hereby
directed to execute all documents necessary in that behalf and to affix the corporate seal of
the Township to all such documents.
3. That this by-law, to the extent to which it provides authority for or constitutes the exercise by
the Council of its power to proceed with, or to provide any money for, any undertaking work,
project, scheme, act, matter or thing referred to in subsection 65 (1) of the Ontario Municipal
Board Act, R.S.O. 1990, Chapter 0.28, shall not take effect until the approval of the Ontario
Municipal Board with respect thereto, required under such subsection, has been obtained.
4. That any acquisition or purchase of land or of an interest in land pursuant to this by-law or
pursuant to an option or agreement authorized by this by-law, is conditional on compliance
with Environmental Assessment Act, R.S.O. 1990, Chapter E.18.
