CONTRACT OF LEASE

KNOW ALL MEN BY THIS PRESENTS

This Contract of Lease (“Contract”) is made and entered into this ___ day of _____________ at
_____________, by and between:

______________, Filipino, of legal both and a resident of _______________, hereinafter


referred to as “LESSOR”;

-and-

______________, Filipino, of legal both and a resident of _______________, hereinafter


referred to as “LESSEE”.

WITNESSETH THAT:

WHEREAS, the LESSOR is the owner of a ___________ situated in _______________ hereinafter


referred to as the PROPERTY.

WHEREAS, the LESSEE desires to lease the PROPERTY and the LESSOR has agreed to have the
PROPERTY leased unto the LESSEES, subject to terms and conditions herein set forth.

NOW, THEREFORE, for and inconsideration of the foregoing premises and the mutual covenants
herein contained, the parties herein hereby agreed as follows:

1. PURPOSES - The LESSOR hereby leases unto the LESSEE the PROPERTY and the LESSEES
hereby accepts the same on lease from the LESSOR on an as is where is basis. The PROPERTY
hereby leased shall be used exclusively by the LESSEES for residential purposes only and shall not
be diverted to other uses. It is hereby expressly agreed that if at any time the premises are used for
other purposes, the LESSOR shall have the right to rescind this contract without prejudice to her
other rights under the law.

2. TERM - This Contract shall be for a period one (1) year commencing on _____________ to
_______________ and shall be automatically renewed year on year unless otherwise terminated by
either Party upon written notice served to the other within fifteen (15) days prior to such
termination.

3. RENTAL RATE - The LESSEE shall pay monthly rental to the LESSOR for the use and occupation of
the PROPERTY in the amount of ______________ (P__________) subject to a ___% increase every
year.

4. DEFAULT IN PAYMENT - In case of default by the LESSEE in the payment of the rent, such as in
case of checks when the same are dishonored, the LESSOR at its option may terminate this contract
and eject the LESSEE. The LESSOR has the right to padlock the premises when the LESSEE is in
default of payment for one (1) month and may forfeit whatever rental deposit or advances have
been given by the LESSEE.

5. SUBLEASE - The LESSEE shall not directly or indirectly sublet, allow or permit the leased premises
to be occupied in whole or in part by any person or corporation, neither shall the LESSEE assign its
rights hereunder to any other person or entity and no right of interest thereto or therein shall be
conferred on or vested in anyone by the LESSEE without the LESSOR'S prior written approval.

6. UTILITIES - the LESSEE shall pay and defray any and all costs of water, electricity, internet, cable
TV, telephone bills and other public services and utilities during the lease period.

7. IMPROVEMENTS - The LESSEES shall not make any alteration or improvement on the PROPERTY
without the written consent of the LESSOR. Any alteration or improvement introduced by the
LESSEE in the PROPERTY shall, upon the termination of this Contract automatically become the
property of the LESSOR without any obligation on the latter’s part to pay or refund its value or costs
to the LESSEES; provided however, that if such alterations or improvements are made without the
written consent of the LESSOR, the latter may cause the removal thereof at any time at the expense
of the LESSEES.

8. FIRE HAZARDS AND OBNOXIOUS SUBSTANCE - The LESSEE shall not deposit or store in the
PROPERTY any obnoxious substance or inflammable materials that might constitute a fire hazard.

9. THIRD PARTY LIABILITY - The LESSEE during the occupancy of the PROPERTY shall hold the
LESSOR free and harmless from any damage or liability or responsibility to any person or property
arising as a consequence of the use of PROPERTY by the LESSEE, its guests, and employees,
however, when any damage or liability is caused to the PROPERTY by fortuitous events or acts of
God such as but not limited to typhoon, earthquake, flood, etc. which are beyond the control of the
LESSEE, the latter shall not be liable to the LESSOR.

10. CONDITION OF PREMISES - The LESSEE shall maintain the premises in good and tenantable
condition and for such purposes. In case of damages in the properties caused by the LESSEE, he/she
shall cause its repair at its own expense and failure to do so shall be deemed a breach of this
Contract and a ground for its termination.

11. RETURN OF PREMISES - Upon termination of this Contract for any reason whatsoever, the
LESSEE shall immediately vacate the premises and return the possession thereof to the LESSOR
upon the latter’s request, unless this contract is extended or renewed.

12. JUDICIAL RELIEF - In case of cancellation or termination of this Contract due to default or breach
of any condition by the LESSEE, the LESSEE shall pay to the LESSOR all reasonable attorney’s fees,
cost and expenses of litigation that, may be incurred by the LESSOR in enforcing its rights under this
Contract as well as all unpaid rents, charges, or reimbursements which the LESSOR may be entitled.

13. BREACH - Any violation of the terms and conditions provided for in this Contract of Lease on the
part of the LESSEE or LESSOR shall be sufficient ground for the termination of this Contract by the
aggrieved party.
