APPLICABLE RULES:

2.02E Self-rate Eligibility Grievance Complaint.


Self rated players who enter the USTA League Tennis program by inappropriately self-
rating at an NTRP level lower than their actual skill level are considered to have violated
the standards of good conduct, fair play and good sportsmanship. These players may be
subject to a Self-Rate Grievance.

A player with a valid NTRP Computer (C) rating, or Benchmark (B) rating, or granted an
Automatic Appeal rating of a Computer (C) rating is not subject to a NTRP grievance.
Any other player is subject to a NTRP grievance.

3.04A NTRP Disqualification Procedures.


Dynamic ratings will be calculated for all players during local league competition, and at
every level of championship competition below National Championships, to determine if
any players have reached the NTRP disqualification criteria stated in the USTA NTRP
Computer Rating System Procedures. Year-end computer (C) and benchmark (B) players
are not subject to dynamic NTRP disqualification. All other players (S, A, M, T, D) will
be NTRP disqualified if they reach the disqualification level three (3) times based on all
matches reported in the National database for the USTA League Adult and Senior
divisions. (chart – 2010 Regulation 3.04A)

A player may not be dynamically NTRP disqualified from the USTA League Mixed
Doubles Division; however, a player is subject to a NTRP grievance.

5.01D(5) Mixed doubles results will not be part of generating a player's year-end rating,
except for those players who play in the USTA League Mixed Doubles Division
exclusively. Players who play exclusively in the USTA League Mixed Doubles Division
and choose to participate in the USTA League Adult and/or Senior divisions the next year
must enter at their USTA League Mixed Doubles Division year-end rating or higher.

3.5 Player NTRP General Characteristics


This player has achieved improved stroke dependability with directional control on
moderate shots, but still lacks depth and variety. This player exhibits more aggressive net
play, has improved court coverage, and is developing teamwork in doubles.

3.0 Player NTRP General Characteristics


This player is fairly consistent when hitting medium paced shots, but is not comfortable
with all strokes and lacks execution when trying for directional control, depth or power.
Most common doubles formation is one-up, one-back.

STATEMENT:

The Eastern Section Grievance Committee has thoroughly reviewed the complaint
submitted by Deb Rose-Andrews on April 6, 2010 and the responses submitted by Irene
Eng and Sean Yuen. The Committee upholds the NTRP Grievances submitted against
Irene Eng and Sean Yuen and and has determined that they shall be reclassified with 3.5
ratings immediately.

The Grievance submitted alleged that both Ms. Eng and Mr. Yuen self-rated inaccurately
in that their match results and mixed dynamic ratings are both at the 3.5 level. We agree.
The Committee has reviewed Mixed Doubles dynamic results generated by Mr. Yuen and
Ms. Eng in 2010. Mr. Yuen has played 3 matches as a 3.0 generating a very high 3.5
dynamic rating in 2 of the matches. Ms. Eng has played 11 matches as a 3.0 generating a
3.5 dynamic rating in 8 of the 11 matches. It should be noted one of the matches did not
generate a rating since one of her opponents was a self-rated player. As such, out of 10
matches Ms. Eng played on a 3.5 level for 8 of the matches.
Based on the Mixed Dynamic results it is the finding of this Committee Ms. Eng and Mr.
Yuen should immediately be reclassified with 3.5 ratings. All matches played by both
players to date shall stand as played.

Section VIII, Section A.
Appeals - The decision of the Section League Grievance Committee may be
appealed only if new information becomes available or the party filing the appeal
can demonstrate that proper procedures were not followed. Appeals must be filed
with the Chairperson of the Section Grievance Appeal Committee within the time
frame specified in the written decision of the Section Grievance Committee. All
appeals must be accompanied by a fifty dollar ($50) filing fee payable to USTA
Eastern; fees will be refunded if the appeal is upheld.

Individuals involved have until the following date and time to appeal:
April 13, 2010 @ 4:00p.m.
(Send email with such request by the date and time listed above and be advised that
the $50.00 check must be received by USTA Eastern within 7 days of the filing of
the Appeal. Failure of USTA Eastern to receive the $50.00 check within 7 days of
the filing of the Appeal will result in the Appeal of this Decision being null and void)
