MINUTES OF COMMITTEE HEARING RE: Proposed Ordinance No. 016-18, Establishing the Operation of the
Community Fish Landing Center (CFLC) at Barangay Pating, Masbate City and providing fees and charges
thereof conducted on September 20, 2018 @ SP Session Hall, Legislative Building, City Hall Compound,
Masbate City.

I. ATTENDANCE: The hearing was attended by the Hon. Ramil O. Yaneza, Chairman of the Committee,
Hon. Julius Anthony A. Aguilar, Hon. Rosemarie V. Salvacio, Hon. Jose Rodolfo B. Cortes, III, Mr.
Ramesis A. Sison, Mr. Rolando P. Tiam, BFAR/PFO, Ms. Lena R. Macadat, BFAR/FLDT, Engr. Isidro
R. Navea, Engr. Gerry D. Guadayo, Mr. Ernie J. Pacheco, AT-Fisheries, Mr. Marcial Julaton, Jr, Fish
Vendor; and the Secretariat.

II. CALL TO ORDER:


The meeting was called to order by the Hon. Ramil O. Yaneza, Chairperson of the Committee on
Economic Development, Cooperative, Trade and Commerce @ 9:00 in the morning to deliberate on the
aforesaid matter.

III. OPENING PRELIMINARIES:


Ms. Mylene C. Ogaya led the prayer. Afterwards, Hon. Ramil O. Yaneza, called the roll of the attendees
and acknowledge their presence.

IV. HIGHLIGHTS OF THE PROCEEDINGS:


The following findings were derived from the deliberation of the Committee:

1. The proposal suggests establishing the operation of the Community Fish Landing Center (CFLC) at
Barangay Pating, Masbate City that will serve as fish repository, training facility, and a center of fish
trade in the area;

2. Mr. Sison stated that the intent of the City Government of Masbate is to secure the rights of fisherfolks
and the local communities of Masbate City to the preferential use of the municipal/city waters and
provide the necessary assistance to the fisherfolks through the project.;

3. Hon. Aguilar suggested that all fisherfolks fish vendors and other individual or person engaged in
aquatic industry must first secure their business permit;

4. Also, Hon. Cortes recommended that all fishing vessels entering the Community Fish Landing Center
(CFLC) must be registered in the City of Masbate even though registered in Maritime Industry Authority
(MARINA) for purposes of taxation;

5. According to Hon. Cortes “Fishing Gear” as utilized in this ordinance should be in consonance with the
Republic Act 8550 otherwise known as “The Philippine Fisheries Code of 1998”;

6. Mr. Tiam suggested that the management of the CFLC shall be administered by the Community Fish
Landing Center Manager under the umbrella of the City Agriculture Office because the fisheries sector
is one of its sub offices wherein the main objective is to help the city to improve their economic stability
and lessen poverty incidence;

7. However, Hon. Cortes explained that the management of the CFLC is under the direct supervision of
the Office of the City Mayor not by the Office of the City Agriculturist;

8. Mr. Sison added that as per manual of BFAR, the CFLC is initially operated and managed by the City
Government of Masbate upon its construction. Then, it is eventually being fully turned-over to the
qualified local fisherfolk organization and cooperative, which will be capacitated in order to manage and
operate the CFLCs as a self-sustaining facility;

9. Below are the suggestions/recommendations per provision in the proposed ordinance:

a) As to Section 3: include the appellation “Fisheries Livelihood Development Technician”


(FLDT) that refers to a representative of BFAR in monitoring fish-catch and other services;

b) As to Section 4: the delegation should be specific; the proposed ordinance should specify
the powers and functions of the Local Chief Executive that can be delegated to the City
Administrator or the Community Fish Landing Center (CFLC) Supervisor or Manager;

c) As to Section 5:

c.1.) Paragraph 2: Engr. Guadayo stipulated that all fish or any other aquatic products
must be inspected and/or examined at the CFLC or its sub-center before being sold or
offered for sale at the Masbate City Public Market including flea markets within the
territorial jurisdiction of the City of Masbate;

c.2.) Paragraph 3: Mr. Sison suggested that there should be an inclusion of the
fishermen’s intent to sell their fish-catch to, but not limited to flea markets in the City for
them to be obliged to unload their fish catch or any other aquatic products/cargoes
exclusively at the CFLC.

d) As to Section 6: the CFLC Personnel Composition shall be composed of the Local Chief
Executive (LCE), the City Economic Enterprise Manager, one (1) CFLC Supervisor, one
(1) Fisheries Livelihood Development Technician (FLDT), one (1) CFLC Operation Officer,
three (3) Fish Examiners, three (3) Fish Inspectors, three (3) Revenue Collectors, three (3)
Administrative Aides, and three (3) Watchmen;

e) As to Section 7:

e.1.) Mr. Sison recommended the inclusion of the City Economic Enterprise Manager
and Fisheries Livelihood Development Technician as members;

e.2.) Hon. Cortes suggested deleting the Sub Section B of Section 7, The CFLC
Project Management Committee;

f) As to Section 10:

f.1.) in the first paragraph: include the statement “through the City Economic
Enterprise” after the word “fish landing facility”;

f.2.) in the second paragraph: change the term “Masbate Fish Vendor Association” to
“the existing fisherfolk organization who qualifies, after complying with all the requirements
set forth by this Ordinance, and thereafter determined by the CFLC Project Management
Committee, shall manage the operation of the CFLC”;
f.3.) It was also suggested to include a provision showing the sharing scheme
between the City Government of Masbate and the qualified fisherfolk organization after the
turn-over;

g) As to Section 12: Below are the suggestions for paragraph 1; while under paragraph 2 (iii),
change the term “ Office of the City treasury” to “City Treasurer’s Office:

h) As to Section 12: include additional provision as to volume of the fish-catch, if fish catch is
below ten (10) kilos, shall be free of charge as to fees and charges but still subject to
inspection;

V. RECOMMENDATIONS:
From the deliberation of the committee, it was hereby recommended to return the proposed ordinance
to the City Legal Officer for his comment.

VI. ADJOURNMENT:
Meeting was adjourned @ 11:45 in the morning.
