RESOLUTION EMBODYING PROVINCIAL ORDINANCE NO. 2020-220, AN


ORDINANCE IMPLEMENTING CURFEW HOURS IN THE ENTIRE PROVINCE OF
ILOILO AS A MEASURE TO ADDRESS THE CONTINUOUS THREAT OF
TRANSMISSION OF THE COVID – 19

WHEREAS, pursuant to Section 16 or the General Welfare Clause in relation to Section


467, both of the Local Government Code, The Sangguniang Panlalawigan may enact ordinances
intended to prevent and suppress vagrancy, adopt quarantine regulations to prevent the
introduction and spread of diseases, and to protect the inhabitants from the harmful effects of
Covid-19 / 2019 nCov ARD;

WHEREAS, on 07 March 2020, the World Health Organization issued a statement


reminding all countries that the spread of Coronavirus Disease 2019 (COVID-2019) can be
significantly slowed or even reversed through the implementation of robust containment and
control activities;

WHEREAS, on 10 March 2020, the World Health Organization (WHO) has considered
and declared COVID-19 / 2019 nCOV ARD as a pandemic;

WHEREAS, pursuant to Proclamation No. 522, local government units are enjoined to
mobilize necessary resources to undertake critical, urgent and appropriate response and measures
in a timely manner to curtail and eliminate the 2019 Coronavirus Acute Respiratory Disease
(COVID-19/ 2019 nCOV ARD);

WHEREAS, pursuant to Republic Act No. 11332, it is the policy of the State to protect
and promote the right to health of the people and shall endeavour to protect the people from
public health threats; and the State recognizes epidemics and other health emergencies as threats
to public health and national security which can undermine the social, economic, and political
functions of the State;

WHEREAS, on March 16, 2020, President Rodrigo Roa Duterte declared as State of
Calamity throughout the Philippines due to Corona Virus 2019 by virtue of Proclamation No.
929;

WHEREAS, as of March 17, 2020, 3:00 PM, Iloilo Province has a total of two thousand
(2000) Persons Under Monitoring (PUMs) and thirty five (35) Persons under Investigation
(PUIs) based on the reports consolidated by the Provincial Health Office;

WHEREAS, in order to protect and promote the right and health of the people, there is a
need to enforce a curfew as procedure to limit the non-essential movement of people as a
measure to counter the local transmission of COVID-19 infection in the Province of Iloilo;

NOW THEREFORE, be it ordained by the Sangguniang Panlalawigan of the Province


of Iloilo, in session assembled, that:

AN ORDINANCE IMPLEMENTING CURFEW HOURS IN THE ENTIRE PROVINCE


OF ILOILO AS A MEASURE TO ADDRESS THE CONTINUOUS THREAT OF
TRANSMISSION OF THE COVID – 19

SECTION 1. Title. This Ordinance shall be known as the "Curfew for COVID-19
Containment Ordinance of 2020".

SECTION 2. Declaration of Policy. It is hereby declared that the policy of the Province
of Iloilo is to promote and protect the health and welfare of its citizens, residents and inhabitants
against the spread or local transmission of emerging infectious diseases such as the 2019 Novel
Corona Virus Acute Respiratory Disease (COVID-19/ 2019 nCOV ARD) though the imposition
of a curfew, to restrict the non-essential movement of the people within the Province of Iloilo.

SECTION 3. Curfew. A curfew from 9:00 in the evening (9:00 PM) to 4:00 in the
morning (4:00 AM) shall be imposed in the entire Province of Iloilo commencing on 21 March
2020 at 12:01 AM.

SECTION 4. Coverage of the Curfew. Within such curfew hours no person shall be
allowed in any public place such as, but not limited, to roads and streets, parks and plazas,
commercial establishments or any building or structure catering to the general public.

SECTION 5. Exceptions. – This Ordinance shall not apply to the following:

a. Government official and employees in the performance of their official duties


and functions and those returning home from such performance of duties and
functions.

b. Medical professionals, health care providers, and those providing medical


support services, in the performance of their tasks related to their profession
or responding to an emergency and those returning home from such
performance of duties.

c. Those in the legal profession and their paralegals travelling to render legal
assistance to clients undergoing custodial investigations.

d. Those under medical emergency when travelling to a hospital or a clinic for


treatment and those responding to emergency calls.

e. Persons delivering food, medicine and drugs, essential basic necessities and
prime commodities including raw materials necessary to the production
thereof, provided only the driver and not more than two (2) helpers are in the
delivery vehicle.

f. Those employed in the private sector, reporting for work and coming home
from their place of work, provided sufficient proof is presented that their work
schedule necessitates that they travel later than 9:00 PM or earlier than 4:00
AM, as the case may be.

g. Persons transiting for travel to the airport or seaport facilities.

h. Persons providing basic services and public utilities except public transport.

SECTION 6. Implementation/Enforcement. This Ordinance shall be implemented by


the Local Chief Executives, Municipal/City Social Welfare and Development Office, members
of the Philippine National Police and Barangay Officials with their Barangay Tanods.

SECTION 7. Guidelines in Apprehension. - Offenders of this Ordinance shall be


apprehended in accordance with the following guidelines:

1. The apprehending official or officer shall, without necessary delay, accompany


the offender, immediately be brought to the barangay where he resides and
endorsed to the Punong Barangay or his authorized representatives for proper
recording. The offender shall be released upon payment of the prescribed
penalties and shall be accompanied to his residence. For purposes of this
provisions the Barangay Treasurer concerned is hereby authorized to receive
such payment and issue the corresponding official receipt.

2. In case the offender refuses or fails to pay the prescribed penalties and/or be
accompanied to his residence, the apprehending official shall seek the assistance
of the Philippine National Police (PNP) for proper arrest and detention pending
inquest proceedings;

3. For an offender who is homeless, abandoned, or neglected or have no known


family member, the apprehending official or officer shall refer the offender to the
custody of the Municipal/City Social Welfare and Development Office within
twelve (12) hours from apprehension.

4. If the offender is a minor, he shall be brought by the apprehending official or


officer to the barangay, which has jurisdiction over the minor's place of residence
for proper recording and counselling by the Barangay Council for the Protection
of Children (BCPC) before the minor is turned over or released to his parents or
guardian/s. Prior to his release, the parent or guardian shall be informed of the
consequences in the event that their minor is re-arrested for the same offenses as
provided in Section 9 (b) of this Ordinance.

SECTION 8. Prevention of Abuse. In case of abuse of authority in the enforcement of


this Ordinance, the persons referred to in Section 6 hereof shall be subject to disciplinary action
under existing laws, rules and regulations.

SECTION 9. Penalties. For violations of this Ordinance shall be punished as follows:

a. For violation of this Ordinance, the following penalties shall be imposed:

I. First Offense: Fine of One Thousand Pesos (Php 1,000.00) or


imprisonment of ten (10) days at the discretion of the Court.

II. Second Offense: Fine of Two Thousand Pesos (Php 2, 000.00) or


imprisonment of twenty (20) days at the discretion of the Court.

III. Third and Succeeding Offenses: Fine of Five Thousand Pesos (Php
5,000.00) and imprisonment of not more than one (1) month at the
discretion of the Court.

b. The parent/s of minor offenders shall be imposed the following:

I. First Offense: Warning


II. Second Offense: Fine of One Thousand Pesos ( Php 1, 000.00)
III. Third Offense: Fine of Two Thousand Pesos ( Php 2, 000.00)
IV. Succeeding Offenses: Fine of Five Thousand Pesos ( Php 5,000)

SECTION 10. Repealing Clause. All previous Ordinances, Resolutions, rules,


regulations and other issuances or parts thereof which are inconsistent with this Ordinance are
hereby revoked, amended, or modified accordingly.

SECTION 11. Effectivity Clause. This Ordinance shall take effect immediately after
publication in a news paper of general circulation.

RESOLVED FURTHER, to furnish copies of this Ordinance, the Honorable Governor


Arthur R. Defensor, Jr.; the Honorable Vice Governor Christine S. Garin; all Local Chief
Executives of component Local Government Units (LGUs); all Punong Barangays through the
Honorable Dorothy G. Paes, Liga ng mga Barangay Provincial Federation President; the Iloilo
Police Provincial Office Director, and the Offices of the Provincial Legal Officer and the
Provincial Social Welfare and Development Officer, all of the Province of Iloilo, for their
information and reference.
