AFFIDAVIT-COMPLAINT

I, ANALYN FARMA, 13 years old, Filipino, elementary graduate, native of Naval, Biliran and
presently residing at Brgy Alegria, Caibiran, Biliran after having been duly sworn to in accordance with
law hereby depose and say:

Sometimes on the year 2003, my parents Arceli Farma and Ariel Cerera separated with each other
leaving us together with my two brothers on the care of my mother, where we remained our stay in Naval,
Biliran;

After few months on September 2003, my mother Arceli met with one Rodolfo Rotairo of Brgy
Alegria, Caibiran, Biliran and lived as husband and wife, in which my mother transferred her residence
to the aforementioned place bringing with her my younger brother while I and my other brother stayed at
my grandmother in Naval, Biliran;

On the year 2008 during the summer vacation, I was fetched by my mother and convinced me to
stay with her and his present husband at Brgy Alegria, Caibiran, Biliran which I yielded to be united with
my mother and my younger brother;

I continued my studies at said place and live happily on the guardianship of my mother and my
step father in which I abide the rules set by my new father and had a common understanding with each
other within the family which made me gain trust and confidence with my respected step father;

Few months of my stay, I noticed bad behavior showed by my step father towards my mother
wherein every time he got drunk he mauled my mother, and since that my mother is afraid to retaliate
with him, their dispute will be patched up on the next day and bring back our good relationship in our
house;

Sometimes on the month of January 2009 which I cant recall the exact date at around 8:00
o:clock in the morning when my mother was outside of our house and while I was alone inside the room
of our house, my step father Rodolfo Rotairo entered the said room and suddenly hold my shoulder in
which I was standing at that time and told me not to shout and retaliate for he will kill me including my
mother and younger brother, causing me to get surprise as innocent of what was he’s doing;

At that juncture, my step father Rodolfo Rotairo laid me down to our bamboo floor and hug my
body while his other hand drew up my skirt and pulled down my underwear, then he suddenly removed
his short pants and inserted his penis to my vagina, and at that moment I told my step father to stop his
evil desire because it was so painful and instead of listening he continued molesting me, and I just cried
for I was so helpless since fear, shock and pain is what I felt on that time;

Bit after when he was already finished, he threatened me to kill if I will tell it to anybody and
commanded me to wear my underwear and just stay inside the room;

Said sexual molestation perpetrated to me by my step father happened several times specially
during the time I was alone in our house and even midnight when my mother was already fall asleep in
which he had sexual intercourse with me in standing and lying position until I was able to graduate in
grade six on March 2010;

The latest dates I experienced sexual molestation on the hands of my step father were on April 1,
2010 at around 6:00 in the morning when I was alone inside the room of our house while my mother was
cleaning our surroundings in which Rodolfo Rotairo entered the room and stayed at my back and cuddled
the part of my breasts while his other hand drew up my skirt and pulled down my underwear, then he
suddenly removed his short pants and inserted his penis to my vagina in a standing position;

On April 8, 2010 at around 6:00 o’clock in the evening when my mother went to the store and
my younger brother was also outside of our house, my step father Rodolfo Rotairo molested me once
again inside the room of our house by quickly folding up my skirt and removing my underwear and
inserted right away his penis to my vagina in standing position which he also positioned at my back, and
the same he threatened me to kill if I will shout and retaliate and when my mother arrived he was already
finished;

On April 16, 2010 at around 4:00 o’clock in the morning, he sexually molested me time and the
same manner when my mother was buying kerosene at a store and I was alone in the room of our house,
which he removed my skirt and underwear and inserted his penis to my vagina in standing position and
do the push and pull until he got finished, and same he threatened me to kill if I will tell it to anybody;

After those series of sexual molestation I experienced on the hands of my step father, I was so
bothered and scared with my step father since he doesn’t want me to get out from our house anymore, and
at that time I decided and revealed to my mother of the ordeal which happened to me , and since my
mother was afraid of the threat made by my step father on the time that somebody will learned on said
incident, my mother was hesitant to help me, but I insisted and went to Vergie Mesa a “kamadrona” in
our place and there she told me that I am already pregnant, and she further told me to stay calm for she
will be the one to make moves for me to seek justice;

The rumors spread in our Brgy, until such that on the evening of May 18, 2010, I was awakened
by PNP Personnel of Caibiran and rescued me while my step father was arrested and was detained in jail
as I insisted to the Policemen to apprehend my step father;

Upon arrival at Caibiran Police Station, I was met by Mrs. Dolores Gaviola and conducted
interview on me, and after which I was brought right away by PNP Personnel of Caibiran and Mrs.
Dolores Gaviola to the Rural Health Unit of Caibiran for medical examination and there it was confirmed
that Im already pregnant;

I executed this affidavit in the presence of Mrs. Dolores Gaviola, Municipal Social Welfare
Development Officer of this municipality;

I executed this affidavit freely and voluntary without being forced or coerced but purely to attest
the truthfulness of the foregoing statement and for my desire to file formal complaint against my step
father RODOLFO ROTAIRO of Brgy Alegria, Caibiran, Biliran, for Multiple counts of RAPE in relation
to RA 7610, or any case the Honorable Prosecutor may see fit under the law.

JOINT AFFIDAVIT OF ARREST

WE, PO3 MARIO DELAN G LEE, PO3 ANDRES V GONZAGA, PO2 FELMIN S
REGIR AND PO2 LEOPOLDO D. VIVERO all PNP member of Caibiran Police Station, both of
legal ages, married, Filipinos and residents of Brgy Palenque, Brgy Looc, Brgy Villa Vicenta all
of this municipality and Brgy Bunga, Cabucgayan, Biliran respectively, after having been duly
sworn to in accordance with law do hereby depose and state to wit;

At around 10:30 o’clock in the evening more or less of May 18, 2010 while we were at
the Police Station, a certain Lorna Fergusson a resident of Brgy Alegria, Caibiran, Biliran, a
newly elected Municipal Councilor of Caibiran reported to this office that there was a rape victim
in their Barangay identified as Analyn Farma, a minor of age perpetrated by his own step father
one Rodolfo Rotairo.

Right after, we informed Mrs. Dolores Gaviola Municipal Social Welfare Development
Officer of Caibiran who went right away to this office and requested Police Assistance to rescue
the said Analyn Farma, a minor of age at Brgy Alegria, Caibiran, Biliran who was under threat
for anytime his step father knew that victim had already informed anybody, victim might be
killed by his step father;

We immediately proceeded to the house of Rodolfo Rotairo at Brgy Alegria, Caibiran,

Biliran together with Mr. Nilo Delante, Brgy Councilor and some Brgy Tanods, and there we
called them politely and when they opened there house we look for Analyn Farma, and while
having a conversation with Analyn Farma, she cried out and requested us to apprehend his father
who at that time staying with us on the conversation, for she was raped several times by his step
father Rodolfo Rotairo which resulted her being pregnant and there after, Analyn Farma hold
tightly his step father Rodolfo Rotairo to avoid of eluding arrest who was about to escape at that
time;

At first Rodolfo Rotairo insisted not to brought Analy Farma to the custody of
CaibiranPNP, however we negotiated with him which he yielded and subsequently he submitted
himself on us and accompanied smoothly to Caibiran Police Station at around 12:00 midnight of
May 18, 2010, after informing him of his constitutional rights provided for under the constitution;

Victim Analyn Farma was subsequently brought to this office and was turned-over right
away to Mrs. Dolores Gaviola who was waiting us at Caibiran Police Station;

That we executed this affidavit freely to attest the truthfulness of the foregoing statement.

At around 10:30 o’clock in the evening more or less of May 18, 2010, a certain Lorna
Fergusson y Delante a resident of Brgy Alegria, Caibiran, Biliran, a newly elected Municipal
Councilor of Caibiran reported to this office that there was a rape victim in their Barangay
identified as Analyn Farma, a minor of age perpetrated by his own step father one Rodolfo
Rotairo. She further alleged that residents in their place requested her to report the incident to
Caibiran Police Station since victim was already pregnant, and was under threat any time his step
father knew that victim already informed anybody about his ordeal on the hands of his step father,
victim including his mother and his brother will be killed by suspect Rodolfo Rotairo. Right after,
Mrs. Dolores Gaviola Municipal Social Welfare Development Officer of Caibiran was informed
relative to said incident and requested Police Assistance to rescue the said Analyn Farma, a
minor of age at Brgy Alegria, Caibiran, Biliran who was under threat for anytime his step father
knew that victim had already informed anybody, victim might be killed by his step father. Victim
insisted to apprehend his father an even hold his step father to avoid of eluding arrest. Suspect
was brought to this office for proper disposition at around 12:00 o’clcok midnight of may 18,
2010 while victim was subsequently turned-over to DSWD of Caibiran.
