RESOLUTION NO. ____SERIES OF 2020

RESOLUTION FAVORABLY ENDORSING THE ESTABLISHMENT OF

LGU-BAYAMBANG DEVELOPMENT CORPORATION (LGU-BDC)

WHEREAS, the Local Government Unit of Bayambang intends to

establish a Government-Owned and Controlled Corporation to be named
as the LGU-Bayambang Development Corporation;

WHEREAS, Section 16, Chapter II, Book I of RA 7160 otherwise

known as the Local Government Code of 1991 provides that every local
government unit shall exercise the powers expressly granted, those
necessarily implied therefrom, as well as powers necessary, appropriate,
or incidental for its efficient and effective governance, and those which
are essential to the promotion of the general welfare. 

WHEREAS, Section 18 of the same law provides that  local

government units shall have the power and authority to establish an
organization that shall be responsible for the efficient and effective
implementation of their development plans, program objectives and priorities;
to create their own sources of revenues and to levy taxes, fees, and charges
which shall accrue exclusively for their use and disposition and which shall be
retained by them; to have a just share in national taxes which shall be
automatically and directly released to them without need of any further action;
to have an equitable share in the proceeds from the utilization and
development of the national wealth and resources within their respective
territorial jurisdictions including sharing the same with the inhabitants by way
of direct benefits; to acquire, develop, lease, encumber, alienate, or otherwise
dispose of real or personal property held by them in their proprietary capacity
and to apply their resources and assets for productive, developmental, or
welfare purposes, in the exercise or furtherance of their governmental or
proprietary powers and functions and thereby ensure their development into
self-reliant communities and active participants in the attainment of national
goals.

WHEREAS, the objective of the LGU- Bayambang Development

Corporation is the maximization of the revenue collection of LGU-
Bayambang for the enhancement of the quality of life of the local people.
Through the LGU-BDC, the expenses of the LGU for the different
infrastructure projects will be minimized as it will focus on general
construction and housing, which means that the budget meant for
construction costs may be redirected towards other social projects. This
would translate to the improvement of social services for the poorest and
most vulnerable sectors in the locality, among others.

WHEREAS, the LGU-Bayambang Development Corporation

focuses on the maximization of the available LGU properties by
converting them into enterprising activities and generation of additional

revenue for the sustainable economic development of the Municipality of

Bayambang;

WHEREAS, this august body deems it necessary to favorably

endorse the establishment of LGU-BDC to maximize the revenue
collection of LGU-Bayambang for the enhancement of the quality of life of
the local people;

NOW, THEREFORE, on motion of SBM Benjamin Francisco S. De Vera,

duly seconded, it was;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Bayan

of Bayambang, Pangasinan, in session assembled, TO FAVORABLY ENDORSE
THE ESTABLISHMENT OF LGU-BAYAMBANG DEVELOPMENT
CORPORATION (LGU-BDC);

RESOLVED FINALLY, that copies of this resolution be forwarded to the

Office of the Honorable Mayor Cezar T. Quiambao, and other offices concerned
for their information and appropriate action.
