R&R Benefits for the Affected Families—Extracts from the Jharkhand

R&R Policy 2008


SNo Policy No Condition Benefit

1 7.2 Any affected family owning a Affected family may be allotted free of cost

metre.
--If family does not want a house/Or desires
to relocate elsewhere,family shall get
financial assistance of Rs.3.00lacs.
2 7.3 Affected family below poverty House of minimum 55Sq.m carpet area in
line,which is without homestead rural areas/55 Sq.m in Urban area may be
land,which has been residing in offered in multi stored building complex.

non scheduled area; less than Stored Buildings may be constructed with

3 7.4 Affected family looses land Each affected family shall be entitled to get
1/10th of the land loses on account of account
of acquisition of land in the proposed
township or adjoining to it.

half acre.
4 7.5 Project involving land Stamp duty and other fees payable for
acquisition registration of land or house allotted to the
affected families shall be born by Requiring
body.

5 7.7 Allotted land /house to the affected
family,shall be in the joint names of the
Husband and wife.
--Monitory amount shall be distributed to a
joint account in the name of Husband and
wife.
6 7.8 If affected family displaced Shall get financial assistance of Rs.35000/-
having cattle for construction of shed.
7 7.9 Displaced family Shall get financial assistance of Rs.15000/-
for shifting the family,building materials
/belongings and cattle.
8 7.10 Affected person is a Shall get a financial assistance of Rs.50000/-
trader/having a pucca shop/stall for construction of work shed or shop.
and has been displaced
9 7.11.1(a) Affected families loosing some Requiring body shall ensure employment in
land on land acquisition due to the project at the rate of atleast one eligible
project person per nuclear family,among those
affected families.
--In providing employment,top priority shall
be accorded to those affected families who
lost all their agricultural and homestead land
--If additional employment opportunities are
available, priority shall be accorded to
displaced persons.
--Administrator shall decide priorities in
providing employment in consultation with
Gramsabha and Requiring Body.
10 7.11.1(f) In case of Nominees of Upper age limit shall be relaxed by 10Years
displaced families eligible for
employment
11 7.11.1(i) For the Purpose of employment Affected family shall nominate one member
of such family
12 7.12 Affected persons , who have not Shall be entitled to Annuity Policies---It will
provided employment or who pay Rs.1000/-Month/Acre of land lost for 30

13 7.13.1 In case of Commercial Project, 1% of the annual profit of the Project in

undertaking/ agency of State year.
Govt, Central. Affetced families shall be distributed this
Govt/Corporation/Board sum within a period of 3 months from date
of declaration of financial results.
14 7.14 Affected family involuntarily Shall get Monthly “Subsistence allowance”
displaced on acquisition of land of 25days agricultural wages/month for a
period of One year from the date of
displacement
--Affected families who donot get
employment will also given an amount equal
to 600days of agricultural wages.
15 7.15 Vulnerable Affected families Shall be paid pension for life of amount
Rs.1500/Month
16 7.16 Affected families Shall be given the option of lump sum
amount in lieu of one or more of the benefits
specified in policy.nos.7.2 to 7.18(except
No.7.13.1 and 7.15) and the amount
determined by Administrator.

17 7.17 R&R benefits to Scheduled


Tribes & Scheduled Caste

7.18.1 Involuntary displacement of 100 A Tribal Development Plan shall be

out of the district specified in policy.n.s.7.8,7.9, and 7.10
7.18.8 Affected ST/SC/Other forest Who are in a possession of forest lands in
dweller families affected area prior to the 13th day of
December, 2005 shall also be eligible for
R&R Benefits under the policy.
18 7.19 Amenities and Infrastructure
Facilities to be provided at
Resettlement Areas:
7.19.1 In case of Involuntery A comprehensive infrastructure facilities and

displacement of 100 or more amenities notified by the appropriate Govt.
shall be provided in the Resettlement Areas.
Such facilities and amenities shall include—
Roads,public transport,drainage,
sanitation,drinking water,drinking water for
cattle,community ponds, grazing land, land
for fodder, plantation(social or agro forestry)
, public utilities such as post offices,fair
price shops..etc., Food storage Godowns,
panchayatghars, Cooperative societies, Seed
cum fertilizer storage, irrigation, electricity
supply,health care facilities,child and mother
supplemental nutritional services,Children
play ground parks, community
centers,schools and educational/training
facilities,places of worship, land for
traditional tribal institutions, service
land,burial/cremation grounds and security
arrangements.
7.19.2 In case of less than 100 families Affected families shall be provided basic
infrastructure facilities and amities asper the
norms specified by State Govt.
Mandatory is that provision of Drinking
water, electricity,schools,dispensaries and
access to Resettlement site ., etc.are
provided.
19 7.21 In Case of Project involving Requiring body shall be responsible for
land acquisition development of Geographical area within 15
KM from the periphery of the project site.
--Required to contribute socio economic
development of the areas, for this purpose ,
requiring body will earmark a minimum of
1% of net profit of the project, if no profit of
the Project is declared by the requiring body
for that year, such minimum amount as may
be determined by the State Govt. to be spent
in the specified Zone.
--Requiring body will carry out the
developmental activity within this zone in
close coordination with the Commissioner
for R&R and concerned Gram Sabha.
20 8.1.1 Project involves involuntary Grievance Redressal mechanism:
displacement of 100 or more R&R Committee at Project Level:

the chairpersonship of Administrator R&R
or an officer not below rank of Sub

divisional magistrate, and it is called as
R&R Committee
--It shall monitor and review the progress of
implementation of scheme or plan of R&R
and carry out post implementation social
audits.
21 8.2 R&R Committee at District level:
State Govt. shall constitute Standing R&R
Committee at District level under the
chairpersonship of DC of the district to
monitor and review the progress of
implementation of scheme or plan of R&R.
excluding those covered by Project level
committee.
22 8.3 Tribunal:
Three member Tribunal shall be appointed
by State Govt. for time bound disposal of
Grievances arising of matters covered by the
R&R policy.
23 9.1 Monitoring Mechanism:
Sate level Council on Resettlement and
Rehabilitation(SLCRR):
State level council on R&R will be
constituted under the chairmanship of Chief
minister.
There shall be monitoring committee to be
chaired by Development Commissioner for
reviewing and monitoring the progress of
implementation of R&R Schemerelating to
all Projects to which R&R Policy applies.

24 9.4 Department of Revenue and Land Reforms ,


Government of Jharkhand will be Nodal
Department for the State Govt, for the
purpose of implementation of and execution
of R&R Policy.
