RESOLUTION

This resolves the Motion for Reconsideration (MR) filed by PO1 Eduardo G
Ofrecio (Movant), assailing the dropped from the rolls (DFR) order issued severing
his employment effective September 27, 2013 as published under ORPHRDD
Special Orders No. 1310 dated October 2, 2013.

Records show that movant while assigned with the Tarlac City Police Office,
Tarlac PPO, failed to report for duty from July 26, 2013 up to the date he was DFR
without valid and justifiable reason. Four (4) radiographic messages dated August 4,
8, 12 & 27, 2013 were sent to him at his given address directing him to report for
duty but still failed to report. Such acts clearly show that subject PNCO intended to
discontinue his service as a police officer. Thus, he was subsequently DFR. Hence,
this MR raising the following grounds:

“I. Movant should be considered on automatic leave of absence as he is


suffering from sickness
II. The dropping from the rolls is excessive and does not commensurate to the
charges against him
III. The dropping from the rolls is not valid as movant was denied
administrative due process of law.”

This Office finds that the MR is not meritorious. It does not raise valid ground
to warrant the reconsideration of the DFR order sought to be reconsidered, aside
from the fact that it was filed outside the reglementary period.

Section 9, of NAPOLCOM Memorandum Circular No. 2010-001 amending


NMC 95-017 provides that: “Filing of Motion for Reconsideration- within fifteen (15)
days from the receipt of the Order of Dropped from the Rolls, the concerned PNP
member may file a Motion for Reconsideration with the authority who issued the
Order, which shall be resolved within the same period.”

Movant was DFR on September 27, 2013 but he only filed his MR on May 17,
2018, or after the lapse of more than 4 years. The DFR order therefore has long
attained finality.
WHEREFORE, foregoing premises considered, the motion for reconsideration
filed by PO1 Eduardo G Ofrecio, is hereby DENIED FOR LACK OF MERIT.

SO RESOLVED.
