Refundable. THIS AGREEMENT IS NULL AND VOID IF FUNDS ARE NOT

5. HOLD HARMLESS: ASSIGNOR shall not be held responsible for the performance
of the ASSIGNEE, and shall further be held harmless and be released from all liability
for any other circumstances arising from or in connection with the subject property or the
“OPTION TO PURCHASE” Agreement.
