citizens, and a residents of Brgy. Doῆa Brigida, Tolosa, Leyte, after having
been duly sworn to in accordance with the law do hereby depose and say:

1. That we are the defendants in the above-entitled case;

2. That we have caused the preparation of the foregoing answer and

have read the allegations contained therein;

3. That the allegations in the said answer are true and correct of our
own knowledge and authentic records;

4. That we have not commenced any other action involving same

issues in any court, tribunal or quasi-judicial agency and, to the best
of our knowledge, no such other action or claim is pending therein,
except the Petition filed by Lydia Casilan represented by defendant
Elizabeth Eracho ,IN RE: Petition for Cancellation of Certificate of
Land Ownership Award (CLOA) No. 000835333 with Original
Certificate of Title (OCT) No. OC- 13683 with Case No. 0801-0080-
2012 (CANC CASE No. 10-11-0195) before DAR- Central Office ;

5. That if we should learn thereafter that a similar action or proceeding

has been filed or is pending, We hereby undertake to report that fact
within five (5) days therefrom to the court or agency where the
original pleading and sworn certification contemplated therein have
been filed;
