LEASE

KNOW ALL BY MEN THESE PRESENTS:

THIS CONTRACT OF LEASE executed and entered into Pasig City on _______,
20____ at AM/PM, by and between:

RIZALDY V. HINAJON and NENITA G. HINAJON, both of legal age,


married, Filipino, residing at Blk.1, Lot 15, Medina Street, Amel
Subdivision, Brgy. Sta. Lucia, Pasig City, Metro Manila, Philippines, herein
after referred to as “LESSOR”.

____________________ Philippines, herein after referred to as “LESSEE”.

WITNESSETH: THAT

WHEREAS, THE LESSOR is the registered owner of a certain parcel of land and
its improvement thereon locates at Blk.1, Lot 15, Medina Street, Amel Subdivision, Brgy.
Sta. Lucia, Pasig City, Metro Manila.

WHEREAS the LESSOR desires to lease an APPARMENT UNIT, particularly


UNIT #____ constructed on the above mentioned land:

NOW THEREFORE, for and consideration of foregoing premises and stipulators,


the LESSOR hereby lets, and ease unto the LESSEE, and the latter hereby accepts to
lease form the former the above described property under the following terms and
conditions;

1. PERIOD AND RENTAL, the period is twelve months from October 16, 2020 to
March 15, 2020 subject to extension upon written agreement of the partners.
During which period the LESSEE binds himself/herself to pay the LESSOR or their
REPRESENTATIVE, a monthly rental of ____________ THOUSAND PESOS
(_________.00) to be paid in Philippine Currency, the said amount to be due
and payable in advance in every 1st of the month without need of demand.
FAILURE TO PAY the stipulated rent results in surcharges of 10% will implement
after 3rd day if the month of delay.

1a. ONLY FIVE (5) occupants of the leased unit is allowed to stay.

1b. NO guest of the Tenants may occupy the property for longer that ONE (1)
week without prior written consent of the Landlord/Landlady. LESSEE will be
charged ONE THOUSAND PESOS (P1,000.00) per month per unauthorized
occupant. And said occupant(s) can only stay for the maximum of three (3)
months otherwise the LESSEE is violation of the rental agreement. A
reminder/notice will be this agreement that may result in immediate termination
of the rental agreement and tenancy. Notice of termination will be served once.

1c. PARKING: Only the 1st floor tenants has designated one (1) parking space.
If the LESSEE has car(s), must follow the Rules and Regulations of the said
Subdivision.

1d. NO PETS OR ANIMALS of any kind and size is allowed. If unauthorized


pet/animal is found in the property, LESSEE will be in violation of the rental
agreement and this will constitute a material non-compliance with this
agreement that may result in early/immediate termination of the rental
agreement and tenancy. Notice of termination will be served once.

1e. HOMEOWNERS ASSOCITION FEE: The LESSEE will be responsible in


paying HA per said subdivision rate amount. All occupants are expected and
obliged to follow Rules and Regulation of the said Subdivision.

1f. ROOFTOP: The rooftop is not included in the monthly rent. It is the private
premise of the owner and neither for the tenants nor public use. If LESSEE wants
to avail the rooftop for small family gatherings like birthdays, anniversaries etc,
etc, not to exceed fifty (50) people; at least one week notice to the
owner/landlord/landlady is required and is subject for approval and availability
and has the right to refuse the request. The OWNER/LANDLORD/LANDLADY is
not responsible for any accidents of any kind, violations and unlawful acts by any
of the lessee’s guest(s).

A cleaning fee of five hundred (P500.00) pesos is required to pay upfront on


approval. Complete refund if cancelled 24hours before the approved event.

A water and electricity deposit of one thousand (P1,000.00) pesos is required


upfront on approval. Complete refund if cancelled 24hours before the approved
event.

Partying is only allowed till 10PM and no excessive noise/music (per HA’s rules
and regulations). Owner has the right to require all the names of the guest(s)
with valid ID’s upon entering the premise.
Serving wines, liquors, beers or any alcoholic drinks are all responsibility of the
LESSEE.

NO DRUGS/PROHIBITED SUBSTANCE OF ANYKIND is allowed during the


event. If any suspicion(s) arises due to intoxication or use of drugs/prohibited
substance, the owner/landlord/landlady has the right to stop the event and do
necessary action.

1g. TRASH AND LAUNDRY: it is not allowed to hang any kind of the laundry in
front of the unit(s) and the premise. Only in the designated laundry area of the
unit is allowed. The owner/landlord/landlady has the right to remove any kind of
laundry hanging in front of the premise without prior notice of the LESSEE. The
Lessor is not responsible for any damage(s) and loss that may occur during the
removal of the laundry.

LESSEE is responsible for the proper disposal of trash. NO UNCOVERED


TRASH is allowed. NO trash can is allowed outside the door of each unit.

1h. NO EXTRA FURNITURES is allowed in the hallway.


LESSOR/landlord/landlady has the right to move out any furniture found in the
hallway and also not responsible for any damages/loss.

1i. RENEWAL. The LEASE CONTRACT may be renewed provided neither party
has objection and only upon express written agreement between the parties.
Upon renewal, the LESSEE agrees to a yearly of 5% or inflation rate of the
immediate past year, whichever is higher.

1j. NON-PAYMENT OF RENTAL: if the rental herein stipulated shall be in


arrears or unpaid for a period of one (1) month, this lease contract shall be
automatically terminated and cancelled the said premise shall be vacated
peacefully by the LESSSEE for the LESSOR to take over possession thereof. In
this event it shall be lawful for the latter or their duly authorized representative
to enter into the leased premises, without prejudice on the part of the LESSOR to
exercise any or all rights arising from this contract and those granted by law.

2. USE AND PURPOSE: The LESSEE and his/her family shall use the leased
premises exclusively for residential purposes and would be limited to FIVE (5)
occupants (as stated in 1a ) declared by the LESSEE prior to signing of this
contract. NAMES and ID’s are required for the other four (4) occupants (as
stated in 2a) are not allowed without prior permission from and consent of the
LESSOR.

3. RIGHTS OF LESSEE NON-TRANSFERABLE. The LESSEE shall not directly or
indirectly sublease, assign or transfer rights of lease over the premises, or any
portion thereof under any circumstances whatsoever, an any such contract made
in violation of this clause, shall be null and void and be ground for the immediate
termination of the CONTRACT OF LEASE plus fine equivalent to one and a half (1
½ ) month rental at the time of the violation.

4. REPAIR AND IMPROVEMENTS: It is expressly agreed and understood that


the LESSSEE shall not commence or proceed with any repair work on any case
introduce improvements or alteration without prior notice and express agreement
of the LESSOR. It is further agreed that all such approved improvements or
alteration(s), of whatever nature, shall form an integral part of the leased
premises and shall belong to and become the exclusive property of the LESSOR
upon termination of the lease without need of reimbursement of the cost
thereof.
No applying of adhesive materials or inserting nails or hooks in walls.
No painting, wallpapering, redecorating or performing any structural alterations.
No removing or adding walls.
No alteration on electrical or exposing any electrical wiring, exposing cable wires
allowed.

ONLY experienced person is allowed to do the job with approval of the LESSOR.
The LESSEE is responsible for any labor material cost.

5. FIRE HAZARDS: The LESSEE shall not bring or store in the lease premises any
article or thing of a dangerous , flammable or explosive character that might
unreasonably increase the danger or fire on the Property or that might be
considered hazardous the property and tenants. The LESSOR is not responsible
for any injuries, accidents, or eve n death.

6. DEPOSIT REQUIREMENT: The LESSEE is required to pay the LESSOR upon


signing of this contract, a TWO (2) months deposit of _______________
THOUSAND Pesos (P___________. 00) and advance rental of one month rent of

THOUSAND Pesos (P___________. 00). The deposit shall be used to pay for
damages other than ordinary wear and tear, other expenses and charges billed
against the LESSEE for utilities, telephone/cable, garbage or back rents if
applicable.

7. In the event that the LESSEE for any reason(s) would rescind this contract, the
LESSOR SHALL RETAIN FIVE THOUSAND Pesos (P5,000.00) as
remuneration for lost opportunity.

8. VIOLATION OR INFRINGEMENT OF CONDITION: In case of violation or


infringement of any of the forgoing terms and conditions, the LESSOR reserves
the right to TERMINATE MEDIATELY this leas and the LESSEE agrees to vacate
forthwith the premises without need of court proceedings. If however, for any
valid reason, it shall become necessary for the LESSOR to institute appropriate
court action, for the reinforcement of their rights under this contract, the
LESSSEE shall be liable in liquidated damages, for in lieu of attorney’s fees and
cost of the suit, the sum of no less than FIFTY THOUSAND PESOS (P50,000.00).

9. IN THE EVENT TO SELL THE RENTAL PROPERTY; hereby expressed that, in


the event the LESSOR sells the rental property; the new owner HONORS the
tenant leas and lets the tenant live in the property until the lease is up. A one
month notice to LESSEE will be given prior to signing of new ownership/
