Alejandro S. Buñag vs Raul T. Tomanan

FACTS:

Alejandro Buñag filed an administrative complaint against Raul Tomanan of RTC Branch
94, for allegedly sexually harassing the former’s wife.

Spouses Buñag claims that Tomanan kissed Ivie Buñag’s hair twice while in a drinking
session. In spite of their marital status and Ivie’s resistance, Tomanan kept on harassing the
woman. Tomanan, however, denied the allegations made against him.

ISSUES:

Whether or not Raul Tomanan is guilty of sexual harassment.

RULING:

Yes, Raul Tomanan is guilty of sexual harassment.

Section 3 of the Court’s Administrative Matter No. 03-03-13-SC regarding the Rule on
Administrative Procedure in Sexual Harassment Cases and Guidelines on Proper Work Decorum
in the Judiciary defines work-related sexual harassment as those committed by an official or
employee in the Judiciary who, having authority, influence or moral ascendancy over another in
a work environment, demands, requests or otherwise requires any sexual favor from the other,
regardless of whether the demand, request or requirement for submission is accepted by the
latter.

Further, Section 53 of the CSC Resolution No. 01-0940 classifies sexual harassment into
three (3): grave, less grave, and light grave. Raul’s act of kissing Ivie’s hair qualifies as unwanted
touching, a less grave offense under the said Resolution.
