AFFIDAVIT

I, ELMER L. TABINGO, of legal age, Filipino, married and a resident of

Purok 15, Poblacion, Compostela, Davao de Oro, Philippines, after having been
duly sworn to in accordance with the law, do hereby depose and say THAT:

1. I am the son of the late Mrs. Lourdes S. Tabingo, who is the permittee of the
Industrial Sand and Gravel holding permit number __________ located at
Brgy. San Jose, Compostela, Davao de Oro;

2. Mr. Sanelo D. Oclarita is my agent who is responsible in processing every

permit, hence, being my agent, I requested him to process the permit of the
Industrial Sand and Gravel Permit at the Provincial Environment and Natural
Resources Office - PLGU;

3. To process the permit, Mr. Sanelo D. Oclarita received an amount of

P55,700.00 bearing check number 66488 dated May 30, 2020;

4. I received the alleged approved permit from Mr. Sanelo D. Oclarita

containing the signatures of Ma’am Virgilla S. Allones and Governor Jayvee
Tyron L. Uy;

5. One of the permits to be processed by Mr. Sanelo D. Oclarita is the quarry

permit located in the Province of Mabini, upon inquiry as to the status of my
permit application, they informed me that there is no permit application
under my name;

6. Upon learning that there is no application under my name, I immediately

assigned my secretary Mrs. Erica Marie U. Dalida to inquire in the Provincial
Environment and Natural Resources Office - PLGU as to the authenticity of
the permit given to me by my agent Mr. Sanelo D. Oclarita;

7. Upon her inquiry, my secretary Mrs. Erica Marie U. Dalida informed me that
there is no Industrial Sand and Gravel Permit recorded or registered and
approved by the Provincial Environment and Natural Resources Office - PLGU
under my name and that the province does not even issue extension permit;

8. I am executing this affidavit to attest to the truth of all the foregoing

declarations.
