Subject: Offer of sum of money to buy a property

Dear Ms. JUST:

Greetings!

Further to your non-acceptance of our Donation, which you received on 25, 2020, and in accordance
with Republic Act No0752, otherwise known as “The -Way Act” of 2016, the OTr, on behalf of the,
hereby offers to buy the Affected Property described below in the amount of FOUR HUNDRED
THIRTEEN THOUSAND FOUR HUNDRED (413,400.00) (“Offered Amount”):

It is noted that the above Offered Amount is based on the Current Market Value of Land as
determined by the ICH Property Appraisal Inc, pursuant to the Act of 2016.

In case the above Offered Amount is acceptable, kindly send us your Reply Letter indicating
acceptance (following the attached template) together with the documents below within thirty
(30) calendar days from your receipt of this Offer, so we can proceed with processing your
payment pursuant to the procedures and timelines. Please submit the following documents:

1. Two (2) valid Government-issued identification cards;


2. BIRD Tax Identification Number (TIN);
3. Certified True Copy from the Assessor’s Office of the concerned Local Government
Unit (LGU) of latest Tax Declaration for Land;
4. Certified True Copy from the Assessor’s Office of the concerned LGU of latest Tax
Declaration for Improvements or a Certificate of Non-Improvement, whichever is
applicable;
5. Certified True Copy from the Treasurer’s Office of the concerned LGU of Real
Property Tax (RPT) Clearance for Land, and if applicable, for Structures and
Improvements;
6. Special Power of Attorney (SPA), if applicable;
7. Photocopy of Owner’s Duplicate Copy of Land Title, which may be any of the
following: (a) Original Certificate of Title (OCT); (b) Transfer Certificate of Title
(TCT); (c) Emancipation Patent (EP); (d) Certificate of Land Ownership Award
(CLOA); or (e) Certificate of Ancestral Domain Title (CADT);
8. Certified True Copy of Land Title from the Registry of Deeds, which may be any of
the following: (a) OCT; (b) TCT; (c) EP; (d) CLOA; or (e) CADT; (Please ensure that
the Certified True Copy shows a Land Registration Authority (LRA) bar code at the
bottom left corner.);
9. If applicable, two (2) valid Government-issued identification cards of the Designated
Signatory to the Deed of Sale in the SPA; and
10. In case where Structures and Improvements are not owned by the Land Owner: (a)
Declaration from the Land Owner on who is the owner of the Structures and
Improvements (following the attached template); and (b) Waiver from the Landowner
of rights over the Structures and Improvements (following the attached template).
11. Extra-Judicial Settlement of Estate, if owner is deceased with surviving heirs;
12. Certification of publication of Extra-Judicial Settlement of Estate, if applicable.

For corporations, please submit the following additional documents:

1. Original Notarized Corporate Secretary’s Certificate attesting to the due adoption of a


Board Resolution designating the Corporation’s Authorized Representative and
his/her/their authority to act on behalf of the Corporation for any purpose in relation
to the Affected Property, including disposition thereto; and
2. Two (2) valid Government-issued identification cards of the Authorized
Representative.
3. Certified True Copy from the Securities and Exchange Commission (SEC) of the
Corporation’s SEC Certificate of Registration;
4. Certified True Copy from the SEC of the latest General Information Sheet (GIS) of
the Corporation;

In case any of the above documents have already been submitted, you may submit a copy of the
Acknowledgment Receipt/s (Documents Requested in Notice of Taking) that the Dr has previously
issued for your earlier submission/s.

In case the above Offered Amount is not acceptable, kindly let us know by sending your Reply
Letter indicating non-acceptance (following the attached template), in which case, DOr may
initiate expropriation proceedings pursuant to Section 6 of the Way Act of 2016.

Please note that if we do not receive your duly signed Reply Letter (following the attached
template) within thirty (30) calendar days from your receipt of this Offer, your failure to respond
shall be deemed as non-acceptance of this Offer, pursuant to Section 5 of the Way Act of 2016.
