Subject: Discussion to resolve 10% L.D (Delivery Charges) against P.O #32 / CEO / CPGCL /
MMM / PM-III (MGT) / ICB / T-24 / 5983-90

Dear Sir,

As per meeting with CEO, GENCO II, TPS, Guddu, Pakistan with Mr. David Moir (Sales Manager MJBI) and
our team from Ahmed Jaffer & Company Private Limited, we would request GENCO to review the facts
presented below and request to remove or reduce the penalty deducted on this subject order.

As per the letter of credit, the last shipment date for this order was 17/11/2014. Since MJBI was short of
1 item, we requested GENCO on 23 rd September and 16th November 2014 to allow partial shipment but
did not receive any response.

We received the amended LC after 3 months on 22/01/2015 with last shipment date of 16/02/2015. On
the day of shipment, GENCO decided to change the mode of shipment from LCL to full container load.
Due to this request from GENCO, the cargo could not be loaded as the bookings made by GENCO’s
nominated forwarder was for LCL shipment and this could not be changed to FCL shipment on the same
vessel. The next available vessel for shipment was on 18 th Feb 2015, which was 2 days after the last
shipment date on the LC. We subsequently received an amended on 27/04/2015 and the material was
shipped to GENCO.

We have requested to GENCO to remove or reduce the penalty as we had no control over the LC
extension process nor should we held liable for penalty because of the decision taken by GENCO to
change the mode of shipment on the last date of shipment.

We kindly request you Sir, to resolve the penalty issue.
