Cash Bail Guide If Case Is Not Yet Filed in Court
PART 1
1)Accused must first file a Petition to Post Bail. Docket the petition. We
will start at SP. Proc. No. 2020- 0076.
2)At the bottom portion of the Petition there must be a written “NO-
OBJECTION” from the Prosecutor. If none, instruct the bondsperson
to go back to the concerned Prosecution Office and have the non-
objection signed by the prosecutor.

7)Once the Order granting the Petition is duly signed by the EJ, give
one copy of the Order to the bondsperson along with the checklist of
requirements.
2) Once complete, you may now collect the amount of the bond and
other fees:
3) Once again, you need to fill out another Legal Fees form for the
aforementioned amounts.
5) After payment, give the Petition back to the Assistant of the Day,
who will in turn draft the Bail Bond Undertaking and Release Order.
6) Once signed, give first all copies of the Bail Bond Undertaking to
the bondsperson. Instruct bondsperson to deliver the Bail Bond
Undertaking to the accused and have him sign on the spaces
provided. The bondsperson must also sign.
9) Only the Bail Bond Undertaking and the Release Order are given to
the bondsperson, everything else must remain with us.
But, WE MUST NEVER give the Release Order to the bondsperson if wala
pa nakabalik and Bail Bond Undertaking with the signatures of both
bondsperson and accused.
