Tutorial Question 1 (classification of law)

1. Define the word law


 the system of rules which a particular country or community recognizes as regulating
the actions of its members and which it may enforce by the imposition of penalties.
 The law is a system of rules that a society or government develops in order to deal
with crime, business agreements, and social relationships

2. Law may be classified into public law, international law and private law. What is private
law.
The third broad division of law is private law. Private law is concerned with matters that
affect the rights and duties of individuals amongst themselves. Basically, private or civil law
is intended to give compensation to person injured. To enable property to be recovered
from wrongdoer , and to enforce obligations contract and trust.

3. Explain what private law is


 Refer as civil law defines the rights and responsibilities of individuals and regulates
private disputes where one party’s rights have been infringed. (ie. Breached)
 Individuals refer company , organizations, group, people

4. Write short notes on the three main components of private law.

Private law can classified in to 3 categories which are contract , trust and tort.

Contract Law

 The branch of law that provides rules regarding agreements between people and businesses

• Deals with the every day transactions in which people purchase or provide goods and services

 If one party does not uphold the terms of the agreement, the other may seek the assistance
of the court to ensure that the terms are enforced

Tort
“Woman seeks $1.5 million for damages after being burned by hot coffee” .This headline
described demands for large amounts of money to compensate for harm, pain, suffering, or
financial loss cause by the careless actions of others. Tort Law is the branch of private (civil
law) that holds a person or private organizations responsible for damage they cause another
person as a result of an accidental or deliberate action. Private Law Tort Law. People now do
whatever they can to avoid being held responsible for accidental injuries.

Trust
A relationship where a person (trustee) holds property for which it has control over the trust
property for the benefit of others ( beneficiaries).
The person who initially transfers property to a trust and set out its terms is referred to as
the settlor. Typically, the settlors enter into an agreement with a trustee to hold the trust
property for the benefit of the beneficiaries on certain terms. The agreement is often
referred to as a trust agreement or trust deed.
