UPON hearing the counsel the Court made the following


O R D E R

Application for permission to file special leave petitions

without certified copy and with a noted copy of the impugned order

is allowed..

These special leave petitions have been filed against an

interim order dated 05.03.2020 passed in RFA(OS) No.21 of 2020 and

RFA(OS) No.22/2020. The next date fixed by the Hight Court is

27.03.2020.

Learned counsel for the petitioner submits that the dates have

been fixed to take emergency measures before foreign seated

arbitrator and after suit was dismissed by learned Single Judge,

Division Bench passed the interim order, but the petitioner could

not get opportunity to place his submissions although he was on

caveat. He submits that matter needs urgent hearing.

We are of the view that High Court having already fixed the

matter on 27.03.2020, it is open for the petitioner to make a

request to the High Court for preponement of the date. We have been

informed that the High Court is reopening on 11.03.2020. It shall

be open for the petitioner to make a request on the reopening day

for preponement of the date. It is, however, for the High Court to

take appropriate decision in the above regard.

With these observations, the special leave petitions are

dismissed.
