JOINT AFFIDAVIT OF ARREST

We, Intelligence Officer (IO) 1 Albert Orellan, IO1 Nestle Carin, and IO2 Vincent
Orcales both agents of the Philippine Drug Enforcement Agency, Regional Office X,
having been duly sworn do solemnly states THAT:
1. We are among the members of the Philippine Drug Enforcement Agency (PDEA)
directed by our Regional Director, Lt. Col. Edwin Layese, who conducted a buy-
bust operation together with the arresting officer, backup, evidence custodian,
and the poseur-buyer;

2. Said operation stemmed from the report of a confidential informant that a


certain “Romy” has been engaged in the sale of prohibited drugs in violation of
Comprehensive Dangerous Drugs Act of 2002 (R.A.9165);

3. Upon the receipt of the said report, our team planned out a buy-bust operation
against the Romy Lim y Miranda, of legal age, Filipino, a residents of Zone 7,
Cabina, Bonbon, Cagayan De Oro City, Philippines, that on or about 10:00 o’clock
in the evening of October 19, 2010, the undersigned together with the CI
proceeded in the said area;

4. Upon arrival thereat, our team positioned in the area to observe. Where the
undersigned and the CI turned at the corner and stopped in front of the house
and knocked at the door. Gorres came out and invited them to enter, where Lim
was sitting on the sofa while watching the television. The CI introduced IO1 Carin
as a shabu buyer and Lim nodded and told Gorres to get one inside the bedroom.
After Gorres came out, he handed a small medicine box to Lim, who then took
one piece of heat-sealed transparent plastic of shabu and gave it to IO1 Carin. In
turn, IO1 Carin paid an amount of 500 php as the buy-bust money with serial
number of FZ386932.;

5. After examining the plastic sachet, the undersigned, with the rest of the team
members, immediately rushed to Lim’s house then entered the house because the
gate was opened and IO1 Orellan declared that they are PDEA agents and
informed Lim and Gorres. They were ordered to put their hands on their head and
to squat on the floor while IO1 Orellan recited the Miranda Rights to them.
Thereafter, IO1 Orellan conducted a body search on both accused;

6. Seized and recovered in the possession and control of the arrested person were
the following, to wit:
a. Buy-bust money amounting of Php 500 with a serial number of
FZ386932;
b. Transparent rectangular plastic box about 3x4 inches in size with plastic
sachet of white substance;
c. A disposable lighter;
d. Heat-sealed transparent plastic containing Methamphetamine
hydrochloride (total weight of 0.02 grams).

7. Suspects together with the seized and recover evidence was brought to the PDEA
Regional office for booking and proper disposition. Likewise, the arrested persons
were apprised of their rights as provided for under the Constitution of the
Philippines.

8. The report of the Regional Crime Laboratory 10, Chemistry Report No. DTCRIM-
196 and 197-2010, the result shown that only Lim was found “POSITIVE” for the
presence of Methamphetamine hydrochloride and indicated that Gorres was
“NEGATIVE” of the presence of any illicit drug based on his urine sample.
We executed this joint affidavit to attest the truthfulness of the foregoing facts and
to support the filing of the Criminal Cases against Romy Lim y Miranda, together with his
stepson Eldie Gorres y Nave (Gorres) for the violations of Comprehensive Dangerous
Drugs Act of 2002 (R.A. 9165).

FINDINGS:

Screening tests conducted on the above-stated specimens gave the following


results:
1. Specimens DTC-196-2010 – POSITIVE for the presence of Methamphetamine
metabolites, dangerous drugs.
2. Specimens DTC-197-2010 – NEGATIVE for the presence of Methamphetamine
metabolites, dangerous drugs.

REMARKS:

1. This laboratory result is based on the condition of the subject/s at the time of
examination
2. Specimens which are negative to the screening tests for the presence of dangerous
drugs are no longer subjected to confirmatory tests.
3. The original copy of this report is retained in this laboratory for future reference.
