Registration of a Trademark:

1. Procedure and Time Frame:

Upon filing of a trademark application, the Trademarks Registry, India (TMR)

the Application is examined by the TMR and the examination report is issued.
If there is any identical or similar mark registered or pending, the Trademarks
Registry will ask to file reply within the time frame of 30 days. In case the
TMR is not satisfied by the reply, the matter is listed for hearing. The
objections, if any are satisfactorily resolved then the application is accepted by
the Registry and is published for opposition by the third party/public. There is
a 4-month period from the date of publication during which any interested
party may file an opposition.

2. Multi-Class System is available in India.

3. Period of the Validity of Registration:

The trademark in India is registered for ten years and is renewable for a term
of ten years each. The beginning of the term is calculated from the Application
date.

4. Information/Documents required for registration of a

Trademarks/Service marks:

a. A simply signed and stamped Power of Attorney from the Applicant.

b. Representations of the trademark for each class in jpg. format (a

depiction of the mark an applicant seeks to register). The meaning of
the mark if any.

 c. List of goods or services and class or classes according to the
International Classification of Goods and Services (Nice
Classification).

d. Date of first use of the mark in India, if any, or whether it is intended

to be used.

e. Full name, address, nationality and postal code of the Applicant in

English.

f. Priority can be claimed within six months of the application filed in

Convention Country.

5. Flow Chart in case of Straight Application:

a. Filing is followed by Preliminary Acceptance (1 month).

b. Preliminary Acceptance is followed by the Substantive Examination

(up to 1 month).

c. Examination report is issued for filing the reply (1 month).

d. Show cause hearing (5-9 months).

e. Acceptance is followed by the Publication (4 months).

f. Publication is followed by the issuance of the Registration Certificate

(2 to 4 months). Total: 5 to 6 months in smooth /straight
registration

6. Costs: For Single Trademark Application in Single Class:
