TO PROVIDE FOR COFFEE MARKETING
የሚኒስትሮች ምክር ቤት ደንብ AND QUALITY CONTROL
የሚኒስትሮች ምክር ቤት የኢትዮጵያ ፌደራላዊ This Regulation is issued by the council of
ዲሞክራሲያዊ ሪፐብሊክ አስፈጻሚ አካላት ስልጣንና ministers pursuant to Article 5 the definition of the

(፩) መሠረት ይህን ደንብ አውጥቷል፡፡

ክፍል አንድ
SECTION ONE
ጠቅላላ GENERAL
፩. አጭር ርዕስ 1. Short Title
This Regulation may be cited as “the Coffee

2. Definitions
፪. ትርጓሜ
In this Regulation, unless the context requires
የቃሉ አገባብ ሌላ ትርጓሜ የሚያሰጠው ካልሆነ
otherwise:
በስተቀር በዚህ ደንብ ውስጥ:-
1/ "Proclamation" means coffee Marketing and
፩/ ‘‘አዋጅ’’ ማለት የቡና ግብይትና ጥራት
Quality Control Proclamation No.1051/ 2017;

፪/ ‘‘የቡና ክምችት ሚዛን’’ ማለት ማንኛውም 2/ ‘‘Coffee stock balance’’ means a result
በቡና ማምረት ወይም በንግድ ሥራ obtained by calculating carry over coffee
የተሠማራ ሰው ያመረተውን ወይም የገዛውን stock available in the warehouse and coffee
produced, purchased or processed and
ቡና በማዘጋጀት ለገበያ ያቀረበውን እና
supplied to the market by any person who
በመጋዘን ሊገኝ የሚገባው ቀሪ ክምችት
engages in coffee production or marketing;
ተሰልቶ የሚገኝ ውጤት ነው፤
፫/ “የቡና ናሙና’’ ማለት ማንኛውም ቡና በሀገር 3/ "Coffee Sample" means representative
ውስጥ ግብይት እንዲካሄድበት ወይም ወደ ውጭ

coffee for determining the type and quality
standard of any coffee before domestic
ከመላኩ በፊት የቡናውን ዓይነትና የጥራት
marketing or export;
ደረጃ ለመወሰን የሚወሰድ ወካይ ቡና ነው፤
፬/ "ጥብቅ የቡና መጋዘን’’ ማለት ባለሥልጣኑ 4/ “Bonded Coffee Warehouse” means a
በሚሰጠው ፈቃድ መሠረት የውጭ ቡና secured warehouse, where foreign coffee
ገዢዎች የገዙትን ወጪ ቡና በሀገር ውስጥ buyers, hoard with permission of the

Authority, a purchased export coffee for
ተረክበው ለተወሰነ ጊዜ የሚያቆዩበት ደህንነቱ
limited time;
የተጠበቀ መጋዘን ነው፤
፭/ "የቡና ምርት ዘመን" ማለት የቡና ምርት 5/ "Coffee Production Season” means one year
ከተሰበሰበበት ጊዜ ጀምሮ የአንድ ዓመት ጊዜ period starting from coffee harvesting time;
ነው፤
፮/ "የቡና ምርት ግብይት ዘመን" ማለት በተለየ 6/ "Coffee Marketing Period" means one year
ሁኔታ በባለሥልጣኑ ካልተራዘመ በስተቀር period of coffee marketing starting from
የቡና ምርት ከተሰበሰበበት ጊዜ ጀምሮ coffee harvesting time, unless extended by
የአንድ ዓመት የግብይት ጊዜ ነው፤ the Authority in special condition;
፯/ "የአምራችና ኢንዱስትሪ ትስስር" ማለት 7/ “Coffee grower and Industry linkage”
በቡና አምራችና በወጪ ቡና ቆዪ means coffee production and sales process,
ኢንዱስትሪዎች መካከል በውል የሚፈጸም through contractual agreement between

coffee producer and export coffee roaster
የቡና ማምረትና ሽያጭ አሠራር ነው፤
industries;
፰/ "የቡና ምርት ዱካ" ማለት የቡና ምርት 8/ “Coffee product Trace” means a document
ከተመረተበት ጀምሮ እሴት ሰንሰለቱን that shows the history of a Coffee product
ተከትሎ ታሪኩን የሚገልጽ መለያ ሰነድ ነው፤ beginning from location of production along
the value chain;
፱/ "የቡና መሸኛ" ማለት በባለሥልጣኑ ወይም 9/ "Coffee Delivery Note" means a pass permit
አግባብ ባለው የክልል አካል የተዘጋጀ issued by the authority or appropriate
አስፈላጊው መረጃ የተሞላበት፣ የተፈረመበትና regional organ with necessary information
የመንግሥት ማህተም ያረፈበት የይለፍ ሰነድ filled, signed and government seal stamped;

፲/ የአቅርቦት ቡና ማዘጋጃና ማከማቻ ኢንዱስትሪ" 10/ "Supply coffee processing and

ማለት አግባብ ያለው የክልል አካል warehousing industry" means industry

ያልታጠበ የአቅርቦት ቡና የሚዘጋጅበትና
washed coffee with parchment and also
የሚከማችበት በቡና አመራች አካባቢ
coffee with pulp is hulled, cleaned and
የተቋቋመ ኢንዱስትሪ ነው፤
sorted to be processed and stored as
unwashed supply coffee;
፲፩/ "የወጪ ቡና ማዘጋጃና ማከማቻ ኢንዱስትሪ" 11/ "Export coffee processing and
ማለት ባስልጣኑ የሚያወጣውን የቴክኒክ warehousing industry" means industry
መስፈርት አሟልቶ ከነገለፈቱ ያለውን established fulfilling the technical

ለወጪ ገበያ የሚዘጋጅበትና የሚከማችበት
sorted to be processed and stored as
ኢንዱስትሪ ነው፤
unwashed export coffee;
፲፪/ "ለግብይት የሚቀርብ የቡና ቅጠል" ማለት 12/ "Coffee leaf supplied for market" means
በቡና አምራቾች ተሰብስቦ ለገበያ የሚቀርብ

coffee leaf collected and supplied to the
market by coffee producers after completing
ቡና ለተክሉ ተፈጥሯዊ አግልግሎቱን
its natural use for coffee tree;
ያጠናቀቀ የቡና ቅጠል ነው፤
፲፫/ በአዋጁ አንቀጽ (፪) የተመለከተው ትርጓሜ 13/ Definitions provided under Article (2) of
ለዚህ ደንብም ተፈጻሚነት ይኖረዋል፡፡ the Proclamation shall also be applicable for
this Regulation.
፫. የተፈጻሚነት ወሰን 3. Scope of Application

This Regulation shall apply to any person who
ይህ ደንብ በኢትዮጵያ የቡና ግብይትና ጥራት
directly or indirectly involves in coffee
ቁጥጥር ላይ በቀጥታም ሆነ በተዘዋዋሪ በሚሳተፍ
marketing and quality control.
ማንኛውም ሰው ላይ ተፈጻሚ ይሆናል፡፡

ክፍል ሁለት SECTION TWO
የቡና ግብይት አሠራር COFFEE MARKETING PROCESS

4. Marketing of Red Cherry coffee and Coffee
፬. የቀይ እሸትና የጀንፈል ቡና ግብይት
with pulp
ማንኛውም የቀይ እሸት እና የጀንፈል ቡና Marketing of red cherry coffee and coffee with
ግብይት የሚከናወነው:- pulp shall take place:
፩/ የቡና አምራች አርሶ አደሮች ከግል ቡና 1/ At allowed washed and unwashed coffee
አቅራቢዎች ወይም ከመሠረታዊ ህብረት processing industries, between suppliers or
ሥራ ማህበራት ጋር በተፈቀደ የታጠበ እና primary co-operatives and coffee growing
ያልታጠበ ቡና ማዘጋጃ ኢንዱስትሪዎች፤ farmers;
፪/ በዚህ አንቀጽ ንዑስ አንቀጽ (፩) የተገለጸው 2/ Without prejudice to the provision of sub
እንደተጠበቀ ሆኖ የቡና ማዘጋጃ ኢንዱስትሪዎች article (1) of this article, at first level coffee
transaction centers where coffee processing
ተደራሽ ባልሆኑባቸው ወይም በሌሉባቸው
industries are inaccessible or nonexistent;
አካባቢዎች በሚቋቋሙ በመጀመሪያ ደረጃ ቡና
ግብይት ማዕከላት፤
፫/ የቡና ልማትና ግብይት ትስስር በፈጠሩ ቡና 3/ At the place mentioned in the contractual
አምራች አርሶ አደሮችና አልሚ ባለሃብቶች agreement of established out growers
መካከል በውል ስምምነቱ በተገለጸ ቦታ፤ እና scheme, between coffee growing farmers
and commercial coffee producers; and
፬/ የወጪ ቡና ቆዪ ኢንዱስትሪዎች ከቡና 4/ At the place mentioned in the contractual

አምራች አርሶ አደሮች ጋር በምርትና ግብይት agreement between coffee growing farmers
ውል ስምምነቱ በተገለጸው ቦታ ነው፡፡ and export coffee roaster industries.
፭. የአቅርቦትና ተረፈ ምርት ቡና ግብይት 5. Marketing of Supply Coffee and Coffee By

Product
፩/ የአቅርቦት ቡና ግብይት በኢትዮጵያ ምርት 1/ Supply coffee transaction shall take place
ገበያ ወይም በሌሎች አማራጭ የቡና only at Ethiopian Commodity Exchange or
ግብይት ሥርዓት ብቻ ይከናወናል፣ at another alternative marketing system,
፪/ ማንኛውም ተረፈ ምርት ቡና ግብይት 2/ Any coffee by product transaction shall take
የሚካሄደው በኢትዮጵያ ምርት ገበያ ብቻ place only at Ethiopian Commodity
ነው፡፡ Exchange,
፫/ በኢትዮጵያ ምርት ገበያ የሚካሄድ የቡና 3/ In Ethiopia Commodity Exchange:
ግብይት:-
a) a coffee supplier or coffee grower shall
ሀ) ቡና አቅራቢ ወይም ቡና አምራች
only sell supply coffee or domestic
የአቅርቦት ወይም የሀገር ውስጥ ፍጆታ
consumption coffee,
ቡና ብቻ በመሸጥ፣

ለ) ቡና ላኪ ለወጪ ገበያ የሚሆን b) a coffee exporter shall only purchase

የአቅርቦት ቡና በመግዛትና ተረፈ export standard supply coffee and sell
ምርት ቡና ብቻ በመሸጥ፣ coffee by product,
ሐ) የወጪ ቡና ቆዪ የአቅርቦት ቡና ወይም c) an export coffee roaster shall only

የሀገር ውስጥ ፍጆታ ቡና በመግዛትና purchase supply coffee and domestic
ተረፈ ምርት ቡናን ብቻ በመሸጥ፣ consumption coffee and sell coffee by

product,
መ) የሀገር ውስጥ ቡና ጅምላ ነጋዴ የሀገር d) a coffee wholesaler shall only purchase
ውስጥ ፍጆታ ቡና ወይም ተረፈ ምርት domestic consumption coffee or coffee by
ቡናን ብቻ በመግዛት፣ እና product, and
ሠ) የሀገር ውስጥ ቡና ቆዪ የሀገር ውስጥ e) a domestic coffee roaster shall only

purchase domestic consumption coffee or
ፍጆታ ቡና ወይም ተረፈ ምርት ቡናን
coffee by product.
ብቻ በመግዛት፤
ይከናወናል፡፡
4/ Supply coffee purchased from Ethiopian
፬/ ከኢትዮጵያ ምርት ገበያ ወይም ከሌሎች
Commodity Exchange or other alternative
የግብይት አማራጮች የተገዛ የአቅርቦት ቡና
market system shall not be re- sold in
በድጋሚ በሀገር ውስጥ ሊሸጥ አይችልም፤
domestic market.
፭/ በዚህ አንቀጽ ንዑስ አንቀጽ (፬) የተጠቀሰው 5/ Without prejudice to the provisions of sub-
እንደተጠበቀ ሆኖ ማንኛውም ቡና ላኪ የቡና article (4) of this Article, any coffee exporter
who closed his exporting business or provide
ላኪነት ሥራውን ያቋረጠ ከሆነ ወይም
convincing evidence on lack of export market

or have small quantity of export coffee
ያቀረበ ከሆነ ወይም ከውጪ ገበያ ሽያጭ
leftover from export, may sell at the Ethiopian
ተርፎ ሳይላክ የቀረ አነስተኛ መጠን ያለው
Commodity Exchange or at export market
ቡና መኖሩ ሲረጋገጥ በባለሥልጣኑ ልዩ
through agreement with other coffee exporter,
ፈቃድ ብቻ በኢትዮጵያ ምርት ገበያ ወይም only when it is verified and permitted by the

6/ Coffee growing farmers may sell supply
፮/ ቡና አምራች አርሶ አደሮች ያመረቱትን
coffee or coffee by product at Ethiopian
የአቅርቦት ወይም ተረፈ ምርት ቡናን አግባብ
Commodity Exchange without trade license,
ባለው የክልል አካል ተረጋግጦ ንግድ ፈቃድ
when this is verified and permitted by
ሳይጠየቁ በሚሰጣቸው ልዩ ፈቃድ ብቻ
appropriate regional organ.
በኢትዮጵያ ምርት ገበያ መሸጥ ይችላሉ፡፡

፮. አማራጭ የቡና ግብይትና አሠራር 6. Alternative Coffee Transaction and Process

፩/ ቡና ላኪ ወይም የወጪ ቡና ቆዪ ከቡና አቅራቢ 1/ Coffee exporter or export coffee roaster may
ወይም ከቡና አልሚ ባለሃብት ጋር የቀጥታ establish supply coffee transaction scheme
የአቅርቦት ቡና ግብይት ትስስር የሚፈጥረው:- with coffee supplier or Commercial Coffee

producer, if :
ሀ) በተዋዋይ ወገኖች መካከል ቢያንስ ለሁለት a) there is a contractual agreement registered
ዓመት የሚቆይ ስልጣን ባለው አካል by the authorized organ between
የተመዘገበ የውል ስምምነት ሲኖር፣ contracting parties for a minimum of two

years,
ለ) የተመዘገበው ውል በአስራ አምስት የስራ b) the Registered contract is approved with
ቀናት ውስጥ ለባለስልጣኑ ቀርቦ የጸደቀና in fifteen working days starting from the
date of registration by Authority and
በሦስት የስራ ቀናት ውስጥ በኢትዮጵያ
thereafter registered with in three working
ምርት ገበያ ቀርቦ የተመዘገበ ሲሆን፣
days by Ethiopian commodity exchange,
ሐ) በውል ስምምነቱ የርክክብ ቦታው የተገለጸና c) the place of delivery is indicated in the

ምርት ገበያው በሚኖር ተመሳሳይ ዓይነትና Commodity Exchange, on the same date
ደረጃ ያለው ቡና አማካይ ዋጋ በላይ ከሆነና the coffee is graded by the coffee quality
ጭማሪውም በመቶኛ በውሉ የተገለጸ ከሆነ፣

inspection and grading center and the
additional payment is specified in the
contract with percentage,
ሠ) ቡና አቅራቢው ወይም ቡና አልሚ ባለሃብቱ e) The Coffee Supplier or commercial
ከሚያዘጋጀው ቡና ከ፸፭ በመቶ (ከሰባ Coffee producer agrees in the contract
አምስት በመቶ) በላይ ጥራቱ ከደረጃ አንድ only to deliver above 75% (seventy five

መዳረሻ ገበያ አማካይ ዋጋ በላይ በውጭ
of the same type, grade and destination,
ገበያ ለመሸጥ የተስማማ ከሆነ፣
gA ፲ሺ፭፻፸፬ Ød‰L nU¶T Uz¤È qÜ_R ፫ ጥቅምት ፳፫ qN ፪ሺ፲፩ ›.M Federal Negarit Gazette No. 3 2 November 2018 ….page 10574
ሰ) ሁለቱም ወገኖች በውል አፈጻጸም ላይ g) there is an agreement in the contract to

አለመግባባት ቢከሰት በድርድር ወይም resolve disagreement between contracting
አግባብ ባለው ፍርድ ቤት ለመዳኘት parties either by negotiation or by court,

and
መስማማታቸው በውሉ የተገለጸ ከሆነ፣ እና
ሸ) በዚህ አንቀጽ ንዑስ አንቀጽ (፩) ሥር h) Without prejudice to the conditions under
sub-article 1(a–f) of this Article, a women
ከፊደል ተራ (ሀ እስከ ረ) የተመለከቱ
coffee growing farmer agrees in contract
ሁኔታዎች እንደተጠበቁ ሆነው የተለየ የገበያ
to transact coffee directly with women
ዕድል ወይም የተሻለ ዋጋ ለማግኘት ከሴት
coffee exporter or women export coffee
ቡና አምራች፣ ከሴት ቡና ላኪ ወይም ከሴት
roasters to obtain special market
የውጪ ቡና ቆዪ ጋር በቀጥታ የቡና ግብይት
opportunity or premium price.
ለመፈጸም በውል የተስማሙ ከሆነ፤
ነው፡፡
፪/ ቴቡና አቅራቢ የወጪ ገበያ ቡናን በቀጥታ ወደ 2/ Coffee Supplier may export directly export
ውጭ ሀገር መላክ የሚችለው:- coffee when he:
ሀ) ከቡና አቅራቢነት በተጨማሪ የቡና አቅራቢ፣ a) holds supplier-exporter certificate of
ላኪነት የብቃት ማረጋገጫና የቡና ላኪነት competence and coffee export trade
license in addition to coffee suppliers;
የንግድ ፈቃድ ካለው፤
b) Agrees to export above 75% (seventy
ለ) በራሱ ኢንዱስትሪ ከሚያዘጋጀው ቡና ከ፸፭
five percent) from grade one up to four
በመቶ (ከሰባ አምስት በመቶ) በላይ የሚሆነው
by maintaining traceability, form coffee

ለመላክ ከተስማማ፤ እና
c) Agrees to sell higher than the average
ሐ) በኢትዮጵያ ብሔራዊ ባንክ ከሚመዘገበው
price of National Bank of Ethiopia export
ተመሳሳይ የቡና ዓይነት፣ ደረጃ እና መዳረሻ
coffee contract registration of the same
ገበያ አማካይ ዋጋ በላይ በውጭ ገበያ
date, coffee type, grade and destination.

፫/ ቡና አምራች አርሶ አደር በቀጥታ ቡናን ለውጭ
directly to foreign market when he:
ገበያ መላክ የሚችለው:-
a) Submits evidence of land holding certificate,
ሀ) የመሬት ይዞታ ማረጋገጫ ያለው፣ በቡና
amount of coffee plantation land and its
የተሸፈነ መሬት መጠንና በየዓመቱ የሚመረተ
estimate of annual coffee production from

appropriate regional organ,
ካለው የክልል አካል የሚያቀርብ ከሆነ፣

ማከማቻ ኢንዱስትሪ ያለው ወይም የኪራይ contract of supply and export coffee
ውል ያለው ስለመሆኑ የሚያቀርብ ከሆነ፣ processing and warehousing industry,

c) Agrees to sell with similar export price
ሐ) በኢትዮጵያ ብሔራዊ ባንክ የቡና አምራች
registered by coffee growing farmers at
አርሶ አደሮች በተመሳሳይ ጊዜ ካስመዘገቡት
National Bank of Ethiopia of the same
ተመሳሳይ የቡና ዓይነት፣ ደረጃ እና መዳረሻ
time, type, grade and destination, and
ገበያ ሽያጭ ተመጣጣኝ በሆነ ዋጋ ለመሸጥ
ከተስማሙ፣ እና
መ) ከማሳው ያመረተውን ቡና ብቻ ለመላክ d) Holds special coffee export permit from
the Authority to export only coffee
ንግድ ፈቃድ ሳያስፈልገው ከባለሥልጣኑ
produced from his own farm without
ቡና የመላክ ልዩ ፈቃድ የተሰጠው ከሆነ፤
export trade license.
ነው፡፡
4/ coffee producer and exporter may export
፬/ ቡና አልሚና ላኪ ባለሃብት በቀጥታ ቡናን
coffee directly to foreign market when he:
በውጭ ገበያ መለክ የሚችለው:-
ሀ) የኢንቨስትመንት ፈቃድ፣ የመሬት ኪራይ a) Submits evidence of Investment license,
ውል፣ በቡና የተሸፈነ መሬት መጠንና land lease certificate, amount of coffee
plantation land and its estimate of annual
ዓመታዊ የቡና ምርት ግምት አግባብ ካለው
coffee production from appropriate
የክልል አካል ማስረጃ ካቀረበ፣
regional organ,
ለ) ከቡና አምራች አርሶ አደሮች ጋር የልማትና b) Establishes out grower’s scheme with
ግብይት ትስስር የፈጠረ እና ስለዚህ ሁኔታ coffee growing farmer and submits
አግባብ ካለው የክልል አካል ማስረጃ ካቀረበ፣ evidence about this from appropriate
regional organ,
ሐ) የአቅርቦት እና የወጪ ቡና ማዘጋጃና ማከማቻ c) Submits ownership evidence or lease
ኢንዱስትሪ ያለው ወይም የኪራይ ውል contract of supply and export coffee
ያለው ስለመሆኑ የሚያቀርብ ከሆነ፣ እና processing and warehousing industry, and
መ) ቡና አልሚና ላኪ ባለሃብቶች በኢትዮጵያ d) Agrees to sell with average and above

ብሔራዊ ባንክ በተመሳሳይ ጊዜ ካስመዘገቡት export price registered in similar time by
ተመሳሳይ የቡና ዓይነትና ደረጃ የመዳረሻ commercial coffee producers at National
ገበያ አማካይ ዋጋ እና በላይ በውጭ ገበያ Bank of Ethiopia of the same time, type,
ለመሸጥ የተስማሙ ከሆነ፤ grade and destination.
ነው፡፡
፭/ የወጪ ቡና ቆዪ በአምራችና ኢንዱስትሪ 5/ Export coffee roaster may export coffee by

purchasing coffee through ccontract farming,
ትስስር ቡና ገዝቶ ወደ ውጭ መላክ የሚችላው:-
when he:

ሀ) ቀይ እሸት ወይም ጀንፈል ቡና ከአምራች አርሶ a) Purchases red cherry coffee or coffee with

coffee grower and Industry contract

7. Specialty coffee preparation and Transaction
፯. የልዩ ቡና ዝግጅትና ግብይት አሰራር
process
፩/ የልዩ ቡና ዝግጅትና ግብይት የሚፈጸመው:- 1/ Specialty coffee preparation and transaction
shall be executed:
ሀ) ቀይ እሸት ወይም ጀንፈል ቡና ለልዩ ቡና a) When red cherry coffee or coffee with
ዝግጅት ግብዓትነት ለመጠቀምም ሆነ ለማዘጋጀት pulp that can be used as input for or
የባለሥልጣኑን የቴክኒክ መስፈርትና የጥራት processing of specialty coffee fulfills the

permission from appropriate regional organ
ካለው የክልል አካል የብቃት ማረጋገጫና
for unwashed specialty coffee preparation,
ፈቃድ ያገኘ ከሆነ፣
c) When information on specialty coffee
ሐ) የልዩ ቡና የግዢ፣ የዝግጅት፣ የክምችትና
purchase, process, storage and sells
የሽያጭ መረጃ በተለየ መልኩ ሲይዝና managed differently and can be provided,
ሊቀርብ የሚችል ከሆነ፣ እና and
መ) በኢትዮጵያ ምርት ገበያ ወይም በአማራጭ d) When it is registered as specialty coffee
ግብይት ሲፈጸም ልዩ ቡና ተብሎ during transaction at Ethiopian
ከተመዘገበ፣ Commodity Exchange or at Alternative

፪/ ማንኛውም ቡና አቅራቢ ለልዩ ቡና ዝግጅት 2/ When any coffee supplier establishes out

farmers,
ለማቅረብ መስማማት፤
ለ) ለቡና አምራች አርሶ አደሮቹ የኤክስቴንሽን b) Provide evidence from appropriate
ድጋፍ ለመስጠት አግባብ ያለው ባለሙያ regional organ about capacity and
በቅጥር ለማሠማራትና የቴክኖሎጂ ድጋፍ employment of appropriate professional
ለማድረግ አቅም ያለው ስለመሆኑ አግባብ to deliver extension services and

ካለው የክልል አካል ማስረጃ ማቅረብ፤
farmers,
ሐ) ከቡና አምራች አርሶ አደሮቹ ከተረከበው c) Agree to prepare above 90% (ninty
ቡና ከ፺ በመቶ (ከዘጠና በመቶ) በላይ በልዩ percent) of all received coffee from coffee
growing farmers as specialty coffee and
ቡናነት ለማዘጋጀት መስማማት፣ እና
መ) ለልዩ ቡና ዝግጅት ለሚረከበው ቡና d) Agree to pay above the local price for
specialty coffee preparation of received
ከአካባቢው ገበያ ዋጋ በላይ ለመክፈል
coffee.
መስማማት፣
አለበት፡፡
፰. ከውጭ ሀገር ስለሚገባ ጥሬ ቡና 8. Importing raw coffee from abroad

1/ Raw coffee from abroad may be imported:
፩/ ከውጭ ሀገር ቡና ለማስገባት የሚቻለው:-
a) If the national significance of importing
ሀ) ጥሬ ቡናን ከውጭ ሀገር ማስገባት የሚኖረው
raw coffee is asserted by the study,
ሀገራዊ ፋይዳ በጥናት ሲረጋገጥ፣
b) If raw coffee allowed to be imported
ለ) ከውጭ ሀገር ተፈቅዶ የሚገባው ጥሬ ቡና
specifies the origin of producing country
የተመረተበት ሀገር የተገለጸ እና ሀገራዊ
and fulfills national plant health quarantine
የዕጽዋት ጤና ማረጋገጫ መስፈርት ሲያሟላ፣ and phytosanitary certificate standard,
ሐ) ከውጭ የሚገባው ጥሬ ቡና የተፈቀደለትን c) If the raw coffee to be imported uses only
የጉዞ መስመር፣ መጋዘንና ኢንዱስትሪ ብቻ the permitted transport root, warehouse

and processing industry,
የሚጠቀም ከሆነ፣
መ) ከሀገራችን ቡና ጋር በሚታወቅ ምጣኔ d) If it is blended with national origin coffee
ተቀይጦ በተቆላ ወይም ተቆልቶ በተፈጨ by known blending ratio, and fully
ወይም በሌላ መልኩ እሴት ተጨምሮ ሙሉ exported in the form of roasted or roasted

፪/ የኢትዮጵያ ገቢዎችና ጉምሩክ ባለሥልጣን 2/ The Ethiopian Revenues and Customs
ከውጭ ለሚገባ ጥሬ ቡና ልዩ የጉምሩክ Authority shall establish special customs service

፱. ለውጪ ገበያ የተዘጋጀ ቡና በሀገር ውስጥ ስለመሸጥ 9. selling of export standard coffee at domestic
market
ለውጪ ገበያ በተቆላ ወይም ተቆልቶ በተፈጨ
Roasted or roasted and grinded or any other
ወይም በሌላ መልኩ የተዘጋጀ ቡና በሀገር ውስጥ form of export coffee shall be transacted at

ሀገር ጎብኚዎች መንገደኞች መተላለፊያና
permitted by the Authority;
ማዘውተሪያ ቦታ ከሆነ፤
3/The transaction is done with U.S dollars or
፫/ በአሜሪካ ዶላር ወይም በኢትዮጵያ ብሔራዊ
other foreign currency permitted only by

4/ The coffee type, brand name, trade mark,

coffee type, quantity, amount of money in

foreign currency and shopping place to the
ለገዥው ደረሰኝ ሲሰጥ፤ እና
buyer; and
፮/ በየወሩ መጨረሻ ዝርዝር የቡና ግዢ እና 6/ At the end of each month, a detailed coffee
ሽያጭ መግለጫ በሻጩ ተዘጋጅቶ በብሔራዊ purchase and sales statement is prepared by

፲. የቡና ገለባና ቅጠል የግብይት አሠራር 10. Coffee husk and leaf Transaction Process
፩/ ቡና አምራች፣ የቡና ገለባ አቀነባባሪ፣ የቡና 1/ Coffee producer, coffee husk processer,
coffee leave processer or coffee exporter may
ቅጠል አቀነባባሪ ወይም ቡና ላኪ የቡና ገለባ
directly export coffee husk or coffee leaf with
ወይም የቡና ቅጠል በባለስልጣኑ ፈቃድ
the permission from the Authority.
በቀጥታ ወደ ውጪ መላክ ይችላል፡፡

፪/ የቡና ገለባ ግብይት የሚፈጸመው ከቡና 2/ The coffee husk transaction shall be made

producer or coffee supplier and coffee husk
አቀነባባሪ ወይም ከቡና ላኪ ጋር በሚደረግ
processor or coffee exporters.
ድርድር ይሆናል፡፡
3/ The transaction of coffee leaf that
፫/ ለቡና ተክሉ ተፈጥሯዊ አገልገሎቱን ያጠናቀቀ
completed its natural life cycle shall be
የቡና ቅጠል ግብይት የሚፈጸመው ከቡና
made through negotiation between coffee
አምራቾች እና ፈቃድ ከተሰጣቸው የቡና ቅጠል
producers and coffee leaf processors or
አቀነባባሪዎች ወይም ከቡና ላኪዎች ጋር
coffee exporters.
በድርድር ነው፡፡
፬/ ለሽያጭ የሚውለው የቡና ገለባ በውስጡ ያለው 4/ Coffee bean content inside prepared coffee
husk for sale should not exceed one
የቡና ፍሬ መጠን ከአንድ በመቶ መብለጥ
percent.
የለበትም፡፡
5/ To transport any coffee husk or leaf from
፭/ ማንኛውም የቡና ገለባ ወይም የቡና ቅጠል
one place to other, dispatch from the

አለበት፡፡
11. Export coffee Sales Contract and process
፲፩. የወጪ ቡና የሽያጭ ውልና አሠራር
1/ Any person supplying coffee to export
፩/ ማንኛውም ለውጭ ገበያ ቡናን የሚያቀርብ
market must enter into contract validating
ሰው ስለቡና ገዢው ህጋዊነት አረጋግጦ
the legality of the buyer.
የሽያጭ ውል መፈጸም አለበት፡፡
2/ Without prejudice to buyers demand,
፪/ የወጪ ቡና ሽያጭ ውል ሲፈጸም የገዢው
contract document for export coffee shall
ፍላጎት እንደተጠበቀ ሆኖ የውሉ ሰነድ:-
constitute the following:
ሀ) የቡና ሻጭ እና ገዢ ሙሉ ስም እና a) The full name and contact address of

ለ/ የቡናውን ዓይነት፣ መጠን፣ የጥራት ደረጃ፣ b) Coffee type, quantity, quality grade
እና ውሉ የሚፈጸምበት ጊዜ እና level, and time of performance and
የተሸጠበትን ዋጋ በአሜሪካ ዶላር፣ እና selling price in US dollars and
ሐ/ ሌሎች አግባብነት ያላቸው የውል c) Other contract terms; and should be

3/ Coffee export contract period shall not

exceed 90 consecutive days after the date of

4/ Any coffee exporter should settle a sales

account within the timeframe decided by
በኢትዮጵያ ብሔራዊ ባንክ በሚወስነው
the National Bank of Ethiopian.
የጊዜ ገደብ ውስጥ ማወራረድ አለበት፡፡
5/ Notwithstanding to sub-article (3) of this
፭/ በዚህ አንቀጽ ንዑስ አንቀጽ (፫) የተጠቀሰው
Article, sales contract period for coffee
ቢኖርም ቡና ላኪው ቡና አምራች ከሆነ የውሉ
producer may be extended up to nine month
መፈጸሚያ ጊዜ ከዘጠኝ ወራት ያልበለጠ ሆኖ
within coffee production season, according
ባመረተው ወይም በሚያመርተው የቡና ምርት
to his coffee type and quantity produced.
ዓይነትና መጠን ልክ እስከ ቡና ምርት ዘመኑ
መጨረሻ ድረስ ሊሆን ይችላል፡፡
፮/ ማንኛውም የወጪ ቡና ሽያጭ በውሉ 6/ Any export coffee sales shall be performed
በተጠቀሰው የጊዜ ገደብ፣ ጥራት፣ መጠን፣ according to time limit, quality, quantity, price
ዋጋና ሁኔታ መሠረት መፈጸም አለበት፡፡ and conditions mentioned in the contract.
፯/ በዚህ አንቀጽ ንዑስ አንቀጽ (፮) የተደነገገው 7/ Notwithstanding the provisions of sub-
ቢኖርም ውሉን ለመፈጸም የማያስችል አስገዳጅ Article (6) of this Article, the Authority
ያልታሰበ ሁኔታ ስለመኖሩ በማስረጃና በሁለቱ may extend the contract period or price

፰/ ማንኛውም ቡና ላኪ ያለበቂ ምክንያት፤ 8/ Any coffee exporter without sufficient

የተዋዋለውን የሽያጭ ውል በሙሉ ወይም ground, fully or partially defaults the sales
በከፊል በተለይ በጊዜ ገደቡ ወይም በጥራት contract he entered, especially in time limit
or in quality or in both, legal and
ወይም በሁለቱም ያለመፈጸሙ ሲረጋገጥ
administrative measures shall be taken.
በዚህ ደንብና አግባብነት ባላቸው ህጎች
አስተዳደራዊ እና ህጋዊ እርምጃ ይወሰዳል፣ 9/ When there is a default of contract by
፱/ ውሉን ያልፈጸመ የውጭ ሀገር ቡና ገዥ ሲኖር foreign coffee buyer, it may be resolved
በውጭ ሀገር ባሉ የኢትዮጵያ ኤምባሲዎች through negotiation using Ethiopian
አማካይነት በድርድር እንዲፈታ ይደረጋል embassies or legal measures shall be taken.
ወይም አግባብነት ባለው ህግ እርምጃ

ይወሰዳል፡፡
፲/ ማንኛውም ቡና ላኪ በኢትዮጵያ ብሔራዊ 10/ When any coffee exporter frequently
registers below the average price range

or legal partnership to promote the natural
ባህሪይ ለማስተዋወቅና የተሻለ ዋጋ ለማስገኘት
taste and characteristics of Ethiopia special
በውጭ ሀገር የተጠቃሚ ገበያ በቀጥታ ወይም
coffee and obtain better price for such, the
በህጋዊ ሽርክና በገበያ ለመሳተፍ የፈለገ
authority may permit, when its national
እንደሆነ ሀገራዊ ኢኮኖሚያዊ ፋይዳው በጥናት
economic significance is asserted by a

፲፪. ለውጭ ሀገር ገዢ የውጪ ቡናን በሀገር ውስጥ 12. Domestic delivery of Export coffee to foreign

፩/ ለውጭ ሀገር ቡና ገዢ የተሸጠ የውጪ ቡና 1/ When the national significance is verified
በሀገር ውስጥ ርክክብ እንዲፈጸምና ለተወሰነ by a study, export coffee sold to foreign
ጊዜ እንዲከማች ሀገራዊ ፋይዳው በጥናት buyer may be delivered domestically and

stored for a limited time by the permission
ሲረጋገጥ በባለሥልጣኑ ሊፈቀድ ይችላል፡፡

፪/ ማንኛውም የውጭ ሀገር ቡና ግዢ በሀገር 2/Any foreign coffee buyer may receive coffee

፫/ የውጭ ሀገር ቡና ገዢ በሀገር ውስጥ የወጪ 3/ foreign coffee buyer within three working
ገበያ ቡናን ከተረከበበት ቀን ቀጥሎ ባሉት days after the date he received export
ሦስት የሥራ ቀናት ውስጥ በኢትዮጵያ coffee, shall pay according to the
registered sales contract at National Bank
ብሔራዊ ባንክ በተመዘገበ የሽያጭ ውል
of Ethiopia.
መሠረት ክፍያ መፈጸም አለበት፡፡
፬/ የውጭ ሀገር ቡና ገዥ በሀገር ውስጥ 4/ A foreign coffee buyer after finishing the
የተረከበውን ቡና አስፈላጊውን የሎጀስቲክና necessary logistics and dispatch procedures

5/ Notwithstanding the provisions of sub-

article (4) of this article, any foreign buyer

shall only transport to the port with written

፮/ በማናቸውም ምክንያቶች የውጪ ሀገር ቡና 6/ Foreign coffee buyer shall not re-sale
received coffee for any reason at domestic
ገዥ የተረከበውን ቡና በሀገር ውስጥ መልሶ
market.
መሸጥ አይችልም፡፡

13. Determination and administration of

፲፫. የመገበያያ ስፍራ እና አሰራር ስለመወሰን
transaction places
፩/ አግባብ ያለው የክልል አካል የቀይ እሸትና 1/ The appropriate regional organ shall
የጀንፈል ቡና መገበያያ ስፍራን፣ ወሰንን፣ determine and demarcate places,
ብዛትንና ስርጭትን ይወስናል፣ ይከልላል፣ dimensions, number and distribution of red

cherry and coffee with pulp transaction
የአስተዳደር ሥርዓት ይዘረጋል፡፡

መ) ለአምራች አርሶ አደሮች የቡና ምርታቸውን d) Relative proximity to growing farmers
ለማቅረብ ያላቸውን አንጻራዊ ቀረቤታና for supplying their coffee and its
ለተገበያዮቹ የግብይት እንቅስቃሴ አመቺ convenience to transacting actors for

፬/ የአቅርቦት ቡና ማዘጋጃና ማከማቻ ኢንዱስትሪ 4/ where supply coffee processing industries
ተደራሽ ባልሆኑባቸው ወይም በሌሉባቸው are inaccessible or not existent at such

localities, first level coffee transaction
አከባቢዎች ለቀይ እሸትና ጀንፈል ቡና
center decided to be transaction center for
መገበያያነት እንዲያገለግል የተወሰነው የመጀመ

ሪያ ደረጃ ቡና ግብይት ማዕከል ከሆነ:-

ለ) ለግብይቱ የሚሆን ቢያንስ ፶ ሜትር በ፶ b) At least 50 meter by 50 meter
ሜትር ስፋት ያለው የታጠረ ቦታ፣ dimension and fenced place,
ሐ) የቡና ጥራት ጉድለት መልቀሚያ አልጋ፣ c) Coffee quality Sorting bed,
መ) ለጋማ ከብቶች ማቆያ የተለየ ቦታ፣ d) Special parking place for transport
animals,
ሠ) ዕለታዊ የቡና ገበያ ዋጋ ማሳወቂያ ሠሌዳ፣ e) Daily market price information ticker board,
f) Dry waste disposal and pit latrine, and

ረ) ደረቅ ቆሻሻ ማቃጠያ እና መፀዳጃ ቤት፣ እና
g) Transaction room with cemented floor
ሰ) በእያንዳንዱ ቡና አቅራቢ ስም ወለሉ
in the name of each supplier.
በሲሚንቶ የተሠራ የምርት ግዢ መፈፀሚያ
ክፍል፣
ያለው መሆን ይኖርበታል፡፡

፭/ ቡና አምራች አርሶ አደር የተሻለ የቡና ዋጋ 5/ Coffee growing farmer may choose to sell
በሚያስገኝለት ኢንዱስትሪ ወይም የመጀመሪያ either primary market center or industry
ደረጃ ገበያ መርጦ መሸጥ ይችላል፡፡ where better price is paid.
6/ Notwithstanding sub-article (1) of this

፮/ በዚህ አንቀጽ ንዑስ አንቀጽ (፩) የተደነገገው

እሸት ወይም ጀንፈል ቡና በውል
coffee growing farmers at the place
ስምምነታቸው በተገለጸው ስፍራ ይሆናል፡፡ specified in their agreement.
፯/ አግባብ ያለው የክልል አካል የቀይ እሸትና 7/ Appropriate Regional organ shall monitor,
ጀንፈል ቡና መገበያያ ስፍራ በቡና ጥራትና regulate and take measures on red cherry
ግብይት ሂደቱ ላይ አሉታዊ ተፅዕኖ and coffee with pulp marketing places to
make sure that it is free from conditions
ከሚያሳድሩ ነገሮች ነፃ መሆኑን ይከታተላል፣
which negatively affect coffee quality and
ይቆጣጠራል፣ እርምጃ ይወስዳል፡፡

፲፬. የቀይ እሸት እና የጀንፈል ቡና ግብይት ወቅት 14. Transaction Season of red cherry and
coffee with pulp
፩/ በአቅርቦት ቡና ማዘጋጃና ማከማቻ 1/ The beginning and ending time of
ኢንዱስትሪም ሆነ በመጀመሪያ ደረጃ የቡና transaction, either at supply coffee
ግብይት ማዕከላት ግብይቱ የሚጀምርበትና processing industries or at first level

coffee transaction centers, shall be

ግብይት ማዕከላት የሚፈጸመው ግብይት
delivery should be from 3 o’clock in the
ወይም በውል ስምምነት መሰረት የሚፈጸም morning up to 12 o’clock in the evening
ርክክብ ከጠዋቱ ፫ ሰዓት እስከ ምሽቱ ፲፪ at local time.
ሰዓት ብቻ መሆን ይኖርበታል፤

፲፭. የብቃት ማረጋገጫ ምስክር ወረቀት አስፈላጊነት 15. The Certificate of Competence
Without prejudice to article 8(1) of the

Certificate of competence to establish out
ማንኛውም ሰው ለቡና አልሚና ላኪ የልማትና
grower scheme for coffee producers and
ግብይት ትስስር ለመፍጠር የብቃት ማረጋገጫ
exporters shall be issued, when any person:
የምስክር ወረቀት የሚሰጠው:-
1/ Holds coffee development investment
፩/ የቡና ልማት ኢንቨስትመንት ፈቃድ እና
license and land lease;
የመሬት ሊዝ ውል ያለው፤
፪/ በቡና የተሸፈነ መሬትና ዘመናዊ የቡና ልማት 2/ Provides evidence for coffee plantation
land and achievement of improved
በማካሄድ የተሻሻለ ምርታማነትና የምርት
productivity and product quality by
ጥራት ደረጃ ስለመድረሱ ማስረጃ ያለው፤
implementing modern coffee development;
፫/ ለአምራች አርሶ አደሮች ዘመናዊ የቡና 3/ Provides evidence about employment of
አመራረት ዘዴ ለማስፋፋት የቡና ዕውቀትና professional with coffee knowledge and

skill to promote modern coffee farming
ክህሎት ያለውን ባለሙያ ማሰማራቱን
methods for coffee growing farmers;
የሚገልጽ ማስረጃ ያለው፤
4/ Agrees to provide modern extension
፬/ ለአምራች አርሶ አደሮች ዘመናዊ የኤክስቴንሽን
service support and improved farm inputs
አገልግሎት ድጋፍ እና የተሻሻሉ ግብዓቶችን
to improve productivity and product
በማቅረብ ምርታማነትና የምርት ጥራት
quality for coffee growing farmers ;
ለማሻሻል የተስማማ፤
5/ Agrees to pay better price than locally
፭/ ከአምራች አርሶ አደሮች ለሚረከበው ቡና
existing market price for received coffee
ከአካባቢው ወቅታዊ የገበያ ዋጋ የተሻለ
from coffee growing farmers,
ለመክፈል የተስማማ፤
6/ Holds evidence for coffee growing
፮/ ከቡና አልሚ ባለሃብት ማሳ ኩታገጠም ወይም
farmers’ list clustered or nearby, area of
በቅርብ ርቀት የሚገኙ ቡና አምራች አርሶ
coffee plantation by each farmer and its
አደሮችን ዝርዝርና በእያንዳንዱ አርሶ አደር
annual yield and signed document of
በባለቤትነት የተመዘገበ በቡና የተሸፈነ ማሳ

ግዴታቸው ተወያይተው የተፈራረሙበት የቃለ
ጉባኤ ሰነድ ያለው፤ እና

፯/ በባለቤትነት የተያዘ ወይም በተመዘገበ የኪራይ 7/ Holds evidence of ownership or registered

ውል ያገኘው የቡና ማዘጋጃና ማከማቻ lease contract for coffee processing and
ኢንዱስትሪ ያለው ስለመሆኑ ማስረጃ ያለው፣ warehousing industry.
መሆኑ ሲረጋገጥ ነው፡፡

፲፯. የቡና አቅራቢነት የብቃት ማረጋገጫ ምስክር ወረቀት 17. Coffee Suppliers Certificate of Competence
ማንኛውም ሰው የቡና አቅራቢነት የብቃት The coffee supplier’s certificate of competence

shall be issued, when any person:
ማረጋገጫ የምስክር ወረቀት የሚሰጠው:-
፩/ በህግ ሰውነት የተሰጠው አካል ሲሆን የሥራ 1/ Has a business address for a juridical
አድራሻ ያለው፤ የተፈጥሮ ሰው ከሆነ ቋሚ person; has fixed asset and residence
ንብረት እና የመኖሪያ አድራሻ ያለው፤ address for a natural person;
፪/ በማንኛውም ንግድ ወይም በማህበራዊ 2/ Provides evidence from relevant organ
አገልግሎት ወይም በተሠማራበት የሙያ about good performance and reputation of

any business work or social service or
መስክ መልካም አፈጻጸምና ስም ያለው
professional engagement;
ስለመሆኑ ከሚመለከተው አካል ማስረጃ
ማምጣት የሚችል፤
3/ Owns or has leased through approved
፫/ አግባብ ባለው የክልል አካል የተዘጋጀውን
contract by Authorized organ a washed and

calibrator verified by the appropriate
የተመረመረ ሚዛንና የእርጥበት መለኪያ
governmental organ;
መሣሪያ ያለው፤
5/ Provides environmental impact assessment
፭/ ስለ ቡና ማዘጋጃና ማከማቻ ኢንዱሰትሪው
document on processing and warehousing
አሠራር ሁኔታ ከሚመለከተው መንግሥታዊ
industries from the appropriate government
አካል የአካባቢ ተጽዕኖ ግምገማ ሰነድ ማቅረብ
organ;
የሚችል፤
6/ Employs permanently, professionals with
፮/ ከቡና ግብይት፣ ክምችት፣ አዘገጃጀትና ጥራት
knowledge and skill about coffee
አያያዝ ጋር በተያያዘ ዕውቀትና ክህሎት transaction, storing, processing and quality
ያለው ባለሙያ በቋሚነት የቀጠረ፤ management;
፯/ የአቅርቦት ቡና አዘገጃጀትን በሚመለከት 7/ agrees to process supply coffee according to
አግባብ ባለው የክልል አካል በተቀመጡ standards set by the appropriate regional
organ;
መስፈርቶች መሠረት ለማዘጋጀት የተስማማ፤

፰/ ስለቡና ግዥ፣ ዝግጅት፣ ክምችትና ሽያጭ 8/ Organizes coffee purchase, process, sells
መረጃ ለማደራጀት እና መረጃውን አግባብ and stock information and agrees to provide
ባለው አስፈጻሚ አካል በተጠየቀ ጊዜ for relevant executing organ upon request;
ለመስጠት የተስማማ፤
፱/ በአቅርቦት ቡና ማዘጋጃና ማከማቻ ኢንዱስትሪው 9/ Agrees to take full responsibility about the
legality of the transaction of the purchased
የሚዘጋጅ ቡና ግዥ በህጋዊ ግብይት ብቻ
coffee to be processed in his coffee
ስለመከናወኑ ሙሉ ኃላፊነት ያለበት ስለመሆኑ
processing and warehousing industry; and
አውቆ የተስማማ፤ እና
10/ If criminally or administratively convicted
፲/ በቡና ንግድ በወንጀል ወይም በአስተዳደር
in coffee trade, completes the punishment, if
ቅጣት ተወስኖበት ከነበረ ቅጣቱን የፈጸመ
criminal punishment is Suspended,
ወይም የወንጀል ቅጣቱ የተገደበለት ከሆነ
completes the suspension.

መሆኑ ሲረጋገጥ ይሆናል፡፡
፲፰. የቡና ላኪነት የብቃት ማረጋገጫ ምስክር ወረቀት 18. Coffee exporter's certificate of competence
The coffee exporter’s certificate of

ማንኛውም ሰው የቡና ላኪነት የብቃት ማረጋገጫ
competence shall be issued, when any person:
የምስክር ወረቀት የሚሰጠው:-
አገልግሎት ወይም በተሠማራበት የሙያ መስክ about good performance and reputation of
መልካም አፈጻጸምና ስም ያለው ስለመሆኑ any business work or social service or

ከሚመለከተው አካል ማስረጃ ማምጣት የሚችል፤
፫/ በባለስልጣኑ የተዘጋጀውን የቴክኒክ መስፈርት 3/ Owns or has leased or has service contract
ያሟላ በባለቤትነት የያዘው ወይም ስልጣን ባለው through contract approved by Authorized
አካል በጸደቀ ውል ከሦስተኛ ወገን ያገኘው organ from a third party an export coffee
ወይም የአገልግሎት ውል ያለው የወጪ ቡና processing and warehousing industry
ማዘጋጃና ማከማቻ ኢንዱስትሪ ያለው፤

which meets technical standards issued by

የተመረመረ ሚዛንና የእርጥበት መለኪያ መሣሪያ calibrator verified by the appropriate

፭/ ስለ ወጪ ቡና ማዘጋጃና ማከማቻ ኢንዱሰትሪው 5/ Provides environmental impact assessment

አሠራር ሁኔታ ከሚመለከተው መንግሥታዊ document on export coffee processing and

፱/ እያንዳንዱን የቡና ዓይነት ተፈጥሯዊ ባህሪውን 9/ Agrees to process and export value added
ጠብቆ ወይም በሚታወቅ የቅይጥ ምጣኔ export coffee by maintaining the natural
ጥንቅር እሴት የተጨመረበት የወጪ ገበያ characteristics and official blending for
ቡና አዘጋጅቶ ወደ ውጭ ለመላክ የተስማማ፤ each coffee type while processing;

20. Domestic Coffee roaster’s Certificate of
፳. የሀገር ውስጥ ቡና ቆዪነት የብቃት ማረጋገጫ
Competence
The domestic coffee roaster’s certificate of
ማንኛውም ሰው ለሀገር ውስጥ ቡና ቆዪነት የብቃት
competence shall be issued, when any person:
፩/ በህግ ሰውነት የተሰጠው አካል ሲሆን የሥራ 1/ Has a business address for a juridical person;
has fixed asset and residence address for a
አድራሻ ያለው፤ የተፈጥሮ ሰው ከሆነ ቋሚ
natural person;
ንብረት እና የመኖሪያ አድራሻ ያለው፤
2/ Provides evidence from relevant organ
፪/ በማንኛውም ንግድ ወይም በማህበራዊ አገልግሎት
about good performance and reputation of
ወይም በተሠማራበት የሙያ መስክ መልካም
አፈጻጸምና ስም ያለው ስለመሆኑ ከሚመለከተው
አካል ማስረጃ ማምጣት የሚችል፤

ጥንቅር አዘጋጅቶ እሴት የተጨመረ ቡና maintaining the natural characteristics and

official blending for each coffee type while
ለሀገር ውስጥ ገበያ ለማቅረብ የተስማማ፤
processing;
፰/ ስለቡና ግዥ፣ ክምችት፣ ዝግጅት፣ እሴት 8/ Organizes coffee purchase, process, value

፪/ በማንኛውም ንግድ ወይም በማህበራዊ አገልግሎት 2/ Provides evidence from relevant organ
ወይም በተሠማራበት የሙያ መስክ መልካም about good performance and reputation of

ማረጋገጫ የምስክር ወረቀት የሚሰጠው:- Competence shall be issued, when any person:

፭/ ከቡና ቅጠል አዘገጃጀትና ጥራት አያያዝ ጋር 5/ Employs permanently professionals with

አገልግሎት ሰጪነት የብቃት ማረጋጋጫ የምስክር provider’s Certificate of Competence shall be

ለማስጠበቅ የተቀመጡ ግዴታዎችንና

፯/ በጥብቅ የወጪ ቡና ማከማቻ መጋዘኑ
legality of the transaction to be stored and
ስለሚከማች ቡና እና የጭነት እንቅስቃሴ
loading activity in his bonded export
በህጋዊ መንገድ ብቻ መከናወኑን አስመልክቶ
coffee warehousing; and
ሙሉ ኃላፊነት ያለበት ስለመሆኑ አውቆ
፰/ በቡና ንግድ በወንጀል ወይም በአስተዳደር 8/ if criminally or administratively convicted
ቅጣት ተወስኖበት ከነበረ ቅጣቱን የፈጸመ in coffee trade, completes the punishment; if
criminal punishment is Suspended,
፳፮. የሀገር ውስጥ ፍጆታ ቡና ጅምላ ነጋዴነት 26. domestic consumption Coffee wholesaler’s
Certificate of Competence
የብቃት ማረጋገጫ
The domestic consumption wholesaler’s
ማንኛውም ሰው የሀገር ውስጥ ፍጆታ የቡና
Certificate of Competence shall be issued,
ጅምላ ነጋዴነት የብቃት ማረጋገጫ የምስክር
when any person:
፩/ በህግ ሰውነት የተሰጠው አካል ሲሆን 1/ Has a business address for a juridical
የሥራ አድራሻ ያለው፤ የተፈጥሮ ሰው person; has fixed asset and residence
ከሆነ ቋሚ ንብረት እና የመኖሪያ
አድራሻ ያለው፤

፫/ አግባብ ባለው የክልል አካል 3/ Owns or has leased through approved
የተዘጋጀውን የቴክኒክ መስፈርት ያሟላ contract by Authorized organ a domestic

consumption coffee warehousing which
በባለቤትነት የያዘው ወይም አግባብ
meets technical standards issued by the
ባለው አካል በጸደቀ የኪራይ ውል
appropriate regional organ;
ያገኘው የሀገር ውስጥ ፍጆታ ቡና
ማከማቻ መጋዘን ያለው፤
፬/ ቡናን ለማከፋፈል ንግድ ፈቃድ 4/ Provides document from relevant
government organ about none existence or
በሚጠይቅበት ዞን፣ ከተማ ወይም ወረዳ
insufficiency of domestic consumption
የሀገር ውስጥ ፍጆታ ቡና አከፋፋይ
coffee wholesaler in zone, city or Woreda,
ስላለመኖሩ ወይም በቂ ስላለመሆኑ
where he applied for coffee wholesaler
ከሚመለከተው የመንግሥት አካል
trade license;
ማረጋገጫ ሰነድ የሚያቀርብ፤
፭/ የሀገሪቱን የቡና ጥራት መስፈርት 5/ Agrees to manage and distribute coffee as
አክብሮ ቡና ለመያዝና ለማከፋፈል per the national coffee quality standards,
የተስማማ፣
6/ Organizes coffee purchase, store and sells
፮/ ስለቡና ግዥ፣ ክምችትና ሽያጭ መረጃ
information and agrees to provide for
ለማደራጀት እና መረጃውን አግባብ
relevant executing organ upon request; and
ለመስጠት የተስማማ፤ እና
፯/ በቡና ንግድ በወንጀል ወይም 7/ if criminally or administratively convicted

በአስተዳደር ቅጣት ተወስኖበት ከነበረ
ቅጣቱን የፈጸመ ወይም የወንጀል ቅጣቱ
የተገደበለት ከሆነ ገደቡን የፈጸመ፤
፳፯. የሀገር ውስጥ ፍጆታ ቡና ችርቻሮ ነጋዴነት 27. Domestic Consumption Coffee retail
የብቃት ማረጋገጫ Trader’s certificate of Competence
ማንኛውም ሰው የሀገር ውስጥ የቡና ፍጆታ የቡና The domestic consumption retail trader’s
ችርቻሮ ነጋዴነት የብቃት ማረጋገጫ የምስክር Certificate of Competence shall be issued,

when any person:

አካል በጸደቀ የኪራይ ውል ያገኘው የንግድ contract by relevant authorized organ trade
store and special place for coffee storage in
መደብር ያለውና መደብሩ ለቡና ማስቀመጫ
the store;
የተለየ ስፍራ ያለው፤
3/ Agrees to legally handle and retail domestic
፫/ የሀገር ውስጥ ፍጆታ ቡና ለመያዝና
consumption coffee; and
ለመቸርቸር ህጋዊ ሥርዓት ጠብቆ ለመሥራት
፬/ ስለቡና ግዥ፣ ክምችት ሽያጭ መረጃ 4/ Organizes coffee purchase, store and sells
information and agrees to provide for
relevant executing organ upon request.
አስፈጻሚ አካል በተፈለገ ጊዜ ሲጠየቅ
፳፰. የቡና የንግድ ሥራ ወኪልነት የብቃት ማረጋገጫ 28. Coffee trade agent’s certificate of competence
ማንኛውም ሰው የቡና ንግድ ሥራ ወኪልነት The coffee trade agent’s Certificate of
የብቃት ማረጋገጫ የምስክር ወረቀት የሚሰጠው:- Competence shall be issued, when any person:
፩/ በህግ ሰውነት የተሰጠው አካል ሲሆን የሥራ 1/ Has a business address for a juridical person;
አድራሻ ያለው፤ የተፈጥሮ ሰው ከሆነ ቋሚ has fixed asset and residence address for a
ንብረት እና የመኖሪያ አድራሻ ያለው፤ natural person;

ከሚመለከተው አካል ማስረጃ ማምጣት የሚችል፤ professional engagement;
3/ Provides evidence for having experience
፫/ በዘርፉ ዕውቀትና ክህሎት ያለው ስለመሆኑ
and knowledge of the sector;
ማስረጃ ማቅረብ የሚችል፤
4/ Organizes coffee purchase, store, sells
፬/ ስለቡና ግዥ፣ ክምችት፣ ሽያጭና ጭነት መረጃ
and loading information and agrees to
provide for relevant executing organ upon
request; and
የተስማማ፤ እና 5/ If criminally or administratively convicted
፭/ በቡና ንግድ በተያያዘ በወንጀል ወይም in coffee trade, Completes the punishment;
በአስተዳደር ቅጣት ተወስኖበት ከነበረ ቅጣቱን
የፈጸመ ወይም የወንጀል ቅጣቱ የተገደበለት
completes the suspension;
ከሆነ ገደቡን የፈጸመ፤

፳፱. ቡና የማጓጓዝ አገልግሎት ሰጪነት የብቃት 29. Coffee Transport Service Provider’s
ማረጋገጫ Certificate of Competence
ማንኛውም ሰው ቡና የማጓጓዝ አገልግሎት The coffee transport service providers
ሰጪነት የብቃት ማረጋገጫ የምስክር ወረቀት Certificate of Competence shall be issued,
የሚሰጠው:- when any person:
፪/ ከሚመለከተው የመንግሥት አካል የጭነት 2/ Provides loading Transport Trade license
from relevant government organ;
ትራንስፖርት ንግድ ፈቃድ የሚያቀርብ፤
፫/ ባለስልጣኑ ወይም አግባብ ያለው የክልል አካል 3/ Owns or has rented through approved
contract by authorized organ loading truck,
ከሚመለከተው ትራንስፖርት ተቆጣጣሪ አካል
which meets coffee transport and loading
ጋር በመሆን የሚያወጣውን የቡና ማጓጓዝ
technical requirement issued by the
ወይም የጭነት የቴክኒክ መስፈርት የሚያሟላ
Authority or appropriate regional organ in
በባለቤትነት የያዘው ወይም አግባብ ባለው
collaboration with relevant Transport
አካል በጸደቀ የኪራይ ውል የተገኘው የጭነት
regulatory organ;
ተሽከርካሪ ያለው፤
4/ Provides evidence for having insurance to
፬/ ቡና ሲያጓጉዝ የሚደርሰውን አደጋ ለመካስ
compensate the risk of transporting coffee;
የሚያስችል የመድህን ዋስትና ያለው ስለመሆኑ
and
ማስረጃ የሚያቀርብ፤ እና
፭/ ስለሚያጓጉዘው ወይም ስለሚጭነው ቡና 5/ Agrees to take full responsibility about the
legality of coffee he is transporting and
ህጋዊነት የማረጋገጥ ሙሉ ኃላፊነት ያለበት
loading.
ስለመሆኑ አውቆ የተስማማ፤
፴. ቡና የመጫንና የማራገፍ አገልግሎት ሰጪነት 30. Coffee loading and unloading service
የብቃት ማረጋገጫ provider’s certificate of competence
The coffee loading and unloading service

ማንኛውም ሰው ቡና በመጫንና በማራገፍ
provider’s Certificate of Competence shall be
አገልግሎት ሰጪነት ለመሰማራት የብቃት
issued, when any person:
1/ Provides renewed Kebele’s residential ID
፩/ በዘመኑ የታደሰ የቀበሌ የነዋሪነት መታወቂያ
card;
የሚያቀርብ፤
፪/ ከአከባቢው አስተዳደር የመጫንና የማራገፍ 2/ Provides evidence from local
administration about forming association
አገልግሎት ለመስጠት በማህበር ተደራጅቶ
or private engagement for loading and
ፈቃድ ያለው ወይም በግል ለመሰማራት
unloading service delivery; and
የሚያስችል ማስረጃ የሚያቀርብ፤ እና

ህጋዊነት የማረጋገጥ ሙሉ ኃላፊነት ያለበት legality of coffee loading; and unloading
ስለመሆኑ አውቆ የተስማማ፤ activities.

፴፩. የቡና ጥራት ምርመራና ደረጃ ምደባ አገልግሎት 31. Coffee quality inspection and grading service
provider’s certificate of competence
ሰጪነት የብቃት ማረጋገጫ
ማንኛውም ሰው የቡና ጥራት ምርመራ እና ደረጃ The Coffee quality inspection and grading
ምደባ ላቦራቶሪ አግልግሎት ሰጪነት የብቃት service provider’s Certificate of Competence

፪/ የባለሥልጣኑን አሠራርና የአደረጃጀት የቴክኒክ 2/ Owns a coffee quality inspection and

grading center which fulfills
መስፈርት የሚያሟላ የቡና ጥራት ምርመራና
organizational and operational technical
ደረጃ ላቦራቶሪ ያለው፤
standards of the Authority;
፫/ በቡና ጥራት ምርመራና ደረጃ ምደባ ልዩ 3/ Employs permanently a professional with
ስልጠና የወሰደ ባለሙያ በቋሚነት የቀጠረ፤ special training on coffee quality
inspection and grading;
፬/ ስለቡና ጥራት፣ ደረጃና መጠን በእያንዳንዱ 4/ Organizes coffee quality, grade and
የቡና ዓይነት ከነባለቤቱ መረጃ ለማደራጀት quantity information for each coffee type
እና መረጃውን አግባብ ባለው አስፈጻሚ አካል including the owner and agrees to provide
በተጠየቀ ጊዜ ለመስጠት የተስማማ፤ for relevant executing organ upon request;
፭/ በህግ የሀገሪቱን የቡና ጥራት ደረጃ ለማስጠበቅ 5/ Agrees to work with the national export
የተቀመጡ ግዴታዎችንና መስፈርቶችን ጠብቆ coffee quality standards set by a law and
ብሄራዊ ጥቅምን ከሚጎዳ ተግባር ተቆጥቦ restrains from harming national interest;
and
ለመሥራት የተስማማ፤ እና
6/ if criminally or administratively convicted
፮/ በቡና ንግድ በወንጀል ወይም በአስተዳደር
in coffee trade, Completes the
punishment; if criminal punishment is
Suspended, completes the suspension;

ንዑስ ክፍል ሁለት Sub-section two

የብቃት ማረጋገጫ ምስክር ወረቀት አሰጣጥና አስተዳደር Issuance and administration of Certificate
of Competence
፴፪. የብቃት ማረጋገጫ የምስክር ወረቀት ለማግኘት 32. Application for Certificate of Competence
ስለሚቀርብ ማመልከቻ
፩/ የብቃት ማረጋገጫ የምስክር ወረቀት ለማግኘት 1/ Any Person who wants to obtain the
የሚፈልግ ማንኛውም ሰው:-

certificate of competence should:
ሀ) በወጪ ቡና ማዘጋጀትና ማከማቸት፣ ቡና a) submit application to the Authority, if
ላኪነት፣ የወጪ ቡና ቆዪነት፣ የጥብቅ ቡና he wants to engage in export coffee
ማከማችት፣ በወጪ ቡና ንግድ ሥራ processing and warehousing service,
ወኪልነት፣ በጥራት ምርመራና ደረጃ ምደባ coffee exporting, export coffee roasting
አገልግሎት ሰጪነት ሥራ የሚሰማራ ከሆነ or roasting and grinding, bonded
ማመልከቻውን ለባለሥልጣኑ ማቅረብ

warehousing service, export trading
agent, coffee quality inspecting and
አለበት፡፡
grading service or any other activities
related with these.
ለ) የቡና አቅራቢነት፣ የሀገር ውስጥ ቡና b) submit application to the appropriate
ቆዪነት፣ በአቅርቦት ቡና ማዘጋጀትና regional organ, if he wants to engage in

coffee supplying, domestic coffee
ማከማቸት፣ በቡና ገለባ አቀነባባሪነት፣
consumption roasting, supply coffee
በቡና ቅጠል አቀነባባሪነት፣ በሀገር ውስጥ
processing and warehousing, coffee
ቡና ፍጆታ ጅምላ ነጋዴነት፣ በሀገር
husk processing, coffee leaf processing,
ውስጥ ፍጆታ ቡና ችርቻሪ ነጋዴነት፣
domestic coffee consumption
በሀገር ውስጥ ቡና ንግድ ወኪልነት፣ የቡና
wholesaling, domestic consumption
ማጓጓዝ አገልግሎት ሰጪነት፣ የቡና retailing trade, domestic consumption
መጫንና ማራገፍ አገልግሎት ሰጪነት trading agent, coffee transporting
ከሆነ፣ ማመልከቻውን አግባብ ላለው service, coffee loading and unloading
የክልል አካል ማቅረብ አለበት፡፡ service and other related activities with
these.
ሐ) ከማመልከቻው ጋር የተጠየቀውን የብቃት c) Provide with the application, evidences
ማረጋገጫ የምስክር ወረቀት ለማግኘት for fulfilling the requirements provided
በዚህ ደንብ የተደነገጉት መስፈርቶች by this Regulation and provide other

information according to directive to be
መሟላታቸውን የሚያሳዩ ማስረጃዎችንና
issued by the Authority or the
ባለስልጣኑ ወይም አግባብ ያለው የክልል
appropriate regional organ to obtain the
አካል በሚያወጣው መመሪያ መሠረት
requested certificate of competence.
የሚጠየቁ ሌሎች መረጃዎችን አሟልቶ
ማቅረብ አለበት፡፡

፪/ ባለሥልጣኑ ወይም አግባብ ያለው የክልል አካል 2/ The Authority or the appropriate regional
ማመልከቻው ከቀረበለት ቀን ጀምሮ በ፲፭ organ shall decide on the application
የሥራ ቀናት ውስጥ አጣርቶ የብቃት ማረጋገጫ within 15 working days from the date of
መስጠት ወይም የማይጋባው መሆኑ የሚገልፅ receipt of the application;
ውሳኔ መስጠት ይኖርበታል፤

፫/ ባለሥልጣኑ ወይም አግባብ ያለው የክልል አካል 3/ When the Authority or the appropriate
regional organ rejects the application for
አመልካቹ የብቃት ማረጋገጫው የማይገባው
certificate of competence, it shall provide a
መሆኑን በወሰነ ጊዜ የክልከላውን ምክንያት
letter for the applicant stating the detailed
በውሳኔው ላይ በዝርዝር በማስቀመጥ
reasons in written form;
ለአመልካቹ በጽሁፍ መስጠት ይኖርበታል፤
፬/ ባለሥልጣኑ ወይም አግባብ ያለው የክልል 4/ Any applicant who is dissatisfied with the
decision of the Authority or the appropriate
አካል በሰጠው ውሳኔ ቅር የተሰኘ አመልካች
regional organ may appeal to appropriate
ውሳኔው በተሰጠው በ፴ የሥራ ቀናት ውስጥ
court within 30 working days from the date
ለሚመለከተው ፍርድ ቤት ይግባኝ ማቅረብ
of receipt of the decision.
ይችላል፡፡
33. Renewal of certificate of competence
፴፫. የብቃት ማረጋገጫ ስለማሳደስ
1/ Any person who received certificate of
፩/ በዚህ ደንብ መሠረት የብቃት ማረጋገጫ
competence shall renew the certificate of
የምስክር ወረቀት የተሰጠው ማንኛውም ሰው
competence annually within the specified
በሚቀመጥ የጊዜ ገደብ የብቃት ማረጋገጫ
time.
የምስክር ወረቀቱን በየአመቱ ማሳደስ
ይኖርበታል፡፡
፪/ በተቀመጠው የጊዜ ገደብ የብቃት ማረጋገጫ 2/ If certificate of competence is not renewed
during the specified time limit, it may be
የምስክር ወረቀቱን ያላሳደሰ እንደሆነ ይህን
renewed in extra time with fine penalty
ደንብ ተከትሎ በሚወሰን መመሪያ በሚወሰን
decided by the regulation of the council of
ተጨማሪ ጊዜ እና በሚኒስትሮች ምክር ቤት
ministers.
ደንብ በሚወሰን የቅጣት መጠን በገንዘብ
ቅጣት ማሳደስ ይችላል፡፡
፴፬. የብቃት ማረጋገጫ የምስክር ወረቀት ስለማገድ 34. Suspension and Revocation of Certificate of
እና መሰረዝ Competence
1/ Where a person issued with a certificate

፩/ በዚህ ደንብ መሠረት የብቃት ማረጋገጫ
of competence in accordance with this
የምስክር ወረቀት የተሰጠው ማንኛውም ሰው:-
Regulation fails to:
ሀ) የምስክር ወረቀቱ የተሰጠባቸውን መስፈር a) maintain the conditions upon the basis

ለ) በተቀመጠው የጊዜ ገደብ ውስጥ የብቃት b) renew the certificate of competence
ማረጋገጫ የምስክር ወረቀቱን ያላሳደሰ within time limit, or
እንደሆነ፣ ወይም
c) Obey the provisions of the
ሐ) የአዋጁን ወይም የዚህን ደንብ
proclamation or this Regulation or
ድንጋጌዎች ወይም አዋጁንና ይህን ደንብ
directives;
ለማስፈጸም የወጡ መመሪዎችን ተላልፎ
ሲገኝ፤
the Authority or the appropriate regional
ባለሥልጣኑ ወይም አግባብ ያለው የክልል
organ by orders to rectify the failures
አካል ጉድለቱን እንዲያስተካክል በማዘዝ
may suspend the certificate of
የምስክር ወረቀቱን አግዶ ሊያቆየው ይችላል፤
competence and inform relevant organ in
መታገዱንም ለሚመለከታቸው አካላት
written form.
በጽሁፍ ያሳውቃል፡፡
፪/ በዚህ ደንብ መሠረት የተሰጠ የብቃት 2/ Where the holder of a certificate of

competence issued in accordance with this
ማረጋገጫ የምስክር ወረቀት የያዘ ሰው:-
Regulation:
ሀ) የምስክር ወረቀትቱን ያገኘው ሀሰተኛ a) found to have obtained the certificate
ማስረጃ በማቅረብ ሆኖ ከተገኘ፣ of competence upon presentation of

false evidence,
ለ) በዚህ አንቀጽ ንዑስ አንቀጽ (፩) መሠረት b) fails to rectify the irregularities which
caused the suspension of the certificate
ለምስክር ወረቀቱ መታገድ ምክንያት
of competence pursuant to sub-article
የሆነውን ጉድለት በተሰጠው የጊዜ ገደብ
(1) of this Article within the specified
ውስጥ ማስተካከል ካልቻለ፣ ወይም
time limit, or
c) has committed a criminal offense in
ሐ) በአዋጁ አንቀጽ ፲፱ የተደነገገውን
violation of Article 19 of the

proclamation;
ከተፈረደበት፤
የብቃት ማረጋገጫ የምስክር ወረቀቱ the Authority or the appropriate regional organ
may revoke the certificate of competence.
በባሥስልጣኑ ወይም አግባብነት ባለው
የክልል አካል ይሰረዛል፡፡
፫/ በባለሥልጣኑ ወይም አግባብ ባለው የክልል 3/ A person whose certificate of competence
is suspended or revoked by the Authority
አካል የብቃት ማረጋገጫ የምስክር ወረቀት
or appropriate regional organ may appeal
የታገደበት ወይም የተሰረዘበት ሰው ቅሬታ
to appropriate court within 60 working
ካለው ውሳኔው ከደረሰው ቀን ጀምሮ ባሉት
days from the date of receipt of the
፷ የሥራ ቀናት ውስጥ ለሚመለከተው ፍርድ
decision.
ቤት ይግባኝ ማቅረብ ይችላል፡፡

፴፭. የእግድ ወይም የመሠረዝ ውጤት 35. Consequences of Suspension or Revocation

፩/ በዚህ ደንብ አንቀጽ ፴፬ መሠረት የብቃት 1/ A person whose certificate of competence
ማረጋገጫ የምስክር ወረቀት የታገደበት has been suspended or revoked pursuant to

Article 34 of this Regulation shall not
ወይም የተሰረዘበት ሰው በዕገዳው ወይም
engage in coffee transaction irrespective of
በመሰረዙ ላይ የቀረበው ይግባኝ በመታየት
the fact that his appeal against the

Article, a person whose certificate of

የቡና ጥራት እና ግብይት ቁጥጥር አሠራር
INSPECTION PROCESS
፴፮. የቡና ጥራት ቁጥጥር አሠራር 36. Coffee Quality Inspection Process
፩/ ቡና ሲለቀም፣ ሲዘጋጅ፣ ሲከማች፣ ሲጓጓዝ 1/ Monitoring and inspection shall be made
ተፈጥሯዊ ጥራት ተጠብቆ ለገበያ እንዲቀርብ during Coffee picking, processing,
ክትትልና ቁጥጥር ይደረጋል፡፡ storing, drying and transporting to

preserve the natural quality.
፪/ በዚህ አንቀጽ ንዑስ አንቀጽ (፩) የተደነገገው 2/ Without prejudice the provisions of sub-

፬/ ጀንፈል ቡና በተዘጋጀው የአደራረቅ የቴክኒክ 4/ Coffee with pulp shall be Monitored and

፮/ የአቅርቦት ቡና ከተመረተበት አካባቢ ታሽጎ 6/ Raw Coffee inspection shall be
undertaken before supply coffee
ከመሸኘቱ በፊት ለባለቤቱ የሚመለስ ወካይ
dispatched from coffee growing area by

with quality, packed by standard packaging
በጥራት ስለመቀነባበሩ፣ በሚፈለገው ደረጃ
and stored according to the technical
ስለመታሸጉና ስለመከማቸቱ ክትትልና ቁጥጥር
requirements set.
ይደረጋል፡፡
፱/ በማንኛውም መልኩ ቡና የሚጫንበት የጭነት 9/ Any form of coffee loading truck or
ተሸከርካሪ ወይም ኮንቴነር ቡናን ለመጫን container shall be monitored and

፴፯. የቡና ግብይት ቁጥጥር 37. Inspection of Coffee transaction process

፩/ በማንኛውም የቡና አምራች የቀይ እሸት ቡና 1/ When red cherry coffee is supplied by any
ለታጠበ ቡና ዝግጅት የሚቀርብ ከሆነ coffee producer for washed coffee process,
ከተለቀመበት ጊዜ ጀምሮ ከስምንት ሰዓት shall be monitored and inspected that it is

፪/ በማንኛውም የቡና አምራች የሚዘጋጅ የጀንፈል 2/ Coffee with pulp prepared by any coffee
ቡና ባለሥልጣኑ ወይም አግባብ ያለው የክልል producer shall be monitored and inspected
አካል በሚያወጣው የቴክኒክ መስፈርት መሠረት that it is stored in quality coffee processing
ጥራቱን በጠበቀ ማዘጋጃና ማከማቻ ኢንዱስትሪ warehousing industry according to technical
እንዲከማች እና ሰለመከማቸቱ ክትትልና ቁጥጥር standard set by Authority or appropriate
ይደረጋል፡፡ regional organ.
፫/ በዚህ አንቀጽ ንዑስ አንቀት (፪) የተደነገገው 3/ Without prejudice to sub article (2) of this

ስለመሸጡ ክትትልና ቁጥጥር ይደረጋል፡፡
7/ Any person, who processed unwashed
፯/ ማንኛውም ቡና አዘጋጅቶ ለወጪ ገበያ
coffee for export market, shall be monitored
የሚያቀርብ ሰው ለወጪ ገበያ ያዘጋጀውን
and inspected that he sells until February 7
ያልታጠበ ቡና የምርት ዘመኑ ማጠናቀቂያ
(Tir 30) ,the end of coffee production
ጊዜ እስከሆነው ጥር ፴ ቀን ድረስ ስለመሸጡ

ክትትልና ቁጥጥር ይደረጋል፡፡
፰/ በባለስልጣኑ የተጠቀሰው የጊዜ ገደብ ያለበቂ
8/ When the Authority confirms that the time
limit is not met with sufficient ground, may

ኢንዱስትሪዎች ውስጥ የሚኖረውን የቡና
industries, shall be counted once in a year in
ክምችት እንደአግባብነቱ በባለስልጣኑ ወይም

አስተዳዳራዊ እርምጃ እንዲወሰድ ይደረጋል፡፡
11/ Any supply and export coffee processing
፲፩/ ማናቸውም የአቅርቦትና የወጪ ቡና
and warehousing industry, shall be
ማዘጋጃና ማከማቻ ኢንዱስትሪ ከተገልጋዩ
monitored and inspected that it provides
ጋር በገባው ውል መሠረት ላዘጋጀው ቡና
certificate for processed coffee, verifying
በኢንዱስትሪው ስለመዘጋጀቱ ማረጋገጫ
the processing of it at its industry in

ስለመሸኘቱና ስለመድረሱ ክትትልና ቁጥጥር
private use coffee amount that can be
ይደረጋል፤ ማንኛውም ሰው ማጓጓዝ transported by any person, shall decided by

፲፫/ የወጪ ገበያ ቡና አስፈላጊውን መስፈርት 13/ Export coffee, after fulfilling the necessary

፴፰. የተከለከሉ አሰራሮች 38. Prohibitions
በአዋጁ የተከለከሉ ተግባራትና አሠራሮች Without prejudice to the prohibitions provided

in the proclamation, for any coffee producer or

፪/ ቡናን ክብደቱ እንዲጨምር በአፈር ማሸት፣ 2/ Jumble coffee with soil or mix coffee with
alien substances or Place coffee into water
ከባዕድ አካላት ጋር ማደባለቅ ወይም በውሃ
with intent to increase its weight;
መዘፍዘፍ፤
፫/ ቡናን በመንገድ ወይም በመሬት ላይ 3/ Scatter coffee on road for pulping; Crashing
መጨፍለቅ ወይም ለማድረቅ ማስጣት ወይም coffee on asphalt road or processing coffee
መርቡሽ ቡና ማዘጋጀት ወይም በማንኛውም with backward traditional method and
ሁኔታ የቡናውን ጣዕምና ጥራት ከሚያበላሽ adulterating with unknown elements;
ባዕድ ነገር እንዲነካካ ማድረግ፤

፬/ ለቡና ተክሉ አገልገሎቱን ያላጠናቀቀ ቅጠል 4/ collect green leaves by force and supply it to
ሸምጥጦ ለገበያ ማቅረብ፤ the market;
፭/ ባለስልጣኑ ወይም አግባብ ያለው የክልል 5/ Use coffee sacks or equipment other than
አካል አገልግሎት ላይ እንዲውል ከሚፈቅደው those approved by the Authority or the

7/ Use Imported raw coffee for domestic

እንዲገባ የተፈቀደውን ቡና በማንኛውም
unless permitted in special circumstance;
መልኩ ለሀገር ውስጥ ፍጆታ ማዋል እና
በጥሬው መልክ መልሶ ወደ ወጪ መላክ፤

አካል ፈቃድ ውጪ የወጪ ቡና በማንኛውም without permission of the Authority or

appropriate regional organ;
መደብር ወይም ቦታ ማከማቸት ወይም
መገበያየት፤
10/ Sell domestic consumption coffee at
፲/ ለውጪ ገበያ የተዘጋጀ ቡና ለመሸጥ
permitted places to sell export coffee; and
በሚፈቀዱ ቦታዎች ለሀገር ውስጥ ፍጆታ
የተዘጋጀ ቡና መሸጥ፤ እና
11/ Transact at first level coffee transaction
፲፩/ አግባብ ካለው የክልል አካል ህጋዊ ፈቃድ
centers without license obtained from
ሳይሰጠው በመጀመሪያ ደረጃ የግብይት
ማዕከል ገብቶ መገበያየት፤
የተከለከለ ነው፡፡
፴፱. የቡና ጥራትና ግብይት ተቆጣጣሪዎችን ስለመመደብ 39. Assignment of Coffee Quality and
Transaction Inspectors
፩/ እንደአግባብነቱ ባለሥልጣኑና አግባብ ያለው 1/ The Authority and the appropriate regional
የክልል አካል የቡና የጥራት ተቆጣጣሪ እና organs shall, as may be appropriate, assign
የቡና ግብይት ተቆጣጣሪ ይመድባሉ፡፡ coffee quality and transaction inspectors.
፪/ በዚህ አንቀጽ ንዑስ አንቀጽ (፩) ድንጋጌ 2/ A person to be assigned as inspector

መሠረት የሚመደብ የቡና ጥራት እና የቡና pursuant to sub-article (1) of this Article
ግብይት ተቆጣጣሪ በቂ ዕውቀት፣ ክህሎት እና shall have adequate knowledge and skill
መልካም ስነ ምግባር ያለው መሆን አለበት፡፡ with good ethical background.
፵. የቡና ጥራት ተቆጣጣሪ ሥልጣንና ተግባር 40. Powers and Duties of Coffee Quality
Inspector
፩/ በዚህ ደንብ አንቀጽ ፴፱ መሠረት የተመደበ የቡና 1/ A coffee quality inspector assigned
ጥራት ተቆጣጣሪ ስለቡና ጥራት ቁጥጥር pursuant to Article 39 of this Regulation,
የተደነገጉ ድንጋጌዎች መከበራቸውን ለማረጋገጥ shall have the following powers and duties
የሚከተለው ስልጣን ይኖረዋል:- to inspect and control:
a) coffee quality delivered to processing

ሀ) በመጀመሪያ ደረጃ የግብይት ማዕከላት እና
industries and primary coffee
በቡና ማዘጋጃ ኢንዱስትሪዎች የሚቀርበውን
transaction centers;
ቡና ጥራት ሁኔታ መከታተል፣ መቆጣጠር፤

ለ/ አነስተኛ ይዞታ ባላቸው ቡና አምራች አርሶ b) the activities of harvesting, processing,

አደሮችና ቡና አልሚ ባለሃብቶች storing and transporting performed by
የሚካሄደውን የቡና አዘገጃጀት፣ አከመቻቸት small scale coffee farmers and commercial
coffee farm investors,
እና የማጓጓዝ ሂደት መከታተል መቆጣጠር፤
ሐ/ በቡና አቅራቢዎች፣ በቡና ላኪዎች፣ በኅብረት c) coffee processing and storing activities by
ሥራ ማህበራት፣ በቡና ቆዪዎች እና በቡና coffee suppliers, exporters, cooperatives,
ማዘጋጃና ማከማቻ ኢንዱስትሪዎች የሚከናወነ coffee roasters at coffee processing and

፵፩. የቡና ግብይት ተቆጣጣሪ ሥልጣንና ተግባራት 41. Powers and Duties of Coffee Transaction
Inspector
፩/ የቡና ግብይት ተቆጣጣሪ በአዋጁ፣ በዚህ ደንብ 1/ To assure the proper implementation of the

ቀ) በየደረጃው የሚጓጓዝ የአቅርቦት፣ የሀገር i) inspect Packing and Sealing of supply
ውስጥ ፍጆታና የወጪ ንግድ ቡና coffee, domestic consumption coffee and

export coffee transported at any level;
አጣርቶ በፕሎምፕ በማሸግ የመሸኘት፣
በ/ ቡና የሚያጓጉዝ ተሸከርካሪ በማስቆም j) Stop any vehicle transporting coffee
መፈተሽና አግባብነት ያላቸው ሠነዶች and demand the presentation of

pertinent documents, and
እንዲቀርቡለት የመጠየቅ፣ እና
ተ) በኬላ ላይ የህገወጥ ቡና ንግድና ዝውውር k) Control Illegal coffee trade and
ቁጥጥር የማካሄድ፣ movement at check points,
፪/ የቡና ግብይት ተቆጣጣሪ ህጉን በመጣስ ህገወጥ 2/ Where a coffee transaction inspector
የቡና ግብይት ድርጊት ተፈጽሟል ብሎ በበቂ suspects with sufficient ground that un
ሁኔታ ሲጠረጠር አግባብነት ባለው ህግ መሠረት illegal act committed, may seize the coffee
በፍርድ ቤት ትዕዛዝ ወይም አስቸኳይ ሁኔታ with court warrant or without court warrant
ሲኖር ያለፍርድ ቤት ትዕዛዝ ከፍትህ አካላት in forcing circumstances in accordance
ወይም ከፀጥታ አካላት ጋር በመተባበር ደረሰኝ with criminal procedure law, in
ሰጥቶ ቡናውን ይይዛል ወይም የቡናውን ናሙና collaboration with relevant justice and
ወስዶ ቡናው የተከማቸበትን ቦታ ያሽጋል፡፡ security organs, against issuance of receipt

or take a sample of the coffee and seal the

፫/ የቡና ግብይት ተቆጣጣሪ ከጠቅላላ የመጫን 3/ Where coffee transaction inspector
ክብደቱ መጠን ግማሽና ከዚያ በላይ ቡና በመጫን suspects, illegal act committed by a vehicle
ተሸከሪካሪው ህገ ወጥ ተግባር መፈፀሙን በበቂ loaded with coffee half and above of its
ምክንያት ሲያምን እና አግባብነት ባለው total loading capacity, shall seize the
vehicle, against issuance of receipt, with
የወንጀል ሥነ ሥርዓት ህግ መሠረት በፍርድ ቤት
court warrant or without court warrant in
ትዕዛዝ ወይም አስቸኳይ ሁኔታ ሲኖር ያለፍርድ
forcing circumstance in accordance with
ቤት ትዕዛዝ ከፍትህ አካላት ወይም ከፀጥታ
criminal procedure law, in collaboration
አካላት ጋር በመተባበር የመረከቢያ ደረሰኝ
with relevant justice and security organs.
በመስጠት ተሸከርካሪውን ይይዛል፤
፬/ የቡና ግብይት ተቆጣጣሪ በዚህ አንቀጽ ንዑስ 4/ The coffee transaction inspector shall
አንቀጽ (፪) እና (፫) መሠረት ስለወሰደው immediately report to the Authority or

appropriate regional organ about the action
እርምጃ ወዲያውኑ ለባለስልጣኑ ወይም አግባብ
taken pursuant to sub-article (2) and (3) of
ላለው የክልል አካል ሪፖርት ያድርጋል፤ በዚህ
this Article and follow the instructions of
ደንብ መሠረት መወሰድ ስላለባቸው ተከታይ
the Authority or appropriate regional organ
እርምጃዎች ከባለስልጣኑ ወይም አግባብነት
for taking subsequent actions.
ካለው የክልሉ አካል የሚሰጠውን መመሪያ
ይፈጽማል፡፡
፭/ የቡና ግብይት ተቆጣጣሪ የቡና ግብይት 5/ Coffee transaction inspector shall provide
timely report on coffee transaction
ቁጥጥርን በሚመለከት ለሚመለከተው አካል
inspection to relevant organ.
ወቅታዊ ሪፖርት ያቀርባል፡፡
42. Whistle blowing Illegal Acts
፵፪. ህገወጥ ድርጊቶችን ስለመጠቆም
1/ Any person, who is aware of an illegal act
፩/ ማንኛውም ሰው በቡና አዘገጃጀት፣ ክምችት፣
committed in the course of processing,
ማጓጓዝ ወይም ግብይት ሂደት ህገወጥ ድርጊት
storing or transporting, or transaction may
መፈጸሙን ሲያውቅ በአካባቢው ለሚገኝ የቡና
inform in physical presence, in writing, with
ግብይት ተቆጣጣሪ ወይም ለባለስልጣኑ ወይም
an electronic message to the nearest coffee
አግባብነት ላለው የክልል አካል ወይም የጸጥታ
quality and transaction inspector or regional
አካላት በአካል፣ በጽሁፍ፣ በኤሌክትሮኒክስ
security organs, to the Authority or the
መልዕክት መጠቆም ይችላል፡፡
፪/ በዚህ አንቀጽ ንዑስ አንቀጽ (፩) መሠረት 2/ Any person who has submitted a report in
ጥቆማ አቅርቦ ሕገወጥ ድርጊት የተፈጸመበትን accordance with sub-article (1) of this Article,
ቡና ያስያዘ እና የያዘ ማንኛውም ሰው በዚህ that led to the seizure of coffee subject to the

፵፫. ስለተያዘ ቡና 43. Seized Coffee

፩/ በበቂ ጥርጣሬ ህገወጥ ነው ተብሎ የተያዘ ቡና 1/ Coffee seized with reasonable suspicion of
ተጣርቶ ውሳኔ እስከሚያገኝ ድረስ:- illegality, until decisions made, shall be:
ሀ) ቀይ እሸት ቡና ከሆነ በ፰ ሰዓት ውስጥ a) Supplied to nearest first level coffee
በአቅራቢያው ወደሚገኝ የመጀመሪያ ደረጃ transaction center within 8 hours and
የቡና ግብይት ማዕከል ቀርቦ በዕለቱ መሸጫ sold with existing sell price and shall be
ዋጋ ተሽጦ በወረዳው በሚገኝ አግባብ ባለው saved in closed bank account opened by

በ፵፰ ሰዓት ውስጥ በአቅራቢያው ወደሚገኝ
Commodity Exchange warehouse within
የኢትዮጵያ ምርት ገበያ መጋዘን መጠንና
48 hours, if it is supply or export coffee.
ደረጃው ተለይቶ በህጋዊ ደረሠኝ ገቢ ሆኖ
መቀመጥ አለበት፡፡
መ) ለቡናው ባለቤት ወይም ተወካይ የተያዘው d) Provided with legal receipt for the owner
or representative by identifying seized
ቡና ዓይነትና መጠን ተገልጾ አንደዚሁም
coffee type, quantity and in addition its
የአቅርቦት ወይም የወጪ ገበያ ቡና ከሆነ
grade when it is supply or export coffee.
የቡናው ደረጃም ጭምር ተገልጾ ህጋዊ
ደረሰኝ መሰጠት አለበት፡፡
፪/ በህገ ወጥ መንገድ ቡና በመጫን ወይም 2/ Any vehicle, loading and transporting coffee,
በማጓጓዝ በበቂ ሁኔታ ተጠርጥሮ የተያዘ seized with reasonable suspicion of

illegality, shall be stayed at relevant nearby
ተሸከርካሪ ተጣርቶ ውሳኔ እስኪሰጥ ድረስ
police station, until investigation and
በአቅራቢያው በሚገኝ የሚመለከተው የፖሊስ
decision is made.
አካል ተይዞ መቆየት አለበት፡፡
፫/ ማንኛውም አሽከርካሪ እንዲጭን ከተፈቀደለት 3/ When any driver seized loading extra
ቡና ውጪ በየትኛውም የተሸከርካሪው አካል coffee or any other load or product on any

parts of the vehicle beyond permitted coffee
ላይ ተጨማሪ ቡና ወይም ቡና ያልሆነ ሌላ
load, the extra load shall be stored by
ጭነት ወይም ምርት አዳብሎ ጭኖ የተያዘ
identifying its quantity and type in
እንደሆነ በተጨማሪነት ለተጫነው ቡና ምርት
accordance with sub article (1) (b) and (c) of
እንደአግባብነቱ በዚህ አንቀጽ ንኡስ አንቀጽ
this Article as may appropriately so.
(፩)(ለ)እና(ሐ) በተደነገገው መሰረት ይፈጸማል፡፡

፬/ ማንኛውም ሰው በዚህ አንቀጽ በተደነገገው 4/ Any person, who seizes coffee, vehicle,
መሠረት ህገ ወጥ ተግባር የተፈጸመበት ቡና extra load and other product, shall provide
ወይም ተሸከርካሪ የያዘ ሰው ለባለስልጣኑ the necessary information and evidence

within 48 hours to the Authority or
ወይም አግባብ ላለው የክልል አካል ለውሳኔ
አስፈላጊ የሆነ መረጃና ማስረጃ አያይዞ በ፵፰
ሰዓት ውስጥ ማቅረብ አለበት፡፡
5/ Any person, who has objection, about seized
፭/ በዚህ ደንብ መሠረት ስለተያዘ ቡና፣
coffee, vehicle, extra load or product
ተሽከርካሪ፣ ተጨማሪ ጭነት ወይም ምርት
pursuant to this Regulation, may:
በሚመለከት ቅሬታ ያለው ማንኛውም ሰው
ቅሬታውን በማስረጃ አስደግፎ በሚከተለው
))
አግባብ ሊያቀርብ ይችላል:-

a) Submits his objection with evidence,
ሀ) ቀይ እሸት ወይም ጀንፈል ቡና ወይም ከዚህ
within three working days starting from the
ጋር የተያያዘ ተሽከርካሪ፣ ተጨማሪ ጭነት
date received the receipt, to the Authority
ወይም ምርት ሲሆን ደረሰኝ ከተቀበለበት
or the appropriate regional organ of the
ቀን ጀምሮ በሦስት የሥራ ቀናት ውስጥ Woreda and city administration level,
በወረዳ ወይም በከተማ አስተዳደር ደረጃ ላለ when it is red cherry coffee or coffee with
ባለስልጣን ወይም አግባብ ላለው የክልል pulp or vehicle or additional load or
አካል ሊያቀርብ ይችላል፣ product related with this,
b) Submit his objection with evidence, within

ለ) የአቅርቦት ወይም የወጪ ገበያ ቡና ወይም
five working days starting from the date
ከዚህ ጋር የተያያዘ ተሽከርካሪ፣ ተጨማሪ
received the receipt, to the Authority or the
ጭነት ወይም ምርት ሲሆን ደረሰኝ
appropriate regional organ of the Zone and
ከተቀበለበት ቀን ጀምሮ በአምስት የሥራ
city administration at the level of zone,
ቀናት ውስጥ ለዞን ወይም በዞን ደረጃ when it is supply or export coffee or
ለሚገኝ የከተማ አስተዳደር ባለስልጣን vehicle or additional load or product
ወይም አግባብ ላለው የክልል አካል related with this,
ቅሬታውን ሊያቀርብ ይችላል፣

6/ Any decision about seized coffee, vehicle,
፮/ የተያዘ ቡናን፣ ተሽከርካሪን፣ ተጨማሪ ጭነትን
extra load shall be made by a committee led
ወይም ምርትን አስመልክቶ የሚሰጥ ውሳኔ
by a high level official of the Authority or
በባለስልጣኑ ወይም አግባብ ባለው የክልል
the appropriate regional organ of any level.
አካል የበላይ ኃላፊ በሚመራ ኮሚቴ ይሆናል፡፡
፯/ በዚህ አንቀጽ ንዑስ አንቀጽ (፭)(ሀ) እና (ለ) 7/ The organ, who received complaint as per
መሠረት ቅሬታ የቀረበለት አካል የቀረቡለትን sub-Article (5) (a) and (b ) of this Article,
after examining the information and
መረጃዎችና ማስረጃዎች መርምሮ:-
evidence provided, shall:

ሀ) ቀይ እሸት ወይም ጀንፈል ቡና ወይም ከዚህ a) Deliver decision and immediately notify
ጋር የተያያዘ ተሽከርካሪ፣ ተጨማሪ ጭነት the applicant in written form within two
ወይም ምርት ሲሆን የቅሬታ ማቅረቢያው ቀን working days after the expiry of the
በተጠናቀቀ በሁለት የሥራ ቀናት ውስጥ complaint date, when it is a red cherry
coffee or coffee with pulp or related

ለ) የአቅርቦት ወይም የወጪ ገበያ ቡና ወይም b) Deliver decision and immediately notify
ከዚህ ጋር የተያያዘ ተሽከርካሪ፣ ተጨማሪ the applicant, in written form, within

three working days after the expiry of

the complaint date, when it is supply or

ለተያዘበት ሰው በጽሁፍ ማሳወቅ አለበት፣
c) Submit a copy of the decision, with

complete evidence, to the Authority or
ወይም አግባብ ላለው የክልል አካል በአምስት
appropriate regional organ within five
የሥራ ቀናት ውስጥ ማድረስ አለበት፡፡

፰/ በዚህ አንቀጽ ንዑስ አንቀጽ (፯) በተሰጠው 8/ A person, who has compliant against the
ውሳኔ ቅሬታ ያለው ሰው:- decision taken under sub-Article (7) of this
Article, may submit within five working
days, to:
ሀ) ቀይ እሸት ወይም ጀንፈል ቡና ወይም ከዚህ a) The Appropriate regional organ of the

coffee with pulp or related vehicle, or
ወይም ምርት ከሆነ በዞን ደረጃ ላለው
extra load or product,

ለ) የአቅርቦት ቡና ሆኖ ቅሬታ አቅራቢው ቡና b) The Appropriate regional organ, if it is
አቅራቢ ከሆነ አግባብ ላለው የክልል አካል፣ supply coffee and the compliant is coffee
supplier,
ሐ) የአቅርቦት ወይም የወጪ ገበያ ቡና ሆኖ c) The Authority, if it is supply or export
coffee and the compliant is coffee exporter.
ቅሬታ አቅራቢው ቡና ላኪ ከሆነ
ለባለስልጣኑ፤
በአምስት የሥራ ቀናት ቅሬታውን ማቅረብ
አለበት፡፡
፱/ በዚህ አንቀጽ ንዑስ አንቀጽ (፰) መሠረት 9/ The Authority or the relevant regional
ቅሬታ የቀረበለት ባለሥልጣን ወይም አግባብ organ, who receives the complaint in
accordance with sub-article (8) of this
ያለው የክልል አካል አቤቱታውን በአምስት
Article, after examining the application,
የስራ ቀናት ውስጥ መርምሮ:-
within five working days:

ሀ) የተሰጠውን ውሳኔ የሚሽር ከሆነ ወዲያው a) Shall immediately return the seized
የተያዘውን ቡና፣ ተሽከርካሪ፣ ተጨማሪ coffee, vehicle, extra load or product or
ጭነት ወይም ምርት ወይም የተሸጠበትን proceedings of sale to the applicant, if it

decided to reverse the decision given;
ገንዘብ ለአመልካቹ እንዲመለስ ማድረግ
አለበት፣
b) Shall uphold the decision and notify the
ለ) የተሰጠውን ውሳኔ ካጸናው ወይም ቅሬታ
complaint after delivery of the decision,
በጊዜ ገደቡ ያልቀረበ እንደሆነ የተሰጠውን
if it sustains the decision given or

time limit;
ሐ) በዚህ ንኡስ አንቀጽ (ለ) መሠረት ውሳኔውን c) Shall deposit, in a closed bank account, the

ተሸከርካሪው ወይም ተጨማሪ ጭነቱ ወይም provided under sub article (10) of this article,
ምርቱ በግልጽ ጨረታ ተሽጦ ከእነዚህ about coffee or vehicle, extra load or product
የሚገኝ ገንዘብ በዝግ የባንክ ሂሳብ which its illegality affirmed by the decision
እንዲቀመጥ ማድረግ አለበት፡፡ pursuant to paragraph (b) of this sub article.
፲/ በዚህ አንቀጽ ንዑስ አንቀጽ (፱)(ለ) የተመለከተውን 10/ The Coffee, vehicle, extra load or product
ውሳኔ የሚቃወም የቡና፣ የተሽከርካሪ፣ የተጨማሪ owner, who objects the decision given
ጭነት ወይም የምርት ባለቤት ውሳኔው በደረሰው under Sub-Article 9 (b) of this Article,
በ፷ (ስልሳ) የሥራ ቀናት ውስጥ ለሚመለከተው may appeal to the relevant court, within 60
ፍርድ ቤት ይግባኝ ማቅረብ አለበት፡፡ (sixty) working days of the decision.
፲፩/ በዚህ አንቀጽ ንዑስ አንቀጽ (፲) መሠረት 11/ Where the Court to which an application is
አቤቱታ የቀረበለት ፍርድ ቤት እንደአግባቡ submitted pursuant to sub-article (10) of

this Article as appropriate if :

or the relevant regional organ, the

proceeds of the coffee, the vehicle, the
የሽያጩን ገንዘብ ለማጓጓዣና ከሽያጭ ጋር
extra load or the product sale shall be,
የተያያዙ ወጪዎች እንዲቀነሱ ተደርጎ
after deducting expenses related to
ለባለቤቱ እንዲመለስ ይደረጋል፤
transportation and transaction, returned
to the owner;

ለ) ያጸናው ወይም ባለቤቱ በዚህ አንቀጽ ንዑስ b) Upholds the decision or the owner fails to

በመቆጣጠር በቀጥታ ለሚሳተፉ ተቋማት of seizure organ, who directly participate in
አቅም ግንባታ እና ቀሪው ፳ በመቶ (ሃያ illegal coffee regulation and remaining 20%
በመቶ) ቡናው በተያዘበት አስተዳደር እርከን (twenty percent) for local development of

ክፍል ስድስት SECTION SIX

ልዩ ልዩ ድንጋጌዎች MISCELLANEOUS PROVISIONS
፵፬. የመተባበር ግዴታ 44. Duty to Cooperate
፩/ ማንኛውም ሰው ይህን ደንብ በማስፈጸም ረገድ 1/ Any person shall have the duty to cooperate

፵፭. የተሻሩና ተፈጻሚነት የማይኖራቸው ህጎች 45. Repealed and inapplicable laws
፩/ የቡና ጥራት ቁጥጥርና ግብይት ደንብ ቁጥር 1/ Coffee quality control and marketing regulation
number 161/2009 is hereby repealed.
፩፻፷፩/፪ሺ፩ በዚህ ደንብ ተሽሯል፡፡
፪/ የዚህን ደንብ ድንጋጌዎች የሚቃረን ማንኛውም 2/ Any rule, directive or customary practice
ደንብ፣ መመሪያ ወይም ልማዳዊ አሠራር በዚህ that is inconsistent with the provisions of
ደንብ በተመለከቱት ጉዳዮች ላይ ተፈጻሚነት these Regulations shall not apply to the
አይኖረውም፡፡
matters covered by this Regulation.
፵፮. የመሸጋገሪያ ድንጋጌዎች 46. Transitory provisions

Any person, who has certificate of competence
ማንኛውም በቡና ንግድ ወይም በአገልግሎት
of coffee trading or service providing, shall
ሰጪነት የብቃት ማረጋገጫ ምስክር ያለው ሰው
have to obtain certificate of competence as per
ይህ ደንብ ከወጣበት ቀን ጀምሮ ባሉት ስድስት
this regulation from the Authority or the

appropriate regional organ within six months
አካል በዚህ ደንብ መሠረት የብቃት ማረጋገጫ
after the issuance of these Regulations, until he

፵፯. ደንቡ የሚጸናበት ጊዜ 47. Effective Date
ይህ ደንብ በፌደራል ነጋሪት ጋዜጣ ታትሞ This Regulation shall enter into force up on the
date of publication in the Federal Negarit Gazette.
ከወጣበት ቀን ጀምሮ የፀና ይሆናል፡፡

ሃያ አምስተኛ ዓመት ቁጥር ፫

የቡና ግብይት እና ጥራት ቁጥጥርን ለመደንገግ የወጣ COUNCIL OF MINISTERS REGULATION

(እንደተሻሻለ) አንቀጽ ፭ እና በቡና ግብይት እና Federal Democratic Republic of Ethiopia

ውስጥ ግብይት እንዲካሄድበት ወይም ወደ ውጭ

፬/ "ጥብቅ የቡና መጋዘን’’ ማለት ባለሥልጣኑ 4/ “Bonded Coffee Warehouse” means a

በሚሰጠው ፈቃድ መሠረት የውጭ ቡና secured warehouse, where foreign coffee

ገዢዎች የገዙትን ወጪ ቡና በሀገር ውስጥ buyers, hoard with permission of the

፯/ "የአምራችና ኢንዱስትሪ ትስስር" ማለት 7/ “Coffee grower and Industry linkage”

በቡና አምራችና በወጪ ቡና ቆዪ means coffee production and sales process,

ክፍል ሁለት SECTION TWO

የቡና ግብይት አሠራር COFFEE MARKETING PROCESS

ሥራ ማህበራት ጋር በተፈቀደ የታጠበ እና primary co-operatives and coffee growing

ያልታጠበ ቡና ማዘጋጃ ኢንዱስትሪዎች፤ farmers;

አምራች አርሶ አደሮችና አልሚ ባለሃብቶች agreement of established out growers

፬/ የወጪ ቡና ቆዪ ኢንዱስትሪዎች ከቡና 4/ At the place mentioned in the contractual

፭. የአቅርቦትና ተረፈ ምርት ቡና ግብይት 5. Marketing of Supply Coffee and Coffee By

፫/ በኢትዮጵያ ምርት ገበያ የሚካሄድ የቡና 3/ In Ethiopia Commodity Exchange:

ለ) ቡና ላኪ ለወጪ ገበያ የሚሆን b) a coffee exporter shall only purchase

ምርት ቡና ብቻ በመሸጥ፣ coffee by product,

ሐ) የወጪ ቡና ቆዪ የአቅርቦት ቡና ወይም c) an export coffee roaster shall only

ተረፈ ምርት ቡናን ብቻ በመሸጥ፣ consumption coffee and sell coffee by

፮. አማራጭ የቡና ግብይትና አሠራር 6. Alternative Coffee Transaction and Process

የአቅርቦት ቡና ግብይት ትስስር የሚፈጥረው:- with coffee supplier or Commercial Coffee

የተመዘገበ የውል ስምምነት ሲኖር፣ contracting parties for a minimum of two

መ) የተዋዋይ ወገኖች የግብይት ዋጋ ስምምነቱ d) The agreement of the price by Contracting

ጭማሪውም በመቶኛ በውሉ የተገለጸ ከሆነ፣

ከሚያዘጋጀው ቡና ከ፸፭ በመቶ (ከሰባ Coffee producer agrees in the contract

በውሉ የተስማማ ከሆነ፣ all processed coffee,

ሰ) ሁለቱም ወገኖች በውል አፈጻጸም ላይ g) there is an agreement in the contract to

ሀ) ከቡና አቅራቢነት በተጨማሪ የቡና አቅራቢ፣ a) holds supplier-exporter certificate of

ለ) የአቅርቦት እና የወጪ ቡና ማዘጋጃና b) Submits ownership evidence or lease

ውል ያለው ስለመሆኑ የሚያቀርብ ከሆነ፣ processing and warehousing industry,

ሀ) የኢንቨስትመንት ፈቃድ፣ የመሬት ኪራይ a) Submits evidence of Investment license,

ኢንዱስትሪ ያለው ወይም የኪራይ ውል contract of supply and export coffee

ያለው ስለመሆኑ የሚያቀርብ ከሆነ፣ እና processing and warehousing industry, and

መ) ቡና አልሚና ላኪ ባለሃብቶች በኢትዮጵያ d) Agrees to sell with average and above

ለመሸጥ የተስማሙ ከሆነ፤ grade and destination.

፭/ የወጪ ቡና ቆዪ በአምራችና ኢንዱስትሪ 5/ Export coffee roaster may export coffee by

ጠብቆ ቆልቶ ወይም ቆልቶና ፈጭቶ ወደ roasting or roasting and grinding

ውጭ ለመላክ ከተስማማ፣ እና according to the coffee quality standard

ባንክ በተመሳሳይ ጊዜ ካስመዘገቡት የቡና export coffee registered by coffee export
