GOVERNMENT LAW

Government law is a system which helps to control the society of a nation .


Mainly the people of the parliament enforced this laws upon a nation to ensure
the government is effective and citizens rights are protected. There are three
branches in government . the deifination of them are given below :

1. Legislative branch : The legislative branch has the primary power to make the
country’s law . People of the legislative branches are 350 members of the
parliament .

2. Administrative or executive branch : Executive branch has the power to


enforce the law of the nations . people of the executive branch are deputy
minister , chief minister etc .

3. Judicial branch : judicial branch helps to apply and interpret the laws . Mainly
the judges are include this branch .

TYPES OF GOVERNMENT LAW


There are two types of government law , they are given below :
1 . Common law
2. Statutory law

1. Common law : Common law is also called case law . Common law are the laws
that judge enforce based on previous laws . its not a written law .

2. Statutory law : Statutory law is a written law which is enforced by the legislative
branch . Statutory law can be passed by various government agencies of a country
.

THE ROLE OF GOVERNMENT IN LAW MAKING


While making a law government follows various steps . These steps are essential
for proper formulation and implementations of laws . Steps follow by the
government while making laws are given below :

STEP 1
In this step the parliament members gather together and discuss about law and
decision . After discussing for a while they decide the overall goals , vision and
direction on specific issues .

STEP 2
In this step the parliament member attempts to convert party policy into official
government law following correct procedures . After that the executive branch of
the government develops new policy and law . And then the legislative branch
approve the policies and passes the new law to give legal effect of the policies .
During this time the government ministry issue a discussion documents called
white and green paper on the policy or law . Due to the white and green paper
Stakeholders or opposing parties tries their best to negotiate or put the pressure
on the new law through media etc.

STEP 3
In this step the law is finalized by the relevant government branches and minister.
The policy then published as a white paper. The white paper contain the detail
information about the policy . During this time members of the parliament debate
about the policy again. After the approval of the parliament members , its is then
consider by the cabinet .

STEP 4
After the cabinet consideration ,the policy is released for the public comment .
depending on the public comment, the government could make some changes if
necessary . Then the draft bill is sent to the legal advisor for approval . After that
minister of the parliament considers the draft bill .

STEP 5
After the bill is considered , it is then refer to the relevant portfolio committee .
The committee then reviews the bill and could make some changes .The portfolio
committee sends the report with some changes to the National Assembly . Then
the national assembly considers the bill and vote on it for the changes . After the
vote they finalize the bill .

STEP 6
When the law has been published , its up to the government departments and
minister to implement the law or policy .

From the above discussion we could say that the procedure making a law by
government takes a lengthy amount of time . It might take 4 to 5 years . But
these laws the rights of the citizen of nation .
