PERPETUAL EASEMENT OF

ROAD RIGHT OF WAY

KNOW ALL MEN BY THESE PRESENTS:

The DEED made and executed by ____________________, of legal age,


Filipino, married to _____________________________, with residence and postal

Philippines, herein referred to as the GRANTOR:

the GRANTEES;

WITNESSETH:

WHEREAS, the GRANTOR is the absolute owner of a parcel, Lot

WITNESSETH FURTHER:

WHEREAS, for and in consideration of the sum of

Currency, receipt in full of which the GRANTOR hereby acknowledged and
confessed to his entire and full satisfaction from ANDREW PROSPERO
SANTOS & CLAUDINE RAMOS SANTOS represented by CHERRY LUZ S.
STRENG, the GRANTEES, do by these presents, hereby GRANTS, in fee simple
and in a manner absolute and irrevocable, unto and in favor of the aforesaid
GRANTEES, their heirs successors and assigns, the above described parcel of
land as a PERPETUAL EASEMENT OF RIGHT OF WAY with a four (4)
meters wide, containing an area of ____________________ (_______) SQUARE
METERS, more or less;

WHEREAS, the GRANTEES, shall have the right to erect _ poles, and
single or multiple guy anchorages along the course of said line. GRANTOR
recognizes that the general course of the said lines, or the meters and bounds as
above described, is based on preliminary surveys only, and GRANTOR hereby
agrees that the easement and right-or-way and its general dimension hereby
granted shall apply to the actual location of said lines when constructed. Together
with the right of ingress along and upon said easement and right of-way and over
and across GRANTOR’S adjoining properties for the purpose of and with the
right to construct, maintain, operate, remove and reconstruct said lines; the right to
relocate along the same general direction of said lines; the right to relocate in the
same relative position to any adjacent road if and as such road is widened in the
future; the right to lease wire space for the purpose of permitting others to string
or lay wire or cable along said lines; the right to prevent excavation within the
easement area or for a distance of ________ feet on each side of the actual center
of said lines; the right to prevent construction of, within the easement area of for a
distance of ____ feet on each side of the actual center of said lines, any and all
buildings, structures or other obstruction which, in the sole judgment of
GRANTEES, may endanger or interfere with the efficiency, safety, and/or
convenient operation of said lines and their appurtenances and the right to trim or
remove trees or shrubbery within, but not limited to, said ___ foot space, to the
extent in the sole judgment of GRANTEES, as may be necessary to prevent
possible interference with the operation of said lines or to remove possible hazard
thereto. GRANTOR shall not make changes in grade, elevation or contour of
the land within the easement area as described above without prior written consent
of GRANTEES.

The Road Right of Way, however is not exclusive to the grantees, but may be used
by other persons so authorized by the grantees.

WHEREAS, the GRANTOR hereby bind himself, his heirs and legal
representatives, to warrant and forever defend all and singular the above described
perpetual easement and rights unto the said GRANTEES, its successors and
assigns, against every person whomsoever lawfully claiming or to claim the same
or any part thereof.
