Introduction to Law
Maximum marks: 60 Time allowed: 8 hrs
1) Read the following passages and answer the given questions. (20 marks)

A. I put my brother in charge of a bank account to give money to both himself and my son
until my son turns 25, at which time they evenly split the rest of the money.
1. Who will be the legal and equitable owner and why?
2. What is the nature of rights vested in my brother and my son?

B. I own a piece of land. I transfer half of it to A by mortgage and half to B by lease.


1. Who will be the corporeal and incorporeal owners and why?
2. What kind of rights do I have in my property and what is the nature of rights vested in A
and B?

C. My friend X has borrowed a hair straightener from me. Another friend of mine Y also
needs the hair straightener for a party. I sell my straightener to her for Rs. 1500 and I tell
her that she can take it from X before the party.
1. Explain what kinds of possession are involved in this example?
2. Can X refuse to give Y my straightener?

D. What advantages and problems can you identify with the Golden Rule of interpretation?

E. If a statute says, “it is offence to be drunk in charge of a carriage on highway” whether


riding a bicycle comes under it? If no, why? If yes, why? Which rule of interpretation
will be applied here?

2) Write short notes on the following. Explain them in your own words with relevant
examples. (20 marks)
A. Legal and Equitable ownership
B. Constructive and Mediate possession
3) Attempt any ONE question. (20 marks)

What are rights? How can you distinguish between legal rights, fundamental rights and human

rights? Explain with relevant examples.

OR

What is person? What is meant by “unit of jural relations”? Explain why animals, slaves and

unborn children are not legal persons.
