COMPLAINT AFFIDAVIT

I, JOZEL LACASTESANTOS-BAS, of legal age, Filipino, married and a resident

of Baliwasan St., Zamboanga City, after having been duly sworn according to law
hereby depose and say:

1. That I am instituting this criminal complaint against my husband BERNABE JAN

A. BAS who is of legal age, Filipino and a resident of Governor Alvarez St.,
Zamboanga City.
2. On June 8, 2017 we got married and since then we have been living as husband
and wife.
3. That on November 2019, I have my unfortunate miscarriage. Since the burial of
our unborn child my husband has been coming home drunk.
4. That on January 10, 2020, he started to be brutal in bed. He would immediately
remove my panties and, sans any foreplay, insert his penis into my vagina. His
abridged method of lovemaking was physically painful for me to resist his sexual
ambush but he would threaten me into submission.
5. As he was carrying out his carnal desires, I continued to protest by desperately
shouting: “Numa. Numa. Ta sinti yo dwele. Jan please, masakit." But my cries
were left in the air and he continued to satisfy his carnal needs.
6. That on In January 15, 2020, at around 7 in the evening, Defendant went home
reeking of alcohol. I prepared dinner for him, but instead he grabbed me by the
hand forcefully dragging me to our room. Despite my resistance he continued
kissing me and even punched me in the stomach and slapped to submission and
laid me to bed. I tried to resist by holding on to my panties but the Respondent
pulled them down so forcefully they tore on the sides. I stayed defiant but he was
strong enough to spread my legs and inserted his penis to my vagina in a
thrusting motion. I cried begging him to stop but to no avail.
7. That on January 22, 2020, at around 11 in the evening, as I was asleep in my
undergarments, as I usually wear at night to sleep, inside our bedroom, I was
awaken by the arrival of Defendant. I heard the door of the room open and felt
him coming to bed. I eventually felt that my panty was being pulled down by him
and that I was immediately turned that made my body face the bed. I told him
that I had headache and abdominal pain due to my forthcoming menstruation
and beg him politely to stop his sexual lust. He just shrugged the idea and told
me “Noma ya reklama, hindi yo para asta hindi kita dos pwede ase anak”. He
then inserted his penis in my vagina and started thrusting. I tried to resist the
sexual conduct but I was too weak to completely repel it.

 8. On February 20, 2020, I decided to move out from our marital home as I fears for
my safety from his brutal and inhumane treatment.
9. That in view of the foregoing facts, I am instituting this criminal complaint for rape
against my husband.
