SINUMPAANG SALAYSAY

I am Maria Leonora Santos y Cruz, Filipino, 16 years of age, and with a

resident of Sitio Balili, Brgy. Palanginan, Iba, Zambales, after having been duly
sworn in accordance with law, hereby depose and state that:

1. On 29 September 2020, at 10:05 in the evening, me, Marlon Merto y

Garcia and five (5) of our friends namely Rex Martines, Boyet Gaslao,
Rudy Fernan, Carlos Sison, and Felix Sintas were about to go home
after we had a drinking spree at the residence of Mr Marlon Merto;

2. That when some of our friends have left the place, Marlon Merto y
Garcia offered to take me home at my house at Sitio Balili, Brgy.
Palanginan, Iba, Zambales as he will also take our friend, Carlos Sison
at their house located 5 kilometers away from mine;

3. That the three of us left their home ridden in a tricycle and Carlos
Sison was the first to get off as his house is located 5 kilometers way
before mine;

4. That when we were on our way to my house, he suddenly stopped his

tricycle in a vacant lot beside the riverbank, came to the passenger’s
side and said to me while he was holding a fan knife pointed towards
my neck “BUMABA KA JAN! HUWAG KANG SISIGAW, KUNDI
MAMAMATAY KA”;

5. That I, with stern reluctance and starting to cry, alight from the tricycle
saying “BAKIT GANTONG GINAGAWA MO? ANONG GAGAWIN MO
SA AKIN?”

6. That he grabbed by right hand and pulled me out of the tricycle and
into the ground and told me to undress myself. Out of fear of my life, I
followed his order;

7. That he pushed me to the ground, drew his shorts down to his knees,
he lie on top of me, pointed th e fan knife unto my neck as he inserted
his penis into my vagina;

8. That I tried to push him away with my hands but my efforts turned futile
because of his weight on me and when I slapped his face, he punch ed
me in the stomach making me unconscious; and

9. That I woke up after I heard a woman’s voice yelling “HOY! ANO

YAN?! ANONG GINAGAWA MO DIYAN?! HOY! ITIGIL MO YAN!
PULIS! TULONG!”
 IN WITNESS WHEREOF, I have hereunto set my hand this 30th day of
September 2020, in Iba, Zambales.
