STUDY OF BIASED JUDICIAL SYSTEM (IN
THE NOVEL 'A PASSAGE TO INDIA'
The indigenous people claimed that the British justice system had been developed to better
the lives of the masses so that they could enjoy a dignified life and dignity for themselves.
E.M. published A Passage to India. Forster has an essential role in the unequivocal and equal
portrayal in British rule's political partisan judicial structure. The plot of the novel is based on
important people, among them Dr. Aziz, Mrs. Adela Quested, Cyril Fielding, Mr. Turton, Mr.
Godbole and Ralph Moore. The storey is about the artist. The novel begins with
Chandrapore's presentation in the British era. The novel features Miss Adela and Mrs. Moore.
Miss Adela is comes to India to marry Ronny Heaslop, a lawyer. At the court of
Chandrapore. Mrs. Moore encounters Dr. Aziz over time and they are now close friends.
They intend to visit Marabar Hills, being interested to know India. The expedition is indeed
to some degree a fruitful trip but a strange incident takes place on the last hour of the journey
in the Marabar cave. Not only Dr. Aziz, but all the significant characters were influenced by
the enigmatic incident. In the Chandrapore courts, Dr Aziz, accused of having angry and
assaulted Miss Adela, is released from the court with a statement from Miss Adela who sues
him. Dr. Aziz changes his attitude to British governor and his mindset absolutely.
If a court has an independent investment firm to conduct any prosecution, it will achieve a
high degree of equitable and fair justice. Justice can be done in some manner without the
involvement of an efficient investment organisation. When a foreign government controls
another country, it becomes harder to get justice. In Dr. Aziz's scenario, there may be a
shortage of an unbiased investment firm. No investment body investigates Dr. Aziz's
situation. The only declaration by Miss Adela is reported to prove Dr. Aziz guilty. Her
announcement is only evidence of his crime. Even the judge would not seek to establish any
single body comprised of an Indian and a British officer. In this terrible and unpredictable
situation, no law is possible, particularly for any Indian, very easily to consider.
But the condition and the situation are so created that it accepts its thoughts and decides to
lodge Dr. Aziz, who loves her from the depth of his heart. The fact that the Britons have little
faith in delivering a truth-based justice can be seen by such a horrible event. They only use
judicial machinery to colonise Indians and their psychology.
Discrimination on The Basis Of Equality
The first rationale of every legal system in the world is fair representation before the judge.
How should anyone be viewed fairly and without discrimination if equality is not defined.
Before the court system developed by the British Raj there is no definition of the right to
freedom. The injustice is obvious right from the outset of the arrest of Dr Aziz. He has no
justification for his detention when he is arrested. The senior official of the inspector who
arrests him is arrested by plain order. The case illustrates that average citizens are not entitled
to freedom and may be prosecuted for no reason at all.
Manipulation of Witnesses
In the judicial proceedings, eye witnesses play a vital part. For Dr. Aziz, Mrs. Moore can by
her comments, play a significant part in acquitting Aziz. Her son called Ronny Heaslop
returned her to England and was also a judge in the court where Dr. Aziz's case was brought.
Mrs. Moore is really conscious that Dr. Aziz has not attempted to annoy Miss Adela and to
rape her. She is convinced to state against Dr. Aziz in order to show him guilty, but before he
intends to leave the county she does not surrender. "There is a trail going on in the meantime,
though, and most of us are mindful that we'd better enter and help ourselves along, rather
than being nasty," said Ronny Heaslop. Can you chat in a jury box like that? ”
Conclusion
It can be said that 'A Passage to India' is a remarkable literary work that looks at all facets of
colonialism that effectively founded the colonists of India. This novel also outlines the
conditions under which the Indian subcontinent dominates the social, economic and political
sphere. The novel clearly indicates that the judges' position in building the British Empire
was highly significant. It would have been difficult for the British to govern the world
without influencing and exploiting the justice system mechanism. The only way they
managed to create the British Empire was by judicial process. In the fake and abused case of
the novelist Dr. Aziz, the increasing anomalies in the judicial system are evident. This novel
is a quest to change Aziz's understanding of the British Rule in India.
