AFFIDAVIT OF DESISTANCE
I, ALFREDO V. MENOR, of legal age, Filipino citizen, married and a resident
of Rizal, Roxas, Isabela, after having been sworn to in accordance with law, deposes and
says:

That I am the same person executing this affidavit;

That I am the guardian and uncle of one Jasper P.Toledo who is the victim of an
incident that transpired along the National Highway of Barangay Sotero Nuesa, Roxas,
Isabela on or about 5:15 o’clock in the afternoon of July 20, 2017 involving a Kawasaki
Bajaj single motorcycle driven by Gerald A. Pangan;

That I am about to file appropriate charges with the authorities for the reckless
imprudence resulting to physical injuries against Gerald A. Pangan, the driver and
registered owner of the Kawasaki Bajaj single motorcycle;

That after a long and deliberate talk/conference with the driver and after arriving
at a settlement of Ten Thousand Pesos (Php.10,000) which is agreeable to us, I now make
known my disinterest in the further prosecution of the case/claim I am about to file
against Gerald A. Pangan;

That I am also by this affidavit make a quitclaim against Gerald A. Pangan, the
driver and the registered owner of the Kawasaki Bajaj single motorcycle that bumped my
nephew, Jasper P. Toledo;

That I am freely and voluntarily executing this affidavit to attest to the truth and
veracity of all the foregoing facts and for all other legal intents and purposes.

IN WITNESS WHEREOF, I have hereunto set my hand this 2nd day of August
