PETITION

COMES NOW, the PETITIONER, through the undersigned counsel, unto

this Honorable Court, most respectfully avers:

1. That the PETITIONER is Filipino, of legal age, married, resident

of and with postal address at Brgy. _____________, San Pablo City, Laguna;

2. That PETITIONER and his wife are the owners of a parcel of land
located in the Brgy. of _____________, San Pablo City, Laguna, containing an
area of ONE HUNDRED FIVE (105) SQ. M., and covered by Transfer
Certificate of Title No. _____________ of the Registry of Deeds for San Pablo
City, Laguna; Certified True Electronic Copy of the aforesaid Title consisting
of four (4) pages is hereto attached as Annex “A”;

3. That the parcel of land covered by Original Owner’s Copy of

Transfer Certificate of Title No. _____________ was mortgage to
_____________ on ____________;

4. That however when the said Original Owner’s Copy of Transfer

Certificate of Title No. _____________ was about to surrender the title to
Registry of Deeds for the cancellation of the mortgage, they discovered that the
third page of the said Original Transfer Certificate of Title was missing;

5. That notwithstanding thorough and diligent efforts, the aforesaid

Title can no longer be found and might have been misplaced/slipped during

processing of the mortgage with _____________ and may be considered lost
for all legal intents and purposes;

6. The Affidavit of Loss of the Original Owner’s Copy of said Title

executed by the PETITIONER, and duly registered with the Registry of Deeds
for San Pablo City, Laguna, is hereto attached as Annex “B” while the
Certification duly issued by the said Registry of Deeds, stating that the said
Title is still intact and existing is hereto attached as Annex “C”.

7. That the Original Owner’s Copy of said Title has not been
delivered to any person or entity in pledge or to guarantee any.

P R A Y E R

WHEREFORE, pursuant to law and in view of the fact that the Owner’s
Original Owner’s Copy of Transfer Certificate of Title No. _____________
had been lost, it is most respectfully prayed of this Honorable Court that, after
due hearing, an Order be issued directing the Registry of Deeds for San Pablo
City, Laguna, to issue a Second Original Owner’s Copy of Transfer Certificate
of Title No. _____________ which shall, in all respects, be entitled to like faith
and credit as the Original Duplicate.
