The department has received multiple complaints regarding your food establishment operating in violation of the Emergency Order under MCL 333.2253 — Gatherings and Face Mask Order as well as not providing protective measures for employees. In the complaints, it was stated your facility continues in the dining room service even after the new emergency order took effect. In addition, numerous calls have been received regarding employee safety standards not being followed, specifically not providing or requiring face mask protections to your employees. Both of these specific complaints were verified during my visit. As you’rr aware, we are in the midst of a global pandemic, itis imperative to adhere to all ‘emergency orders issued by the Michigan Department of Health Human Services (MDHHS). ‘The current Epidemic Order states in part: “Bars and restaurants will be open for outdoor dining, carry-out and delivery only”. (MDHHS Order Attached) Currently, based on the number of days you have violated this order you have accumulated a '$2000.00 fine that will be addressed in a second notice. Additional days will accumulate your fine total as your facility operations continue to violate the Epidemic Order issued October 18, 2020. A separate violation order is being determined regarding the number of complaints received and verified for the lack of safety and protections offered to your employees. At this time, complaints are being forwarded to Michigan Occupational Safety and Health ‘Administration (MIOSHA). MIOSHA will administer further enforcement action in terms of fees charged to your facility. More so, the department will be forced to escalate enforcement action, specifically revocation of your operation license for year 2020 - 2021. ‘You are required to follow all rules applicable from the Executive Orders directed by MDHHS in order to reduce the spread of Covid-19.
