1.A person becomes creditor and debtor at the
same time over the same obligation.

Art. 1276 Effect of merger to guarantors

1.Obligation of the guarantors are extinguished.
2.Reason: Accessory follows the principal.
3.Effect of merger in the person of the guarantor,
principal obligation remains.

Art. 1277 Effect of merger in joint obligation

1.Affects the co-debtor only whom the two
characters of creditor and debtor are merged.
2. While in solidary obligation, extinguishes the

entire obligation.
