A. INTRODUCTION
On behalf of OWNER (IOCL), M/s. Technip India Limited (TPIL) as EPCM CONSULTANT
invites e-Bids for COMPOSITE WORKS FOR CIVIL & STRUCTURAL, PIPING,
MECHANICAL, PROCESS SAFETY, ELECTRICAL AND INSTRUMENTATION WORKS,
RESIDUAL ENGINEERING, STATUTORY APPROVALS AND MECHANICAL
COMPLETION, PRE-COMMISSIONING, COMMISSIONING OF INTERCONNECTION
SYSTEM FOR STORAGE TANK INTEGRATION for IOCL Paradip Refinery on Open
Domestic Competitive Bidding under Single Stage Two-Bid system (Part-1: Techno-
Commercial and Priced Part and Part -2: Technical Part) from competent contractors with
sound Technical and Commercial capabilities fulfilling the Qualification Criteria as stated
below.
The Composite Works mainly covers Civil & Structural, Piping, Insulation and Painting,
Equipment erection, Process Safety, Electrical and Instrumentation, dismantling & disposal
and other related works as per Scope of Work defined in various parts of the bidding documents
along with statutory approvals, Mechanical Completion, Pre-commissioining, Commissioning,
submission of final documentation and handing over of all facilities to OWNER as required for
Storage Tanks Integration at IOCL Paradip Refinery.
All the Works shall be carried out as per item descriptions, Price Schedule/Schedule of Rates,
Technical Specifications, Standards and IFC drawings and shall be measured accordingly in
line with the terms and conditions of the bidding document.
During execution of Works, there may be increase /decrease of Quantities and Price/Unit Rates
shall remain firm for any increase / decrease in quantity as per provisions of terms & conditions
of the Contract. Bidder shall be required to execute the work anywhere within the IOCL Refinery
plant boundary on the same Unit rates, and terms and conditions.

Pre-Bid Meeting At 10:30 Hrs on 27.11.2020 in the following address:

9 Techno-commercial 15.00 Hrs. on one day after bid submission (*). If date
Bid opening date identified as (*) above happen to be a declared holiday in TPIL,
Chennai/ IOCL, New Delhi, the next working day shall be
considered.
ii. Bidder who is meeting the criteria mentioned in 12.1.i above for Electrical works
on its own, should have valid electrical contractor license. The copy of the same
shall be submitted by the Bidder.
iii. In case the Bidder does not meet the criteria mentioned in 12.1.i above for Electrical
and/or Instrumentation works on its own, the bidder may also be considered
provided:-

b. Bidder shall furnish with his bid, the Memorandum of Understanding (MOU)
with the proposed Sub-contractor(s) for executing the work pertaining to
Electrical and/or Instrumentation for the scope mentioned in the Tender
Documents. In case of Bidder being successful bidder, the MOU with Sub-
Contractor(s) (submitted during Qualification), shall be binding on the Bidder
at least till the pendency of the Contract.
c. The Bidder shall furnish documentary proof in the form of copy of work order(s)/
contract agreement(s)/ relevant pages of contract document(s)/ drawings/ data
sheet, completion certificate(s), fulfilling the qualification criteria, for
themselves, and for their Sub-Contractor (s) (in case they have proposed Sub-
contractor(s).
d. The successful bidder or its subcontractor, as the case may shall furnish a copy
of the valid electrical license to Engineer-in-charge before commencement of
any electrical work or work pertaining to Electrical System for working in the
state in which the job site is located.
12.2 QUALIFICATION CRITERIA–FINANCIAL
A) The Annual Turnover (ATO) of the tenderers during any of the preceding three
financial years i.e., 2019 - 2020, 2018 -2019 and 2017- 2018, shall be equal to or
more than INR 41,54,27,000/-
B) Bidder shall have positive Net worth. To establish the same, bidder shall furnish the
latest Audited Financial Statement including Auditors reports, Audited Balance
Sheet, Profit & Loss Account, Notes, Annexures (if any) etc.
C) In case Net worth is negative, the bid shall be considered for further evaluation only
if the bidder provides an undertaking from financial institutions towards “financial
support for executing orders in case of order placement on them.
D) The net worth means paid up share capital, share application money pending
allotment* and reserve # less accumulate losses and deferred expenditure to the
extent not written off.

# Reserves to be considered for net-worth shall be all reserves created out of the
profits and securities premium account but shall not include reserves created out of
revaluation of assets, write back of depreciation and amalgamation.
In case the financial year closing date is within 9 months of bid due date and audited
annual report of immediate preceding financial year is not available, bidder has the
option to submit the financial details of the previous year immediately prior to the last
financial year. Otherwise, it is compulsory to submit the financial details of the
immediate preceding financial years.
Example, in case, audited annual report of immediate preceding financial year (year
ending 31st March) is not available and where bid closing date is up to 31st
December, the financial details of the previous year immediately prior to the last
financial year may be submitted. However, in case the bid closing date is after 31st
December, it is compulsory to submit the financial details of the immediate preceding
financial year only.
F) Any of the following documents furnished by the bidder in support clause no. 12.2 (A)
and 12.2 (B) above shall be:
a) Audited published Annual Report
OR
b) Audited Balance Sheet and Profit and Loss Statement
OR
c) Financial statements duly certified by practicing Chartered Accountant (not
being an employee or a Director and not having any interest in the bidder’s
company) where audited accounts are not mandatory as per law.

QUALIFICATION CRITERIA–COMMERCIAL
12.3 For experience, the bidder, as a main or as a sub-contractor, should have Executed /
completed at least one or two or three contract (s) involving Similar works of minimum
value(s) as indicated below during the last 10 Ten years ending on last day of the
month immediately previous to the month in which last date of bid submission falls (in
case of extended bid submission date, original bid submission date shall be considered)
➢ One “Similar” completed contract having similar works valuing not less than the
amount equal to INR 40,38,87,000/-
OR
➢ Two “Similar” completed contracts each having similar works valuing not less
than the amount equal to INR 32,31,10,000/-
OR
➢ Three “Similar” completed contracts each having similar works valuing not less
than the amount equal to INR 24,23,33,000/-
Note: The Similar completed order value for the purpose of calculation of BQC shall
be exclusive of GST or service tax.
a) The Bidder shall furnish documentary proof in form of the copy of (i) work order(s)/
contract agreement(s)/ relevant pages of contract document(s) mentioning the value
& the scope of work, Schedule of rates and (ii) completion certificate(s) issued by
owner/ Consultant indicating executed value and certificate(s) of commissioning of
previous plants from owner/ Consultant, fulfilling the qualification criteria for
themselves.

b) In case Executed Value is not mentioned in the Completion Certificate, Work Order
value with amendments, if any, shall be considered towards BQC requirements.
Where the executed value is not mentioned in the Completion Certificate, the copy
of certified Bill shall also be acceptable for determining the executed value if
submitted along with Completion Certificate. Executed Value or Work Order Value,
whichever is higher, shall be considered towards BQC requirements as above and
Offer shall be evaluated accordingly.
ii. Bidder has to submit a Certificate from the End User/ Owner/Consultant of the
Owner stating that the Main Contractor has intimated them about the
engagement of Bidder as a Sub-Contractor OR the Bidder had been
allowed/permitted as a Sub-Contractor in the concerned job(s). (This is not
required in those cases where Completion Certificate/Commissioning
Certificate issued in the name of Bidder directly by the End User/
Owner/Consultant of the Owner is available). The Copy of Certified Final
Bill/TDS Details against the concerned job shall also be submitted by the
Bidder, if so required by IOCL/Technip.
iii. Copies of Completion Certificate issued by the Owner/ Owner’s Consultant. The
said Certificates shall have details like work order no. /date, brief scope of work,
ordered & executed value of the job, completion date etc. In case bidder is not
able to furnish the completion certificates from the Owner/Owner’s Consultant
in his name then the Certificate issued in the name of Main Contractor shall also
be considered as proof of completion of the relevant job.
e) If the bidder cites any reference of a job executed for IOCL or executed for some
client through Technip and the bidder is not able to furnish documentary evidence,
the internal records of IOCL or Technip (as the case may be) shall be considered.
f) A job executed by a bidder for its own plant/ projects can’t be considered as
experience for the purpose of meeting requirement of BQC of the Bidding Document.
However, jobs executed for Subsidiary/ Fellow subsidiary / Holding company will be

NOTES:
Indian Bidders who would like to quote directly shall have Indian ESI Registration in
a)
their own name and submit Copy of the same Registration Certificate along with the
Bid.
If ESI Registration is not available during Bidding as mentioned above, concerned
b) bidder is required to submit the ESI registration certificate (if applicable) within 15 days
from the award of work to EIC.
16.2 Duly notarised Power of Attorney in favour of person authorized to sign and submit
the bid.

18 Agreement Applicable for this tender
4. The Bank Guarantee for EMD shall be valid for 3 (Three) Months beyond the bid
validity. The EMD BGs shall be submitted along with techno commercial bid only.
5. Wherever applicable, scanned copy of EMD Instrument (i.e. B.G /MSEs/NSIC
certificate etc.) must be uploaded along with offer & original of BG should reach to
the office of tender issuing authority in sealed envelope super-scribing tender name,
tender number, date of opening and bidder’s name, preferably before the deadline of
submission but not later than 7 (seven) working days from opening date of techno-
commercial (unpriced) bids
E. GENERAL:
6. Bidders shall submit the following documents in Original to TPIL/ IOCL within Seven
(07) days from the date of Un-priced Bid opening:
a) Original EMD BG, if applicable
b) Original copy of Integrity Pact Agreement
7. Bidders/Agencies shall ensure submission of complete information/documentations in
the first instance itself. IOCL reserves the right to complete the evaluation based on the
details furnished by the agencies without seeking any subsequent additional
information. Bids not in compliance with Bidding Document or with incomplete
information documents are liable for rejection.
8. As far as possible Bidders are requested to clarify all the technical queries related to
tender before the bid opening and ensure compliance of all provisions of the bidding
document.
9. The bidder is expected prior to the submission of its/his/their bid, as a prudent and
experienced Contractor to make its/his/their own assessment of all the requirements of
the work and of the accuracy, correctness and completeness of any estimate, data, or
information furnished by the OWNER in the Tender Documents and of the availability,
suitability, propriety, adequacy and/or soundness of any suggestion made by the
OWNER in the Tender Documents as hereinabove referred to
10. The bidder is also expected prior to finalization of its/his/their bid to visit and examine
the job site and its surroundings and to familiarize itself/himself/themselves of the
ground realities, the availability, existence and suitability of facilities and sources of
supply required for the work(s) and the environmental conditions which can be
encountered, and collect all data and other information which the bidder may require
for preparation and formulation of its/his/their bid. The CONTRACTOR will not to be
entitled to make any claim against the OWNER or to raise any objection or defense to
any claim based on the ignorance of existing or expected conditions, or on the lack of
adequate information, or of any plan, estimate or expectation based on a different
perception or expectation or information.
11. The tenderer shall be deemed before tendering to have undertaken a thorough study
of the proposed work, the job site(s) involved, the site conditions, soil conditions, the
terrain, the climatic conditions, the labour, power, material, and equipment availability,
transport and communications facilities, the availability and suitability of borrow areas,
the availability of land for right of way and temporary office and accommodations,
quarters, and all other facts and facilities necessary or relevant for the formulation of
the bid, supply of materials and the performance of work.
12. Submission of authentic documents is the prime responsibility of the bidder. Wherever
IOCL has concern or apprehension regarding the authenticity/ correctness of any
document, IOCL reserves the right to get the documents verified from issuing
authority/any relevant source. If documents (part or full) are found forged, such offers
will be summarily rejected and EMD will be forfeited and may be debarred from future
tenders.

13. IOCL (Owner) / Technip (Consultant) reserve the right to assess Bidder's capability and
capacity to perform the Contract by taking into account past performance, and various
aspects such as concurrent commitments etc. IOCL (Owner) / Technip (Consultant)
also reserve the right to use in-house information for assessment of capacity of bidder
and their performance on jobs completed/in progress for evaluation purpose.
14. Relevant supporting documents towards other requirements specified are also to be
uploaded along with Techno-commercial bid failing which bid is liable for rejection.
15. IOCL reserves the right to reject any or all of the tenders or any parts of the tender so
received and may cancel the tender in part or full, extend the due date of Tender
submission etc. without assigning any reason. Although ordinarily the lowest
responsive bid amongst the bids submitted by tenderers and considered by the
OWNER to qualified and competent shall be preferred, the OWNER reserves the right
not to accept the lowest bid if in its opinion this would not be in the interests of the works
16. Tendering can be abandoned by OWNER without assigning any reason. No
compensation is paid for the efforts made by the contractor.
17. In case any Bidder is found to be involved in cartel formation, his Bid will not be
considered for evaluation / placement of order. Such Bidder will also be debarred from
bidding in future.
18. Canvassing in any form by the Bidder or by any other agency on their behalf may lead
to disqualification of their Bid.
19. Unsolicited clarifications to the offer and / or change in the prices during the validity
period would render the bid liable for rejection.
20. Techno-commercial part of the Bids shall be opened at 15.00 Hrs. (IST) on the due
date. Time and date of opening of Price Bids shall be notified through e portal to the
qualified and acceptable bidders at a later date. Bidders may view the Bid opening
through IOCL e-Tendering portal-https://iocletenders.gov.in.
21. Bidders are to quote their most competitive rates. Negotiations will not be conducted
with the bidders as a matter of routine. However, Owner reserves the right to conduct
negotiations.
22. Legal dispute, if any, shall only be within the jurisdiction of Local Court in DELHI.
23. All communication will be made through e-Tendering web site
(www.iocletenders.gov.in). However, IOCL reserve the right to take cognizance of
the communication made outside e-Tendering Portal under exceptional circumstances.
24. Bidder cannot make any claim against IOCL towards its expense incurred in connection
with the preparation and delivery of their bids, site visit, participating in the discussion
and other expenses incurred during bidding process.
25. Bidder should make sure that their priced bid contains only prices. Rates mentioned
elsewhere shall not be taken into cognizance. Offer shall be liable for rejection if any
condition directly or implied, recorded in Priced Bid.

26. After opening of the technical bids but before the opening of the price bids, the bids
may be rejected for unsatisfactory performance or adverse comments which have come
to the notice after the issue of the tender enquiry.
27. Offers not meeting statutory requirement are liable for rejection.
28. Bidders are advised to visit Announcement section/ Information for DSC/ Bidders
Manual Kit/ FAQ of e-Tender Portal before bidding.
29. Notwithstanding any other condition /provision in the tender documents, in case of
ambiguity or incomplete documents pertaining to Bidder Qualification Criteria (BQC),
bidders shall be given maximum one opportunity with a fixed deadline after bid opening
to provide complete & unambiguous documents in support of meeting the Bidder
Qualification criteria (BQC). In case the bidder fails to submit any document or submits
incomplete documents within the given time, the bidder’s tender is liable to be rejected.
However, IOCL reserves the right to make any further queries.

31. Any Addendum/Corrigendum/Sale date extension in respect of above Tender shall be
issued on our website: https://iocletenders.gov.in only and no separate notification shall
be issued in the press. Bidders are therefore requested to regularly visit our website to
keep themselves updated. Failure of Bidder to submit tender without taking cognizance
of Corrigendum / Amendment (if any) issued by IOCL shall make bid liable for rejection.
32. IOCL does not take any responsibility for the correctness of tender documents obtained
from any other source. Bidders are advised to visit above mentioned website before
submitting their offer for official version of the tender document including any
corrigendum / amendment if any, which shall be binding to the bidder.
33. Owner reserves its right to allow Public Sector Enterprises (Central/State), purchase
preference as admissible/applicable from time to time under the existing Govt. policy.
34. For detailed specifications, terms and conditions and other details, refer complete
Bidding Document.
35. Tendering can be abandoned by OWNER without assigning any reason. No
compensation is paid for the efforts made by the contractor.
36. Consultant appointed for the project / work shall not be allowed to participate in the
tender either directly or indirectly. An indirect participation shall include participation
through an affiliate or as subcontractor, consultant or supplier with the exception of
participation as TPIA for the same job. The expression ‘affiliate’ for the purpose of this
clause will include any person, or company or association (howsoever designated)
who/which is a member of the consultant (if the consultant is a joint venture or
consortium or who or which directly or indirectly holds 10% (ten percent) or more of the
capital or voting capital of consultant (if the consultant or any of its members is a
company or a body corporate) or who or which is consultant or sub-contractor of the
consultant with regard to the project.

48. Bidder shall submit the undertaking as provided in Annexure-I on their company letter
head duly signed by their authorised representative along with the bid.
49. Fax of Acceptance (FOA) /LOA (Letter of Acceptance) will be issued by the OWNER to
the successful BIDDER.
