Weekly Legal Updates Feb Week 4

1. AMU Minority Status: Supreme Court Refers the Matter to Seven Judge Bench

The apex court has referred the matter of determining the correctness of minority status granted to Aligarh
Muslim University a to seven-judge bench. A three-judge bench headed by Chief Justice Ranjan Gogoi
referred the matter to the larger bench for defining the parameters for grant of minority status to educational
institutions.

2. Anil Ambani held Guilty of Contempt of Court:

A division bench of the Supreme Court of India held Anil Ambani, Chairman of Reliance Communications,
guilty of contempt of court for defaulting payments to Ericsson as per the undertaking given to the Court.
The three Reliance Companies - RCom, Reliance Telecom and Reliance InfraTel- are also held guilty of
contempt, and fine of Rs One Crore each has been imposed on them. The court has said that there would be
no no jail for Anil Ambani if reliance pays Rs. 453 crores to Ericsson in 4 weeks.

3. Supreme Court on Medical Negligence: Wrong diagnosis does not amount to medical negligence.

The apex court dismissed the appeal filed by a man against order of National Consumer Disputes Redressal
Commission (NCDRD) which dismissed his complaint alleging medical negligence on the part of a hospital
in the death of his wife. The court upheld the NCDRC order stating that wrong diagnosis cannot be
considered to be a part of medical negligence as diagnosis included opinion and perception of the doctors
which can vary.

4. We as Constitutional Courts can’t direct the Election Commission to debar the candidates with
more than two children: Supreme Court of India

The Supreme Court on 25th February dismissed a PIL seeking a direction to the Election Commission of
India to require all political parties to not field candidates who have more than two children and to also
declare the two-child norm a mandatory criterion for government jobs, subsidies, besides other measures to

control the population explosion. The court said that we as constitutional courts can’t direct the election
commission to debar candidates from constesting elections if they have more than 2 children. The petition
was filed by Advocate Ashwini Upadhyay.
